00:00The Supreme Court slams the brakes on the impeachment case against Vice President Sara Duterte,
00:05calling it premature but not the end of the road.
00:09Our Luisa Irispe tells us more.
00:12The Supreme Court of the Philippines, Sir SC, has declared the articles of impeachment
00:18against Vice President Sara Duterte as unconstitutional in a unanimous decision
00:23of the justices of the highest court with one on leave and one who inhibited from the case.
00:29It ruled that the impeachment complaint was barred by the one-year rule.
00:34The Supreme Court has ruled that the House impeachment complaint versus VP Sara Duterte
00:39is barred by the one-year rule and that due process or fairness applies
00:44during all stages of the impeachment process.
00:48On the decision, it simply explains that the fourth impeachment complaint
00:52was filed under a different mode compared to the first three,
00:55which was filed with verified complaints, or Article 11, Section 3-2 of the Constitution,
01:01the fourth complaint was filed under Article 11, Section 3-4,
01:06or by at least one-third of the members of the House.
01:08This barred the fourth complaint and was resolved as unconstitutional.
01:13The Supreme Court also ruled that the complaint filed by one-third of the House
01:17shall also be accompanied by evidences, shall be sufficient to prove charges,
01:21and that the draft of the articles of the impeachment was made available
01:25to all the members of the House, not only to those who are willing to endorse the complaint.
01:30But the attorney team clarified this does not absolve Vice President Sara Duterte
01:35from the charges filed against her.
01:37A new complaint may be filed starting February 6, 2026.
01:41However, the court said it is not absolving Vice President Duterte from any of the charges against her.
01:50But any subsequent impeachment complaint may only be filed starting February 6, 2026.
01:57When asked if the impeachment trial shall continue
01:59since the impeachment court of the Senate has already convened,
02:03Attorney Ting responded,
02:04The court said that the House complaint versus the VP is unconstitutional and null and void,
02:12and therefore the Senate did not acquire jurisdiction to convene as an impeachment court.
02:19The House of Representatives can still file their motion for reconsideration,
02:23but the decision is immediately executory.
02:26Malacanang Palas has expressed its respect and trust on the Supreme Court's decision
02:31and asks everyone to do the same.
02:33But they said they have yet reviewed the full context of the decision.
02:37The lower house also said they will review the decision,
02:40and they respect the Supreme Court,
02:42but they will continue to exhaust remedies to protect the independence of the Congress.
02:47On the other hand, the Senate impeachment court spokesperson acknowledged the high court's decision,
02:52saying that the Senate sitting as an impeachment court
02:55has always acted in deference to the Constitution and the rule of law.
02:59But if Senator Tito Soto will be asked,
03:03I think it may be the same thing that we can disregard the Supreme Court decision,
03:10because it tramples over the work of the Senate na kahiwalay.
03:19Sen. Joel Villanueva even said whether the SC made that decision or not,
03:24the impeachment court will proceed.
03:26Sen. Bam Aquino also has the same sentiment as Villanueva.
03:30Sen. Risa Honteveros also expressed dismay over the Supreme Court's decision,
03:56saying that the Filipino people have every right to demand answers.
04:00And Rep. Laila Dilima questioned the court's decision,
04:04saying that it is ex-part decision,
04:06a prohibited action among judges,
04:08and parties should have been given opportunity to be heard first.
