02:46We learned Ozzy Osbourne has died, and we also have new reporting just in tonight on Cosby Show actor Malcolm Jamal Warner.
02:53Now we learn both he and his eight-year-old daughter were struggling in that current, what authorities tried to do.
02:59But we are going to begin tonight with the tributes pouring in at this hour for music icon Ozzy Osbourne,
03:03lead singer of Black Sabbath, known as the godfather of heavy metal.
03:07Later showing another side, a more personal one, on the MTV reality show The Osbournes.

03:38Black Sabbath's stage shows were notorious, with Osbourne dubbed the Prince of Darkness,
03:43infamous for his drug use, once biting the head off a bat on stage.

03:52After Sabbath, he went solo, earning 15 platinum albums, with hits like Crazy Train and Mama, I'm Coming Home.

05:24Tonight, we have now learned he and his eight-year-old daughter were both struggling in those strong currents.
05:29Volunteers frantically trying to save them.
05:31And authorities now say they tried CPR on the actor for 45 minutes.

05:43we're learning about the desperate efforts to try to rescue the actor and his daughter from a rip current off Costa Rica.

05:51This officer telling us on Sunday, Warner was swimming with his eight-year-old when surfers spotted them struggling and dove in to help.
05:59One surfer using his board to bring the little girls safely to shore.
06:03But volunteer lifeguards had to pull Warner and another surfer from the ocean.
06:07Both surfers survived, but Warner showed no vital signs after minutes of CPR.

06:16She was safe, but very scared, police told me.
06:20The 54-year-old was declared dead at the scene.
06:23An autopsy confirming the cause was accidental drowning.

07:52It's almost refreshing tonight here in New York, but by Friday, it will be that air you have to wear.
07:58And that's what they're feeling along the Mississippi River, where those extreme heat warnings are in place.
08:02Through tomorrow afternoon, you can see some of the numbers, like 110 Memphis and Jackson, down to New Orleans, those warnings, and back up to St. Louis.
08:10Heat advisory for Chicago, they will see likely the hottest of the season, or to at least tie it with the feels like at 106.
08:17New York, that 103 on Friday, Washington, D.C., 104.
08:20And we're watching tonight, David, some damaging wind threats in the northern plains into Minnesota, that arrowhead there, and a flood watch as well with Duluth.

08:31In the meantime, we turn to the new scare on the runway, a Delta flight taking off for Atlanta as another passenger plane was landing on the same runway.
08:40Authorities say the two passenger jets just 200 feet apart on the Mexico City runway.
08:44That Delta 737 with 150 people on board going to Atlanta, reaching about 60 miles an hour, then slamming on the brakes.
08:51The pilot saw an Aeromexico jet right overhead coming into land on the same runway.
08:56A terrifying close call on one of the busiest runways in Latin America is under investigation tonight after two passenger jets were just 200 feet from each other.
09:08A Delta 737 with 150 people on board bound for Atlanta was cleared for takeoff and picking up speed down the runway at Mexico City International Airport.
09:18At the same time, air traffic control also cleared an Aeromexico jet to land on the same runway.
09:24The Delta pilots, at this point reaching about 60 miles per hour, saw that aircraft flying right over them as it came in for landing and slammed on its brakes, just 200 feet apart, aborting takeoff and avoiding what would have been a catastrophe.

09:48But we don't know if the controller told the Aeromexico aircraft to land on the left-hand and not the right-hand runway where the Delta jet was.
09:56It's unclear if the pilots of the Aeromexico jet saw the outbound Delta plane.
10:01It's the second no near miss for Delta in the last week.
10:04Friday, a Delta regional jet coming in for landing at Minot International Airport in North Dakota made a hard turn after spotting a B-52 bomber.
10:13The Air Force, saying that the military jet seen here flying over a state fair with its location turned off, was never told about an inbound commercial jet by Minot's air traffic control, which the FAA says is run by a private company.
10:28And, David, back to that flight from Mexico City to Atlanta.
10:33Aeromexico says it is working with authorities and investigating.

10:53Tonight, as the White House struggles to turn the page from the Epstein investigation, the Justice Department announcing they will speak with Jeffrey Epstein's former companion, Ghislaine Maxwell, who's now serving a 20-year prison sentence for trafficking underage girls to the sex offender.
11:09Deputy Attorney General Todd Blanche, who until recently was President Trump's personal attorney, says he plans to meet with Maxwell soon, saying if Ghislaine Maxwell has information about anyone who committed crimes against victims, the FBI and the DOJ will hear what she has to say.
11:27For years, Trump socialized with Epstein and Maxwell and was asked about her when she was arrested in 2020.
11:33Do you feel that she's going to turn in powerful men? How do you see that working out?
11:37I don't know. I haven't really been following it too much.
11:39I just wish her well, frankly.
11:41In an interview with Axios shortly after, he doubled down.
11:44Mr. President, Ghislaine Maxwell has been arrested on allegations of child sex trafficking.
11:50Why would you wish such a person well?
11:52Well, first of all, I don't know that, but I do know that...
11:53She has. She's been arrested for that.
11:55Her friend or boyfriend...
11:57Epstein.
11:57...was either killed or committed suicide in jail.
12:00She's now in jail.

12:06Today, the president claimed he didn't know his Justice Department was planning to speak with Maxwell.
12:11I don't know about it, but I think it's something that would be... sounds appropriate to do you.
12:15Trump, clearly frustrated by the Epstein story, today tried to shift the spotlight onto Barack Obama,
12:21baselessly accusing the former president of treason in the 2016 election.
12:25He's guilty. They... this was treason. This was every word you can think of. They tried to steal the election.
12:34Trump falsely claiming Obama deliberately manufactured and politicized intelligence reports about Russian interference in the 2016 election.
12:43Tonight, in a rare rebuke, Obama firing back, his spokesman pointing to the widely accepted conclusion
12:49that Russia worked to influence the 2016 presidential election, but did not successfully manipulate any votes.
12:56Noting those findings were affirmed by Republicans in Congress, including Secretary of State Marco Rubio.
13:02The spokesman adding,
13:03These bizarre allegations are ridiculous, and a weak attempt at distraction.
13:08Trump's efforts to shake the Epstein case have only increased scrutiny of their friendly relationship of more than a decade.
13:15Epstein was asked about it in a 2010 deposition in a civil suit.

13:53When Epstein was arrested in 2019, Trump said they'd had a falling out and hadn't spoken in 15 years.
14:00On Capitol Hill today, Democrats and some Republicans are demanding that the Justice Department release the Epstein files.
14:07Today, the House Oversight Committee voted to subpoena Maxwell to testify.
14:11The president's staff, administration, his own children, his vice president have promised that these files would come out, and now we're being told it's a hoax.
14:21It just doesn't wash.
14:22And again, David, the deputy attorney general says he plans to meet with Ghislaine Maxwell soon.
14:28In a statement, her attorney saying they are, quote, grateful to President Trump for his commitment to uncovering the truth in this case.
14:35And we should note she's appealed her 20-year sentence and is eager to get out of prison.

14:43There's also breaking news in the Menendez case tonight, just weeks before this crucial hearing over their potential freedom.
14:48Tonight, we've learned here that Eric Menendez has had a health emergency.

14:54Tonight, one month before a pivotal parole hearing, Eric Menendez is in the hospital with a serious medical condition that his attorney says should convince the governor of California to set him free.
15:05His wife's daughter posting on social media, my dad is in the hospital due to passing a kidney stone.
15:10Please keep him in your prayers.
15:12Sources tell ABC News his condition may be even more complicated.
15:16So tonight, defense attorney Mark Garagos speaking with TMZ, saying Eric needs to be out of prison.
15:21And he medically furloughed in advance of the hearing so that he can work with the parole attorney and get up to speed and be ready.
15:31Eric Menendez and his older brother Lyle were convicted of the 1989 murders of their parents in a case that captivated the country.
15:38In May, a judge resentenced them, making them eligible for parole.
15:42If the parole board recommends releasing the Menendez brothers, David, Governor Newsom has suggested he could make a final decision in the case by Labor Day.

16:02Yeah, David, inside the Idaho Maximum Security Institution, they are no stranger to a high-profile inmate.
16:09But officials tell me Brian Koberger is as high-profile as it gets.
16:13And that will be a factor in determining his safety and his placement, an assessment that can take about 7 to 14 days before he's officially placed.
16:21Now, the facility is double-walled and reinforced with razor wire on the outside and equipped with various security levels on the inside to accommodate up to 535 of the most dangerous and volatile male inmates.
16:35But, David, officials here tell me those serving out life sentences are often the easiest to deal with because for them, David, this is home and it always will be.
