Jay-Z is revealing how he found out the Jane Doe rape accuser allegedly lied about his involvement ... and how attorney Tony Buzbee allegedly pushed her to sue, anyway.

00:00So, you know, there is a big brouhaha over this case against Jay-Z, this rape case that

00:09was dropped after this woman had essentially recanted and said, I'm going to dismiss this

00:16with prejudice.

00:17Right.

00:18Now, you use the word recant, and I understand why you use the word recant.

00:22Her attorney, or I guess you would say formerly her attorney, Tony Busbee, says she is not

00:26recanting her story and that she firmly stands on what she alleged in the lawsuit, even though

00:32she's dismissed it.

00:33But one of the allegations that Tony Busbee made was that two private investigators went

00:41out and allegedly harassed this woman after she dropped the lawsuit.

00:46Well, it turns out there were two private investigators who went to visit her, and at

00:51least, well, at least one of them has made a declaration in Jay-Z's lawsuit against

00:57Tony Busbee.

00:58For extortion.

00:59For extortion, right.

01:00And this private investigator goes into detail about this meeting that she had, the private

01:05investigator had with the Jane Doe accuser, went to her home and talked to her about Jay-Z's

01:12involvement.

01:13Now, according to these documents filed by the private investigator, the Jane Doe accuser

01:17said no less than four times, Jay-Z did not assault me.

01:23And in fact, she, according to the investigator, the accuser, put it on Tony Busbee, saying

01:30that Tony Busbee is the one who brought up Jay-Z at all.

01:34The Jane Doe accuser says, I absolutely claimed that, alleged that Diddy assaulted me back

01:41in the year 2000, after the VMA awards, and that she said there was also a female celebrity

01:48there who watched this happen.

01:49She says she never brought up Jay-Z, and in these documents, according to the PI, it was

01:55Tony Busbee who brought up Jay-Z.

01:57Well, and also, now we know that this conversation was recorded.

02:05And so, presumably, if this declaration is correct, that the woman said four times, Jay-Z

02:13never assaulted me, presumably that would be on the recording.

02:17That they would have that on the recording, and look, they do not include that recording

02:22in this lawsuit.

02:23Well, but by the way, there's a reason for that.

02:25We should just explain.

02:26To cut through it all, what Jay-Z's lawyers are saying is that Tony Busbee manufactured

02:33this claim to get money.

02:34That's their allegation.

02:35Right.

02:36That they manufactured a claim that wasn't true, and then went to Jay-Z and his lawyer

02:42and said, pay up or else.

02:45And that's what they say the extortion is.

02:47Right.

02:48And that's the heart of Jay-Z's case against Tony Busbee's lawsuit, is saying that this

02:52guy sent me a letter demanding money when he knew full well that I had not done the

02:58things that he put in this lawsuit, because the accuser herself never mentioned Jay-Z.

03:05So that's why this declaration was made by the private investigator.

03:09You know what's really interesting to me about this?

03:12Is that, and correct me if I'm wrong here, but the private investigator said she does

03:18not work for Jay-Z or the lawyers.

03:21Correct.

03:22So who does she work for?

03:23That's, she never says in the declaration, but it is really odd she said that she does

03:28not, was not hired by them.

03:30So why did she go to this woman's house?

03:33I can't figure it out myself.

03:35It's very puzzling.

03:37Tony Busbee has an interesting response to this.

03:40He said, each assertion is flat out false and made up.

03:43The assertions by Jay-Z and by this private investigator.

03:47He adds, Jane Doe called referring counsel, the Ava Law Group, and alleged she was assaulted

03:53by P. Diddy and Jay-Z before her case was ever referred to our firm.

03:58Those investigators likely didn't know that the paper trail will demonstrably prove what

04:03they say to be false.

04:05Yeah, it's interesting.

04:06It looks like he's sort of passing the buck to the initial firm that she reached out to

04:10and maybe filled out an intake form and he's going to lean on what's in that intake form

04:14to say, I just took it as it came and it already included Jay-Z.

04:18What this PI says is that Jay-Z was brought into it by Busbee, that Jay-Z may have been

04:23at this party.

04:24She does remember spotting Jay-Z potentially at the party she alleges it occurred at, but

04:28that in four separate times said Jay-Z did not assault her and that Busbee was the one

04:33who sort of wanted to bring Jay-Z into it in that level.

04:36She also says that when she decided to dismiss the lawsuit, it was because Busbee came to

04:40her and said Jay-Z might try to kill her and come after her.

04:43And she was scared enough that she dismissed the lawsuit.

04:46Can I tell you something that seems evident to me after reading this declaration, after

04:52watching the NBC News interview with the accuser where she was in silhouette, I think this

05:00woman is dealing with some sort of mental illness.

05:04And that gets to, I think, a fundamental problem that Jay-Z has with the extortion lawsuit.

05:10And Derek, hear me out on this, but it seems to me that on the one hand, what Jay-Z is

05:16saying is this woman made claims that have absolutely no basis in reality, that she is

05:23essentially mentally ill and you can't believe necessarily what she's saying.

05:29But then on the other hand, if they're suing for extortion, even if she said those things,

05:34I never claimed Jay-Z did it, Tony Busbee was the one who put me up to it.

05:40Why are you believing that part of what she says?

05:42Right.

05:43You're 100% right.

05:44This is what's called an unreliable narrator.

05:45If she's been on both sides of this issue and he has, by the way, there's another investigator

05:49who's detailed some of the mental health issues that she had.

05:53And Jay-Z submitted a declaration from another investigator who said 90 days, within 90 days

05:57of filing this complaint at all, she was in a mental health treatment facility.

06:01So you're right.

06:02What version of events do we believe?

06:04The one where she says Jay-Z didn't assault her or the one where she says he did.

06:07You're right.

06:08It's all over the map and it does hurt his case.
