Erik and Lyle Menendez can celebrate a new court victory -- the judge gave them a new sentence, which allows for parole ... so now, they can get out of prison after facing the state parole board.

00:00Well, the celebration was in full swing here in L.A. after the re-sentencing hearing for the Menendez brothers.
00:08And so the media has been reporting this as a huge moment that now the parole board is going to hear whether Eric and Lyle should be recommended for release and send it on to the governor.
00:19Here's the thing. They're all wrong. They're just all wrong.
00:23That ship sailed two months ago.
00:25Governor Newsom has already asked the parole board for a review.
00:29To review the case.
00:30So what really happened here is this, that, yes, there was on the table a motion to re-sentence them.
00:38So they took out life without the possibility of parole and they made it 50 years to life, which makes them eligible.
00:44So now what the judge has done is said, we will send this over to the parole board can now make a decision on whether they want to hear the case.
00:52But they're already hearing the case.
00:53And the reason Mark Garagos wanted this hearing was not even to get re-sentencing.
00:57I mean, I know this, right?
00:58I mean, we do two angry men together.
01:00So the reason he really wanted this is what he wanted was the judge to change the conviction from murder to manslaughter because they would be instantly free because they've served way more than the max.
01:12That didn't happen.
01:13So, you know, Garagos is happy.
01:14I mean, it's really more of a loss for the DA than it is a win for Garagos because it's already at the parole board.
01:21So I just want to give you my opinion about this.
01:24Gavin Newsom, I find this really shocking that Gavin Newsom, who knows how to calculate and is almost certainly going to run for president, people are divided right down the middle on whether these guys should ever get out.
01:38So Newsom took it upon himself.
01:41He picked up the political hot potato.
01:43He picked it up as soon as the new DA got elected and said, I want it sent to the parole board.
01:49So the parole board is looking at two things.
01:53Are they a danger if they get out?
01:55And have they been rehabilitated?
01:57Given the fact that Newsom said, I want them to review it, if the parole board comes back, and I think they're gonna, and say they're not a threat and they are rehabilitated, I think Newsom is going to let them out.
02:11I think so.
02:12And he would have whatever political cover, if he even wants that, he would have it from the parole board.
02:18But he still makes the, listen, he denies Sirhan, Sirhan role.
02:23So he has the power and the inclination to-
02:27The reason, because he set it in motion, it feels like-
02:30He's gonna do it.
02:31He's inclined to let them out.
