00:07Department, DOE, pleaded not guilty at the Sessions Court in Seremban to charges of illegally
00:14dumping hazardous waste. Nature Energy Products, Sendirian Berhad, along with directors 62-year-old
00:21S. Sivana Thiran and 47-year-old Chan Kwai Soon were charged with disposing of scheduled waste,
00:27code SW322, without proper approval at Lot 11224, Jima, Port Dickson, around 4.30 p.m. on October
00:3614, 2024. Sivana Thiran previously served as a deputy director at the State DOE, while Chan appeared on
00:45behalf of the company during proceedings before Judge Mohamed Kamil Nizam. SW322 refers to waste
00:54containing non-halogenated organic solvents, a category classified as hazardous under environmental
01:01regulations and requiring specific disposal procedures. The charges were brought under Section 34B,
01:08Subsection 1, Subsection A of the Environmental Quality Act 1974, which prohibits the placement,
01:15deposit, or disposal of scheduled wastes without the Director General of Environment's approval.
01:20If convicted, the accused face a maximum jail term of five years and fines ranging from
01:27100,000 ringgit to 10 million ringgit. Judge Mohamed Kamil set bail at 9,000 ringgit each for the two
01:35directors and fixed July 3 for case mention. He also ordered them to report monthly to the nearest DOE
01:42office and barred them from contacting prosecution witnesses.
