00:00Malaysian laws need an update to meet the demands of technology advancements in a fast-evolving
00:07world, says Chief Justice Tengku Maimun Tuan Mat.
00:10The nation's top judge said that while reliance on artificial intelligence and other generative
00:15technology is growing, there are very few laws and regulations in place to regulate
00:20their use.
00:21Tengku Maimun raised concerns about the admissibility of computer-generated evidence under Section
00:2690A of the Evidence Act, 1950.
00:29She said judges wield considerable discretion in admitting such evidence, taking into account
00:34factors such as reliability and potential bias.
00:37She added that the provision has not been updated since 1993, unlike similar laws in
00:42other jurisdictions.
00:44According to Tengku Maimun, Malaysia currently lacks specific legislation against spamming
00:48and phishing, and authorities often rely on Section 233.1b of the Communications and Multimedia
00:54Act, 1998, which criminalizes anonymous communication intended to annoy, abuse, or threaten others.
01:02Tengku Maimun added that this section in the CMA is also used to address cyberbullying
01:06and harassment, but the absence of dedicated cybercrime laws has led the government to
01:10consider drafting new legislation.
