00:00You were interested in her daycare?
00:01Yes, ma'am.
00:02OK.
00:03I have video footage of the children with me,
00:05and I have pictures.
00:07I don't recall none of this.
00:08You don't?
00:09Hmm.
00:10Oh, my god.
00:11You have a bad memory.
00:12There are some people that just will never get it,
00:17and they will go through life never getting it.
00:20This is Judy Justice.
00:30Daycare owner, Lakeisha Thomas, is suing her former client,
00:44Kalisha Frye, for one month of daycare services,
00:48fraud, and breach of contract.
00:51Court come to order.
00:55Have a seat, please.
00:57Hello, Judge.
00:58Hello.
00:58Case number 1116, Thomas v. Frye.
01:02You're welcome.
01:03Ms. Thomas, how long have you had a daycare center?
01:06Since 2006.
01:07And are you licensed?
01:09I am licensed right from the start.
01:11In what state?
01:12Georgia.
01:13How many children are you allowed to have in your daycare facility?
01:16I'm allowed to have six in the daytime and six at nighttime.
01:18Give me the hours that you watch children during the day.
01:22From 530 to...
01:24In the morning?
01:25530 a.m. to 530 p.m.
01:28It's 12 hours there, but it's nine hours per child.
01:33What does that mean?
01:33I can care for children for nine hours, up to nine hours, because of my family home daycare.
01:39How many children can you have full-time as children in the home at one time?
01:45At one time. Six children.
01:47During the day?
01:48During the day. Yes, ma'am.
01:49And when you say six at night, does that mean overnight, that they stay overnight, or part of the night?
01:55That means, I guess, part of the night.
01:58You don't know?
01:593 p.m.
02:003 p.m.
02:00Do you usually have children who stay the night?
02:04No, ma'am.
02:04So it's just really during the day that you take care of up to six children a day?
02:09Yes, ma'am. My night hours are 3 p.m. to 11 p.m. or 4 p.m. to 12 a.m.
02:17Okay. And you're paid additionally for that?
02:19Yes, ma'am.
02:20Do you usually have six children in your program?
02:22Yes, ma'am.
02:23Since 2006, would you estimate that most of the time you have maximum capacity children?
02:30Yes, ma'am.
02:31Ms. Fryer, the first time that you went to the plaintiff's home
02:35to look for a place for your two children, did you go during the day?
02:39Yes, ma'am.
02:40And how many children were there?
02:41I'll say four, five, four or five.
02:45Okay. This is about money that you claim is owed to you for taking care of the defendant's children.
02:51Correct.
02:52And falsely disputing a charge.
02:54So I'm going to start with Ms. Fryer. How old are your children?
02:57Now, they're one and five.
03:00Now, you are originally from Texas?
03:02Yes, ma'am.
03:03You were moving to Georgia?
03:04Yes, ma'am.
03:05Month, day, and year?
03:08I moved in September.
03:14September? I really don't know the date. It was like September 10th of 2020.
03:19I contacted her a month before, I mean two months, almost three months, June 2020.
03:24To tell her that you were moving and that you were interested in her daycare?
03:27Yes, ma'am.
03:27Okay. And did you go to see it before you enrolled your children?
03:31Yes, ma'am. I actually went to see her and we, uh, I told her that I got a...
03:35In what month? Was that in September?
03:37That was when I went to go... Oh, it was September. Yes, ma'am.
03:40Do you remember what date in September?
03:42I'll say, I'll say like the...
03:45Do you know when in September?
03:47I do. Around the 10th through the 12th.
03:50When did your children start at her daycare?
03:53Uh, I'll say the... It was after the 14th. Yeah, the last week of September.
03:57Give me the date.
03:58Oh, the 20th. I think it was the 28th. Yep, 28th.
04:02That's when they started?
04:04Yes, ma'am.
04:04Both full-time?
04:06Yes, ma'am. It was actually past full-time.
04:08Okay, so full-time. Yes, ma'am. And then you agreed with her, according to what I read,
04:12about how much she would be paid every two weeks to take care of the children.
04:16Yes, ma'am.
04:16And what was she supposed to be paid every two weeks to take care of the children?
04:20352.
04:21Bi-weekly?
04:22Bi-weekly.
04:23Did you sign a contract?
04:24Uh, yes, ma'am.
04:25You have a copy of the contract?
04:28Now see it, please.
04:38What is this loan and or daycare tuition repayment form?
04:43My loan and daycare tuition form is for parents who cannot pay me on my stated Monday tuition
04:52payday or if a personal loan is loaned to anyone. And the daycare tuition repayment form is because
05:02Ms. Fryer couldn't make Monday payments. My tuition is due on Monday.
05:06Okay, but she says you made an arrangement with her to pay $352 bi-weekly. Was that your agreement with her?
05:11That was my agreement with her up until January.
05:14Just a second.
05:14Sorry.
05:15Was that your agreement with her?
05:16Yes, ma'am.
05:17Okay. And you started September 28th?
05:19Yes.
05:20And did you make bi-weekly payments through October 28th?
05:24No, ma'am. I, um, actually, October 23rd was the last time she seen my children because my...
05:31Just a second. You were actually there for four weeks.
05:34Yeah. Yeah. No.
05:36Yeah, four weeks.
05:36I was, yeah, I was there actually for four weeks.
05:38Your children were there for four weeks.
05:40Not too long.
05:42Just a second. We were actually physically in the location for four weeks.
05:45Yes, ma'am.
05:46So if your children were there for four weeks, you should have paid her $704.
05:51Did you pay her the $704?
05:54Yes, ma'am. I paid her that amount. I paid bi-weekly.
05:57What I want to know is, did you pay her $704?
06:01Yes, ma'am.
06:01And those payments, you did not have reversed at a bank or anything else?
06:05No, ma'am.
06:06You actually paid her $704?
06:08Yeah, we didn't do that cash out.
06:10How much did you receive from the defendant between September 28th and October 23rd?
06:18That's a question.
06:20When did you marry?
06:23Um, we're in that process at this time.
06:25Now it gets married.
06:26So you're not married.
06:27Right.
06:27So the answer is, you're not married.
06:28You're married or you're not married.
06:30People know when they're married or when they're not married.
06:40Daycare owner Lakisha Thomas claims her former client, Kalisha Fryer, is responsible for one
06:50month of daycare services after Kalisha disputed the charges.
06:54Look at your papers, and I want to know how much you were paid for those four weeks.
07:01It should have been $704.
07:02The registration fee is $65 per child.
07:05No joke.
07:06Yes, ma'am.
07:06I understand something.
07:08I asked you a question.
07:09I said, how much were you paid by her between $9.28 and $10.23?
07:15The biweekly should have been $704.
07:18That's correct.
07:19How much did you receive from her in total?
07:22$704 plus $130.
07:23Okay, so you received what you started to say was a registration fee plus the $704.
07:30Were any of those charges reversed by a bank?
07:32Those charges were two weeks.
07:35That's either yes or no.
07:36Yes, ma'am.
07:37Which two weeks?
07:38The week of October 24th, that week.
07:42You mean the week prior to that.
07:45So she reversed one payment to $352.
07:48Is that what you're saying to me?
07:49She reversed two payments.
07:51Ms. Friar stated she was, her children were with me until October 23rd.
07:55That's not true.
07:56They came another week in October, and they came three weeks in November.
08:01So I don't know where.
08:02You know they were there, actually physically there?
08:05In my presence, yes, ma'am.
08:07Really?
08:07May I see your records?
08:08You can, yes, ma'am.
08:10Here's November, here's October.
08:13I have video footage of the children with me, and I have pictures of the children with me.
08:17I would love to see.
08:18I would love, just a second, I would love to see it.
08:21Absolutely.
08:22Now, before I look at that, and it's not that I wouldn't like to look at it,
08:25which I probably will, do you want to rethink of when your children were last there?
08:31They weren't there.
08:32October 23rd of 2020.
08:34Oh my God.
08:36She says that they were there.
08:38That's Arthur and Keyshawn.
08:40Their name is Arthur and Cashton.
08:41Arthur and Cashton.
08:42Okay.
08:43Well, I only have October through October 30th, the 26th through the 30th.
08:47That's one week.
08:49Oh, there's November.
08:50I have through, well, you have through November 19th.
08:56So you have video showing me the children there after October 23rd.
09:01Yes, ma'am.
09:02I'd like to see it.
09:03Yes, ma'am.
09:03It's labeled Judy Justice.
09:08If she want to press that one, then she can see the timestamp.
09:10Yes, sir.
09:14This one right here, Judge.
09:15The one top right.
09:21Well, I have one photo here on October 29th.
09:25I mean, she could have got the photo anywhere.
09:28And timestamp?
09:28Just a second.
09:29No, it says October 29th, 1025 AM.
09:32Okay, she could have...
09:33Are these your children?
09:34Um, I can't see.
09:38Oh, wow.
09:44Yeah, yeah, okay, good.
09:52That's a video, Your Honor.
09:53What?
09:54That, if you go back...
09:56Yeah.
09:57This is a video.
09:58It's a screen recording of a...
09:59Would you do me a favor?
10:00See if you can negotiate that for me.
10:02Okay.
10:05You can see here, it says home, November 10th, 9.58 AM.
10:08It's my birthday.
10:10It's just...
10:13Got it.
10:13Yeah, she screen recorded a security footage or something.
10:17You mean the security footage from her house?
10:19Yeah, it's timestamped at November 10th, 2020,
10:23at 9.58 AM.
10:25Got it.
10:26Do you want to see the video?
10:27I mean, she could have found the video and screen recorded it.
10:30It's...
10:30God!
10:31I could easily screen record this right now.
10:33Okay.
10:33So I want you to prove to me that you were not in Georgia
10:37after September 23rd.
10:39Um, do you want me to go through my phone?
10:41I don't care how you prove it to me.
10:43I want you to look in your phone and show me that you were not in Georgia after September 23rd.
10:49October.
10:50Can I show you text messages from my last conversation, please?
10:57It's October 23rd.
10:58October 23rd.
11:01Oh, this is a different phone.
11:02This is a different phone.
11:04I got a whole nother phone.
11:05I'm ready.
11:05Everybody who can't find something finds a whole other phone.
11:08They get a whole other phone.
11:09See, if something happens to their phone, who's that?
11:12My husband.
11:13Stand up.
11:14How you doing?
11:16Stand up.
11:19Did you move with your wife from Texas to Georgia?
11:22No, ma'am.
11:23I did not.
11:23Where were you?
11:24In Texas.
11:25What were you doing there?
11:26Working.
11:27And why did your wife go to Georgia?
11:29Well, she wasn't my wife at the time.
11:31I met her during this process.
11:34What date did you meet her?
11:35Um, I would probably say, uh, September 18th or so.
11:40Where did you meet her?
11:41How did I meet her?
11:42Uh, on a website.
11:44But she was in Georgia at that time.
11:46No, ma'am.
11:46I was not in Georgia.
11:48No, she was in Georgia.
11:49Yes, ma'am.
11:50She was in Georgia when you met her on a website.
11:52Yes.
11:52Don't touch him.
11:55So you met her on a website.
11:56Yes.
11:57When did you marry?
11:58Um, we're in that process at this time.
12:01Now getting married.
12:01So you're not married.
12:02Right, but I mean.
12:03Is that, so the answer is you're not married.
12:05You're married or you're not married.
12:06People know when they're married or when they're not married.
12:08You understand, like, I'm saying we're in that process right now
12:11as far as we are going to court for that.
12:13Hmm?
12:14Because I have to get some things off of my, in order to get married.
12:17Sir, either you're married or you're not married.
12:19You are currently not married.
12:21Currently, right.
12:21Which I answered.
12:22Either you're married or you're not married.
12:24I mean, you asked me the question.
12:25I gave you the answer to begin with.
12:26Then just answer the question.
12:27I'll give you that.
12:28She said, it's my husband.
12:29Right.
12:30It is.
12:31No, it's not your husband.
12:32I mean, but common law marriage.
12:33No, there's no.
12:34Common law marriage would make sense.
12:36It doesn't exist anymore.
12:37Oh, well, according to the staff of police in Texas, it does exist in Texas.
12:43Okay.
12:43The only time common law may exist in some jurisdictions, because it's outlawed in most,
12:47is when you live open and notoriously with someone for a period of either 10 or 20 years or more.
12:53Oh.
12:54Then you can be considered in some jurisdictions, maybe in some remote state, but most states
13:00have outlawed common law marriage.
13:02Oh, well, I'm just giving you the information that was given to us.
13:04Just give me information.
13:06So you're not married.
13:06You met in September of 2020.
13:082020, right.
13:09She was in Georgia.
13:10You were in Texas.
13:11Yes, I was.
13:12Okay.
13:12Were you working in Texas?
13:14Yes, I work in Texas.
13:15Okay.
13:15What were you doing?
13:16What kind of work?
13:16I do music.
13:18I'm an entrepreneur in the music business.
13:20Had you known her before?
13:21No, ma'am.
13:22I did not.
13:22So you met her online?
13:24That's what I'll give you information of earlier.
13:25Okay.
13:26When was the first time you met her in person?
13:28Um, probably, um, February.
13:31So you met her in September.
13:32September, October, November, December.
13:34You didn't see her Christmas time?
13:36No.
13:36What about Thanksgiving?
13:37Did you see her on Thanksgiving?
13:38No, I don't celebrate holidays, no.
13:40When you were communicating with her, was she in Georgia?
13:43Yes, ma'am.
13:44Did you know where she was living in Georgia?
13:46No, ma'am.
13:47I did not know exactly where she was living.
13:49Did you know if she was working?
13:50Yes, she was working at that time.
13:52During Thanksgiving or Christmas, did she ever tell you that she stopped working?
13:56Yes.
13:57When did she tell you she stopped working?
13:58Um, October, somewhere.
14:00Whenever the kids had symptoms of COVID, they had to be released from, go to the 14 days of COVID.
14:09And she had to do an extra 14 days.
14:11So that made four weeks that she had to sit for COVID.
14:15And she eventually lost her job.
14:17Do you remember what date that was?
14:18Around October 23rd, around that, or 25th, somewhere around.
14:24Okay.
14:27On November 11th, hey, we're going to be there around 9.
14:31I don't recall none of these messages.
14:32You don't?
14:33No.
14:33Hmm.
14:34You have a bad memory.
14:36Yeah.
14:36Bad memory and nasty.
14:38Daycare owner, Lakeisha Thomas, has accused her former client, Kalisha Fryer, of owing for
14:57one month of daycare services.
14:59Kalisha disputed the charges with her bank, claiming her boys did not attend the daycare that month.
15:06Can you show the witness, please, the video of the children from November 10th?
15:28Was there ever a time that the defendant's children were out sick?
15:32No.
15:32Did she ever tell you that they were out sick?
15:34No, ma'am.
15:34Okay.
15:36I assume that if your children were sick and you were out with them for a month,
15:39that you took them to see some sort of pediatrician or urgent care.
15:43Can I see proof of that?
15:45Um, actually, I went to a hospital.
15:47And we didn't have Medicaid or nothing like that.
15:49Well, they would give you a...
15:50No, they just gave us a not.
15:52They didn't have COVID.
15:54What's the name of the emergency room that you went to?
15:57I don't know, honor.
15:59I just barely moved to Georgia.
16:00It's like South something.
16:02South Georgia hospital.
16:04Tell me on what date you reversed the charges on checks that you were giving to her.
16:08I reversed the charges.
16:10And did you ever reverse charges?
16:12I, um, actually talked to Keisha and let her know that what was going on before this time.
16:19And she was cool.
16:22She was like, all right, you know, you're a cool person.
16:23Not all, uh, and there's no...
16:25I just asked you a simple question.
16:27I said, did there come a time when you reversed charges on a bank for money that you had paid her?
16:33Uh, I contacted my bank.
16:35That's what I'm asking you.
16:36Oh, I let them know.
16:38On what date did you contact your bank to tell them to reverse the charges on a check?
16:43January 2021.
16:45January what?
16:46Um, 7th, I guess.
16:4728th.
16:49No, 7th.
16:50Well, if according to you the last time that your children were there was on October 23rd,
16:57why would you be reversing charges in January?
17:00Because she was still getting my money from me.
17:02My kids wasn't there the four weeks, so why should I pay?
17:04What I'm asking you is you had to have paid her.
17:07Was she on an automatic payment?
17:09Yeah.
17:10So what you did was you told the bank to stop making automatic payments.
17:15But you didn't stop in November.
17:18You stopped the end of January.
17:20You didn't stop in November.
17:22According to you, you stopped in January.
17:24Because she said she was going to stop them.
17:27Okay, now I'll see the email.
17:29Text message.
17:30Yeah.
17:31Got you.
17:33There you go.
17:34On November 11th, at 519 in the morning, hey, we're going to be there around nine.
17:51Mm-hmm.
17:52GM OK will be here.
17:54At 535 AM, you respond, we just woke up.
17:59No worries, we'll be here.
18:01I don't know where Cash Cup is, and she didn't either.
18:04If you find it, let me know.
18:06And then on November 20th, they're not coming.
18:09I don't recall any of these messages.
18:12You don't?
18:13No.
18:13Hmm.
18:15You have a bad memory.
18:16Yeah.
18:18Bad memory and nasty.
18:22Bad and nasty.
18:24November 20th.
18:25Bad and nasty.
18:26Bad and nasty.
18:26Sit.
18:30You sit down.
18:30I mean, it's the way that you sit.
18:32Sit down.
18:32Stand up.
18:33Good.
18:37So what you want me to think about looking at this is that the plaintiff, who's been in
18:43business since 2006, and as kids, you said she had four or five when you went there to visit,
18:49that she somehow got somebody to change the digitalized date stamp on a video, and she
18:55somehow created text messages with you going back, oh my god, for October 7th.
19:06That is a child that belongs to you.
19:09That's my tongue.
19:11Right.
19:12All these text messages go all the way back to October 1st from the same number.
19:17Do you understand?
19:19I can stand.
19:20All the way.
19:21Sit.
19:22You said stand.
19:23Which one do you want me to do?
19:24I didn't ask you to stand.
19:25I said, do you understand?
19:27Oh, do I understand?
19:28Do you understand?
19:29They go all the way up to November the 20th, that she made all that up.
19:33It's 2020.
19:34You know, there are some people, there are some people that just will never get it,
19:40and they will go through life never getting it, and the sad part of it is people that go through
19:45life who never get it are going to teach that to their children.
19:49Judgment for the plaintiff in the amount of $1,900.
19:52We're finished.
19:53Court is adjourned.
19:57She was wrong.
19:57I'm glad justice was served.
19:59She did Photoshop.
20:00People told me that folks would come up with whatever they want to come up with to get out of it,
20:04so.
20:04You can do anything to an awful.
20:06I don't even know, and I don't even care.
20:08I ain't going through this again.
20:09I'm glad it's over.
20:12See, I told you there's some upside of learning all the technical time stamps and location stamps and
20:19things like that.
20:19The plaintiff really had it all together, and she had her evidence, and it was very clear from the
20:24timestamp on the video and the photo that it was at her home.
20:28It had a location on a map that you could see and a specific time, and it just shows that technology
20:33can be useful sometimes.
20:35I'm sure it would be very helpful if someone could teach me how to use those things.
20:40Until that time comes, I'm going to have somebody sitting right over there who can get it for me.
20:46I don't know.
20:46I've really tried, but I find it very difficult to master.
20:49I've just learned how to send an email, which for me is a giant leap forward into the century.
20:55I'm doing my best.
20:56We have time.
