38:59But without the actual gun the police believe is seen in the CCTV,
39:04detectives can't tell if it was real or imitation.
39:09I'm satisfied that if the victim's telling me that it was a firearm
39:12and the item I see on CCTV,
39:14that a firearm of some description was there.
39:17But from a charging perspective,
39:19we're going to have to seek the view of an imitation firearm at this time.
39:26Threatening with an imitation gun is a serious offence
39:29and can lead to ten years in prison.
39:33But now it's up to the Crown Prosecution Service
39:36to decide what charges, if any, the men should face.
