The Industrial Court has ruled that the decision by Taylors University to declare two associate

professors, Tam Shih-Mei and Wong Ching-Li, surplus to requirements based on their high

salaries, was unfair and discriminatory.

Court Chairman Eswari Mari criticised the university's criteria used to retrench staff,

saying they should align with existing policies and not be arbitrary.

She said targeting employees solely based on salary is unjust and overlooks their contributions

as well as undervalues their loyalty.

Taylors defended its decision, citing financial losses and the need to reduce costs.

Taylors said terminating higher-earning academic staff would be able to reduce costs more significantly,

leading to fewer staff being released.

However, the court found the terminations of Tam and Wong from employment were without

just cause or excuse.

Eswari ordered Taylors to pay Tam back wages of RM256,742, equivalent to 24 months' salary

but subject to a 20% deduction for post-dismissal earnings.

Wong was awarded RM276,480 on the same basis.
