Sean "Diddy" Combs' federal sex trafficking and racketeering 18th day of testimony resumed Friday, with "Jane" returning to the stand ... she told the jury about her reluctance to participate in alleged "freak-offs."
00:00Well, the Diddy trial rolling on with testimony from his former girlfriend who's testifying under the pseudonym Jane.
00:07And Jane had a lot to say on the stand today about their sex life and about participating in freak-offs.
00:16Does she get to the point where she is saying that she felt forced into this life?
00:21We're going to get to that.
00:22But one of the really shocking things she testified about was about what very well may have been the last freak-off that Diddy participated in.
00:33And it certainly was, she said, the last one that she participated in.
00:37And what's interesting about this is Jane says it happened not in a hotel, as we've heard all the others, but it happened at Diddy's home in Miami on Star Island.
00:47And maybe it had to happen there, because at this point, the raids had happened five months earlier.
00:55So in March, we had these raids, and Fox 11 cameras were above for that.
01:02Yep, this was here in L.A.
01:03In L.A., we had a raid in Miami as well.
01:06At the Star Island mansion.
01:07And then in August, according to Jane's testimony, there's a freak-off at Star Island.
01:15In the home where the raids happened.
01:16It had already happened.
01:17So he knew that the feds were very concerned about this whole thing, and did it anyway.
01:23And probably knew that his arrest was imminent.
01:26This is a month before his arrest, and we know that the feds were in contact with his attorneys.
01:30He even went to New York expecting to be arrested.
01:34So there was some anticipation on his part, but it is mind-boggling that a month before his arrest, he's still talking about a freak-off.
01:43But in his mind, he didn't do anything wrong.
01:46Yeah, you know, at first blush, it seems like Diddy having a freak-off, according to this testimony, just weeks before he's arrested in New York, might seem like he's incorrigible.
01:56Like he just was getting in one last fling before he went away.
01:59But it could also cut that he didn't think he was doing anything wrong.
02:02This could help Diddy's case that this is just his lifestyle.
02:05He doesn't know what the feds were looking into, but having consensual group sex is not a crime, and he was just going about his business.
02:12He might also say he was in the throes of addiction and things like that.
02:16But I can actually see this testimony helping him in some odd way.
02:19I would imagine that that's, on cross-examination, that's what his attorneys are going to bring up, and that, you know, the bigger thing for them is going to be whether or not she was forced into this.
02:33And that's what they've got to, the prosecution's got to make clear here in her testimony.
02:38And an interesting nugget, she apparently was picking out who she wanted to have sex with and was reaching out to them?
02:44So there's at least one guy, this dude named Sly.
02:47She and Diddy actually saw him in a pornographic movie, and because Jane said she wanted to have, like, some sort of agency over who she was sleeping with, she said, I really want to get with that guy.
02:58So she DM'd him.
02:59They had a phone conversation where she and Diddy were on one end and Sly was on the other.
03:03And they ended up actually flying him from Atlanta to New York and Atlanta to L.A., which is, again, like, that's moving someone across state lines.
03:11And then she says that they paid him after a sexual experience that he had.
03:15So it kind of goes to one of the charges that they're looking into.
03:17So that's the Mann Act right there.
03:19That's the Mann Act.
03:20I mean, that's testimony of interstate transport for the purposes of sex and the exchange of money.
03:24She says he was paid around $4,000 for these escapades.
03:27Diddy reimbursed her.
03:28That's going to help prove up that charge, which has always been the simplest one in this case, because Diddy's not really running away from the fact that he often ordered, you know, sexual company of this sort.
03:37What's interesting about her testimony about choosing some of the sexual partners, that she wanted to have agency over that, the forcible part.
03:48And I felt like with Cassie, they really did a really good job of her talking about feeling like this was not the life she wanted anymore.
03:57And it was fear that kept her in it, that she and that's the coercion to stay in it.
04:04I we haven't I haven't really heard that really with Jane yet.
04:07And I would imagine the defense is going to use that.
04:10The fact that she said, look, I got to choose my partners.
04:13But there was an incident because Jane talked about the fact that she was most of the time high on drugs, often on ecstasy.
04:23But she was sober one night and after having sex with two guys sober, she went into the bathroom to throw up and then Diddy walks in.
04:32What happens next?
04:33Diddy walks in and he's like, well, I'm so glad you threw up and you feel better because the third guy's here and we got to get back to this, basically.
04:40I think that gets you closer.
04:42Starts to get close. Yeah, it is getting closer.
04:44I still think a lot of this testimony seems like a girlfriend trying to please her boyfriend.
04:49And some of the Cassie testimony felt that way.
04:51But when you got to the physical violence, threatening to leak sex videos on that flight and then asking for a freak off after that is a clearer nexus to me than her thinking, I really am into Diddy and I want to please him.
05:03So some of this interior thoughts that she had, the defense is going to look into how much of that was communicated to Diddy.
05:09So that you could say he was forcing it over her objection.
05:13Right, because if it's just her talking about what she thought, it's always going to come back to what Diddy know.
05:19And the defense used that line when Cassie, when they were cross-examining Cassie as well.
05:27Right now, Jane is still on the stand, is expected to be all day.
05:32And then maybe on Monday they get to cross-examination.
05:36But they got to, you know, this is, and there's nothing from her that has touched on Rico.
05:42And you don't, not that every witness has to touch every single count against him.
05:46But everyone is still saying, where is this, the Rico evidence?
05:52Doesn't seem like it's going to come from Jane at this point.

05:56And it just kind of shows that the way Diddy uses freak off is the way that we use, like, mindful over matter techniques.
06:03Diddy has a clear addiction.
06:05But also you have to be a little bit more self-aware and recognize what you're going to be going through.
06:08And I just think that that level of perception, he just clearly does not have that if they'll participate in those freak offs so close after getting unraided.
06:16You've got to imagine that that was a moment where they were like, what?

06:21Well, it doesn't really give you a sense that he's got any sort of remorse at all.
06:24Obviously, he thinks what he's doing maybe wasn't bad.
06:27But if you were to let him off where he's back on the streets again, would he continue this sort of behavior again?
