00:00I have a business in renting jet skis?
00:04Yes, ma'am.
00:05Did you have any accident?
00:07No.
00:08And they're still working?
00:09No.
00:11Your Honor, I have right here that he is re-rented out,
00:13elisted online.
00:14Oh, well, that's a problem.
00:16Um.
00:17You're renting them to other people.
00:20This is Judy Justice.
00:30Jeremy Wissman is suing jet ski renter Amanda Hartley
00:44for property damages and lost revenue.
00:47Court come to order.
00:48Have a seat, please.
00:49Hello, Judge.
00:51How are you, Kevin?
00:52Good.
00:53Case number 1142, Wissman v. Hartley.
00:56You're welcome.
00:57You have a business in renting jet skis?
01:00Yes, ma'am.
01:01How long have you had the business?
01:02April 2021.
01:04What did you do before that?
01:05I was in the military and I work in missile defense also.
01:08That's my full-time job.
01:10So this is sideline?
01:11It is.
01:12Did you buy equipment?
01:13Yes, ma'am.
01:14What did you buy?
01:15I have three sets of jet skis.
01:17When was the first time you purchased jet skis?
01:19September of 2020.
01:21What kind?
01:22Sea-Doo, watercraft.
01:23Were they new or used?
01:25Used.
01:25How much did you pay for them?
01:277,000.
01:28What year were they?
01:30One's a 2006, one's a 2008.
01:33Take a look.
01:34And you had three sets, you said?
01:36Correct.
01:37When did you buy the second set?
01:38The second set I bought in April of this year, 2021.
01:43Were they also used?
01:44Yes, ma'am.
01:452006 and 2008.
01:46Also Sea-Doo's?
01:47One's a Sea-Doo, one's a Yamaha.
01:49How much did you pay for them?
01:51$14,500.
01:52What was the difference?
01:54The market.
01:55The after.
01:56Fascinating.
01:57Yeah.
01:58Yeah.
01:59That's fascinating.
02:00Everything was going a lot higher than Blue Book value.
02:03Because they couldn't get parts and stuff.
02:05Yes, ma'am.
02:06I know.
02:07Car manufacturers have the same problem.
02:09So you paid double for pretty much the same thing?
02:12Pretty close.
02:13And when did you buy the third set?
02:14July of this year.
02:15And what did you buy?
02:16They're actually 1997's.
02:18I had a friend who had them in storage and just wasn't using them and asked if I wanted
02:24to use them in my rental business.
02:25And they're still working?
02:26No.
02:27No?
02:28No, I got them.
02:29They had been sitting for a couple years and they weren't running and they're still
02:34with the mechanic.
02:35They're still not running?
02:36Because they haven't been used at all this summer.
02:37How much did you pay them for those?
02:38A thousand.
02:39Oh, not bad.
02:40No.
02:41Okay.
02:42So the ones that you rented to Ms. Hartley were the ones that you purchased in April of
02:462021?
02:47Yes, ma'am.
02:48And it is your claim that you returned them damaged?
02:50Yes.
02:51And the defendant said, well, they may have hit a rock or two, but nothing serious.
02:56Is that your answer?
02:58No.
02:59Well, did I make that up?
03:01I don't know.
03:02Just a second.
03:03Just a second.
03:04Hold on one second.
03:05Uh, so for 2006, Sea-Doo, depending on the model, it looks like they ranged between
03:10$7,000 and $11,000.
03:12For 2006?
03:13Yes.
03:14So you got a bargain in 2020.
03:17Yeah.
03:18When I bought them, the value was a lot lower, though, too.
03:20Yeah.
03:21Amazing.
03:22Okay.
03:23I thought that you indicated here that, yeah, you may have anchored them someplace.
03:27They may have hit a rock or two, but they weren't.
03:29There were some rocks at the lake, but not that I had run into any rocks.
03:32No, I didn't say you ran into a rock.
03:34I didn't say you ran into a rock.
03:35I thought it said that you sort of anchored them and then you went doing something and
03:39they may have hit up against a rock.
03:41Isn't that what you said?
03:42I mean, maybe I misunderstood you, but I didn't write up against on rocks.
03:46No, I didn't say that you wrote against a rock.
03:48Did you indicate to the plaintiff that when you had the jet skis out, you had anchored
03:53them?
03:54They did have anchors?
03:55Yes.
03:56You had anchored them and maybe gone for a swim, gone for whatever.
03:59And they may have hit from a wave, from a current they may have hit against a rock.
04:05Yes.
04:06Okay.
04:07Now, that's not something that you think about, like, you know, the baby burped on my jet
04:13ski.
04:14That's a, oh my goodness, I anchored it too close to rocks.
04:18And I heard it hitting up against a rock.
04:21So you heard it.
04:22No, I had it anchored up at a boat dock, which is really where they should be, right?
04:28Have them on a boat dock.
04:29So there are rocks around the lake.
04:31But not that I was allowing them to repeat and hit against rocks or that I was hearing
04:34the big yesterday rocks.
04:35We checked on them throughout the night.
04:37They weren't really moving very much.
04:38They seemed very okay.
04:39It wasn't very windy.
04:41Do you have photographs of them?
04:42I do.
04:43I'd like to see them.
04:48Ms. Hartley, when you took the jet skis, what color were they?
04:51So the jet skis were supposed to be red ones.
04:54That was the ones that we discussed for me picking out.
04:56That's the ones that was listed online.
04:58The red ones, sir, are the ones from 2020?
05:01Yes.
05:02The ones that you used were the ones that you purchased in 2021?
05:06Correct.
05:07Okay.
05:08Is there any reason that you switched them?
05:10I believe they had broke from the previous rental.
05:14The ones from 2020?
05:16Yeah, they were in the shop.
05:17So I had that set left.
05:19And when we did discuss it, I wasn't 100% sure whether it was going to be the red ones
05:25or the ones I had just-
05:27It doesn't matter 100% sure or not.
05:29Your Honor, if I may speak, that's not what he has said to me on the day that we met.
05:33What did he tell you?
05:34So that day, I viewed the Sea-Doo and I viewed the Yamaha.
05:37And then he says the red ones were out rented, had not been brought back yet.
05:42That the Sea-Doo and that the Yamaha is not what I would be taking out because they had rocks sucked up in them, water sucked up in them.
05:49He still had to go through and clean it out from people that dropped it off, left it damaged with him.
05:53And then when I went and picked up and paid the rest of them out to take jet skis out, these were the ones that he sent with me.
05:59So since he changed his mind on that and these were what was sent out with me, I presumed that they were safe to drive and that they had been repaired.
06:06Let me ask you this question. Did you take them both out?
06:09I did.
06:10Okay, and you used them?
06:11Yes.
06:12You're not renting damaged jet skis. You're suing her for $10,000, which would make these things totally inoperable.
06:22But you're renting them to other people.
06:25They're going to be repaired fully.
06:27They're not going to be repaired by her.
06:29And later today.
06:30Ms. Keeling.
06:31Yes.
06:32Where is this coin collection?
06:33It's in the car.
06:34How did you get here to court today?
06:36A rental.
06:37I have to tell you that I'm not liking your attitude.
06:40Yes.
06:41I have to stand out.
06:53Jet ski owner Jeremy Wissman claims Amanda Hartley damaged both of his jet skis while renting them.
07:00Let me ask you this question. Did you take them both out?
07:02I did.
07:03Okay, and you used them?
07:04Yes.
07:05And did you take the trailer?
07:06Yes.
07:07Did anything happen with the trailer?
07:09So with the trailer, it was missing pins, and so we had to purchase our own pins with the trailer.
07:14And then the lights were not working, so we had to purchase our own lights for that trailer.
07:18So when we dropped off the trailer and the jet skis, I had let him know that the lights were not working.
07:22I had to then purchase my own.
07:23Did you send him that by text or by phone?
07:25By message.
07:26By messenger.
07:27May I see it?
07:28Yes.
07:29Let's see.
07:30Mr. Wissman, the prior people who you said rented the jet ski, you said that they damaged them, which is possible if not probable when somebody uses jet skis.
07:39Because people, I know people, I know my own grandchildren ride around like lunatics when they have an opportunity.
07:45Why don't you have insurance if this is a business of yours?
07:47I do have personal insurance.
07:49Not personal insurance.
07:50I'm talking about any kind of insurance for damage to your business, to your property.
07:54Well, business insurance was...
07:56For the jet skis.
07:58They are insurance.
07:59You paid $14,000 for them.
08:00I'm just curious.
08:01So I do have insurance on them.
08:03I have that right here.
08:04The reason I don't want to make a claim on them is because my insurance skyrockets or they would drop me because I have so many pieces of equipment insured on them.
08:14Oh, well, that's a problem.
08:16Your Honor.
08:17May I see the text messages?
08:19That, Mr. Wissman, might be your problem.
08:23Can I speak for a moment, please?
08:25Yes, in a second.
08:26Okay.
08:27I'm reading this.
08:29Do you have the next page of this?
08:31This is on June 19th at 1241 p.m.
08:33We haven't made it to the lake yet.
08:35Someone must have drove the trailer into the water because there was water in the lights.
08:39The brake lights don't work and there's no keys to the blue jet ski.
08:43Then you write back.
08:44The key was in the center console.
08:46They worked when you guys took them and the keys were in both.
08:49They picked them up at 10 o'clock at night.
08:51The lights worked.
08:52Right here is where it says that I bought the lights.
08:54Okay.
08:55Don't read it.
08:56Just give it.
09:03What does this mean, no sucked up rocks?
09:07Because he had asked me, was there water and rocks sucked up in it?
09:10Because when I picked those ones up, he said that's what he had to clean out,
09:13what was in those CDs and the Yamaha prior for me picking them up,
09:17which is why he said I was going to have the red ones instead of those.
09:19Got it.
09:20Would you show this to the plaintiff, please, and tell him to explain that to me?
09:24This is her telling me that she didn't suck any rocks up.
09:33The front part of that jet ski is what I am aware of, of the damage that I did.
09:37Great.
09:38Let me know exactly how you damaged the front of the jet ski.
09:42I was driving into the front of the shore and then gradually bumped against the boat dock.
09:47And when you bumped against the boat dock, what happened to the jet ski?
09:51So that's when the front piece of that, that plastic piece had broke.
09:54Was there any damage to the Sea-Doo?
09:56No.
09:57Okay.
09:58You drove the Sea-Doo?
09:59Yes.
10:00Could you stand up for me, please?
10:02Your last name is?
10:03Hartley.
10:04Mr. Hartley, you drove the Sea-Doo and your wife drove the Yamaha.
10:09Yes.
10:10Did you stay on those all weekend?
10:11We probably switched back and forth, but...
10:14Okay.
10:15Did you have any accident with the Sea-Doo?
10:17No, ma'am.
10:18No, ma'am.
10:19Hit anything?
10:20No.
10:21Did you see any damage to the Sea-Doo?
10:22No.
10:23And when you returned them, the damage that you saw on the Yamaha was this front panel damage
10:29that your wife had done?
10:31Yeah.
10:32How much did you pay the plaintiff?
10:34$480.
10:35For the weekend?
10:38For the weekend, yes.
10:39For the two?
10:40The deposit was $300, and then when we picked him up, we had paid him the $180, and he said
10:45that was fine.
10:46And when you dropped them off, was he there?
10:49Yes.
10:50So I assume he was inside his home.
10:51We were messaging.
10:52As I was there at his home, I'm texting him, hey, I'm here.
10:54Do you want to come outside and overview these?
10:56He then declined to come outside and look at them.
10:59May I see those texts?
11:01Oh, I don't believe I have those of him declining to come outside.
11:04Well, I'd like to see your text to him indicating that you're there.
11:09I never got that text.
11:11I don't think I have it within this, but we were texting the whole way that we were there.
11:15Well, that's important.
11:16That's important.
11:17Can I speak, ma'am?
11:18My last message to her was at 1045 that night, saying that since there's no daylight,
11:24and I had to work the next day to go ahead and just leave him in the front yard.
11:28Got it.
11:29So you just told her to leave it?
11:30I told her to leave it at 1045, but I never received any response back, no, I'm here.
11:35And she left it?
11:36Yes.
11:37And the next day you looked and you saw damage?
11:39Yes, ma'am.
11:40And the only thing that she advised you of was damage to the blue Yamaha?
11:45She did say that there's scuffs and stuff on the bottom of the holes also, but she wasn't sure if that was still there.
11:53But they weren't scuffs, they were giant holes in them.
11:55I also indicated that I didn't believe it was from me.
11:56They were giant holes?
11:57Yeah, what you saw in the pictures.
11:59Okay.
12:00I would like to see the repair bill.
12:02And I would like to see why, if you have these insured, why you didn't use the insurance unless you have a deductible.
12:09They're not fully repaired yet.
12:11So I don't have the repair bill.
12:13Your Honor, I have right here that he is still, they must be fixed because he has them re-rented out, listed online.
12:18May I see it?
12:19Yes.
12:20And from when I screen shot that yesterday, I said a week ago.
12:32Is this the Yamaha you used?
12:33Yes.
12:34Did you list these out for rent, sir, after the defendant used them?
12:37I did, yes.
12:38I have them patched.
12:39The answer is, the answer is you did.
12:41So they must be available.
12:42So they're patched.
12:43They're not fully fixed.
12:44Oh.
12:45And I have it, I have it.
12:46Oh.
12:47Oh.
12:48Mr. Wiseman.
12:49They're at the mechanic right now.
12:50Mr. Wiseman.
12:51Mr. Wiseman.
12:52Unless you can show me an estimate to fix the front panel that she says was damaged, I'm dismissing your case.
12:57The front bill?
12:58This is just the front piece.
12:59I'd like to see it.
13:00I ordered it and replaced it myself.
13:02I'd like to see it.
13:07It's $114.59.
13:10That's the only piece you're getting reimbursed for.
13:12Not the holes?
13:13Oh, no.
13:14Not that you re-rent it again.
13:16I don't know how many people you rent these things to and say, well, I patched them up and charged the exact same thing as she did and then they use them.
13:24And with your patchwork, maybe they come off again.
13:27Maybe you say that they damaged them.
13:30Listen, Mr. Wiseman, if you're running a business and your business is renting jet skis and you have insurance, then use it.
13:35But you're not renting damaged jet skis.
13:38You're suing her for $10,000, which would make these things totally inoperable.
13:43But you're renting them to other people.
13:46I've rented them once.
13:47And later today.
13:49Is anything today that I just said to you inaccurate?
13:53Well, yes, as far as me going to his home.
13:56I'm going to tell you that today is home.
14:03Jet ski owner Jeremy Wiseman is accusing his customer, Amanda Hartley, of damaging his jet skis and not returning all his equipment.
14:17Listen, Mr. Wiseman, if you're running a business and your business is renting jet skis and you have insurance, then use it.
14:23But you're not renting damaged jet skis.
14:26You're suing her for $10,000, which would make these things totally inoperable.
14:31But you're renting them to other people.
14:34I've rented them once.
14:35You're renting them to other people.
14:37They're going to be repaired fully.
14:39Well, they're not going to be repaired by her.
14:41Right now it's the cosmetics.
14:42114-59, judgment for the plaintiff, we're finished.
14:45Court is adjourned.
14:46That's it, we're done.
14:50I'm not happy with it.
14:51I'm just glad that the good person won in this.
14:53I got a patch on him.
14:55I tried to make it right with him and then when he started to have these excessive charges and have damages that were not mine, it was wrong.
15:01They're going to be fixed fully this winter.
15:03So that's when it needed to come to this.
15:06They work.
15:07They're just cosmetically not finished.
15:09Probably through an actual business, not private renter.
15:11Probably do it for another year and see what happens.
15:15I actually thought that while dressed in a suit and tie and sounding very good, when the defendant said I sent him a note and I said we didn't suck up any rocks, but I did damage the front and I'm sending you a picture of it.
15:30I thought two things were disingenuous about the plaintiff.
15:33A, he didn't use his insurance and it's a business.
15:37He said, well, my rates will go up.
15:39Well, otherwise then you have...
15:40You're stuck with the damage.
15:41You're stuck with the damage because usually if you rent a car, either you pay for the insurance when you rent a car or you self-insure.
15:48And the second thing and the most important thing was he said there were gaping holes in them and he took pictures of the holes.
15:54But then he acknowledged that he had listed them for rent.
15:58And then he said, I patched the holes.
16:00Who knows if a patch is good?
16:01You're out in the middle of a lake and if the patch fails, then that's dangerous.
16:05Anyway, I was not impressed with him.
16:07If you're going to be in the business, this was our second jet ski case.
16:10I don't know why that's become such a popular business.
16:12I think probably because of the pandemic, Sarah.
16:15Yeah, I think people are just spending more time with their families outside.
16:19Outside.
16:20We've seen our family with jet skis.
16:22Mm-hmm.
16:23Some are normal.
16:24Few incidents here and there.
16:25Some are normal.
16:26Mm-hmm.
16:27And some power them up and stand up on them.
16:30You can ride them standing up and sitting down.
16:32By their very nature, they're designed to be driven aggressively.
16:36Yeah.
16:37Except if they're driven by a 70 and an 80-year-old.
16:39Then, you know, you're lucky to sort of make it around the lake.
16:42Anyway, I didn't believe him.
16:44That's the bottom line.
16:45I could tell.
16:46Case number 1164.
16:48Angelus versus Keelan.
16:50Please step forward.
16:51Jorge Angelus is suing his former friend, Chianti Keeling, for the return of a car and a coin collection.
17:00Ms. Keeling.
17:01Yes.
17:02Where is his coin collection?
17:03It's in a car in my Volkswagen Jetta.
17:05Where is it?
17:06It's parked in front of my apartment.
17:08How did you get here to court today?
17:09A rental.
17:10I have to tell you that I'm not liking your attitude.
17:14Yeah.
17:15Do you understand that?
17:16Yes, I do understand.
17:18Good.
17:19Case is a relatively simple one.
17:20You and the defendant were friends.
17:22A certain period of time, you were roommates.
17:24According to you, just friends.
17:26There was a time when you needed a car.
17:28A friend was selling a car.
17:30According to the plaintiff, it was a Jetta.
17:33He agreed to advance the money for the car.
17:35He did.
17:36You agreed to pay him for the car.
17:38You didn't.
17:39He took the car.
17:40You went to the house and took his coin collection.
17:43That's how you have his coin collection.
17:45According to you, you were holding the coin collection as collateral to get the car back.
17:50He's a truck driver.
17:51While he was out of town, you went and took the car back.
17:54Yes.
17:55You acknowledged all of those things.
17:56Yes.
17:57Right?
17:58Two things.
17:59Is anything today that I just said to you inaccurate?
18:02Well, yes.
18:03As far as me going to his home, I rented out a room in his house.
18:09From when to when?
18:10From December 2020 until I took the car in August.
18:15August 2nd.
18:16Where was he when you took the car?
18:18Out of town.
18:19The car is in both your names.
18:21Yes, it is.
18:22It was in both your names because you were supposed to pay him for the car.
18:26And as soon as you paid him for the car, he was going to take his name off the title.
18:29That was your agreement?
18:30Yes.
18:31Who has the title for the car?
18:32George.
18:33Great.
18:34Would you give me the title, please?
18:39I see it.
18:40Don't leave, Kevin.
18:47Where does she sign this car over to him?
18:49You know where?
18:50Right there.
18:51Sign it.
18:54Right now.
18:55Date and signature.
19:03Date it.
19:09Give it to him, please.
19:10Here you go, sir.
19:14You getting an appearance fee for coming to court today?
19:16Yes.
19:17How much?
19:18Two feet.
19:19We're going to hold that.
19:20He's going to pick up his car, which you didn't pay for.
19:22Do you understand?
19:23I understand.
19:24Do you understand?
19:25I understand.
19:26If the car isn't there or if there's any damage to the car, he's going to report it stolen
19:30because now he has full title to the car.
19:32Do you understand?
19:33I understand.
19:34Great.
19:35Where is the coin collection?
19:36It's in the car in the Volkswagen.
19:38Where exactly in the car?
19:39It's in the trunk.
19:40Do you know where the car is now located?
19:42Yes.
19:43Do you have a second set of keys for the car?
19:45I have one set of keys, yes.
19:46Hmm?
19:47Yes, I do.
19:48You're not to go near the car again.
19:49Do you understand?
19:50Yes, ma'am.
19:51If you do, he's going to call the police.
19:53Then we're going to play him this tape.
19:55Do you understand?
19:56I understand.
19:57Very good.
19:58You've got your car back and you've got your coin collection back.
20:01It's in the trunk.
20:02Okay.
20:03Any difficulty, you let me know.
20:04Okay.
20:06Thank you very much.
20:07We're done here.
20:08Court is adjourned.
20:10I feel like he gave me the car as a gift.
20:13Well, I was just trying to help her get a car to go to her job.
20:18Because he wanted me to be his girlfriend.
20:20We're just trying to be nice, not buy.
20:22You know, you don't buy people.
20:23You just be nice.
20:25No, I took the coins out of anger because he took the car from me first.
20:28I was the one that offered her a car.
20:30That was just out of revenge.
20:32I just took his coins.
20:33So she will not be Ubering all the time.
20:35I'm not mad.
20:36You know, I just get my own car.
20:37I know what to do now.
20:40Sarah Rose, that was easy peasy.
20:42That was very easy.
20:43You had a defendant who knew she was in the wrong,
20:46looking maybe to get over.
20:48She was nice looking, had a nice smile, took advantage.
20:53Knew she took advantage.
20:54Knew, right.
20:55Knew she took advantage.
20:56So didn't even fight me on signing over the title.
21:00He's now made whole, which is our job.
21:02That's absolutely right.
21:04If you can walk out here and if the right thing happens,
21:07then we've done our job.
21:09Good day.
