Two men are celebrating their freedom this Ramadan after being acquitted of drug trafficking charges that could have resulted in the death penalty.
The Johor Baru High Court ruled on Friday (March 14) that the prosecution failed to prove their case.

Court on Friday after Judge Khan Wanghin acquitted and discharged them of the offence.

The duo had been facing the death penalty under section 39B subsection 1A of the Dangerous

Drugs Act 1952 for allegedly distributing approximately 32 kilograms of methamphetamine.

In his ruling, Judge Khan stated that the prosecution had failed to establish a prima

facie case against both accused.

A key factor in his decision was the lack of connection between the boat where the drugs

were allegedly found near a homestay at Telok Sengat in Kota Tinggi on May 22, 2020, and

the two men.

The court heard that the homestay had been previously rented to an Indonesian in March,

while the accused only rented it in May.

Judge Khan also noted there was no evidence placing the accused at the scene, and criticised

the prosecution's failure to identify and retrieve information from three confiscated

phones.

The prosecution has not yet indicated if they will appeal the decision.
