00:00 The US government has declined to supply defense materials to Nikhil Gupta, an Indian national
00:08 held in a Czech prison on murder for higher charges linked to a thwarted assassination
00:13 attempt on Khalistani terrorist Gurpatwant Singh Pannu.
00:17 Insisting on furnishing information only after Gupta's appearance in a New York court and
00:22 facing arraignment, the government asserts its stance.
00:25 Gupta, aged 52, faced federal prosecutor's charges in an unsealed indictment in November
00:31 of the previous year.
00:33 The charges accused him of collaborating with an Indian government employee in a foiled
00:37 plot to kill Pannu, a dual US and Canadian citizen on American soil.
00:42 Arrested in Prague, Czech Republic on June 30, 2023, Gupta is currently detained there
00:48 with active efforts by the US government to secure his extradition.
00:52 On January 4, Gupta's attorney filed a motion to compel production of discovery in the US
00:57 District Court, Southern District of New York, seeking relevant defense materials.
01:01 US District Judge Victor Moreiro on January 8 granted the government three days to respond
01:06 to Gupta's motion.
01:08 In the response filed on Wednesday, the government contends that Gupta's request for discovery
01:12 material should be denied.
01:14 According to federal prosecutors in opposition to Gupta's motion, the government is prepared
01:18 to provide discovery promptly upon the defendant's appearance in the district and arraignment
01:23 on the case.
01:24 Until then, they argue, Gupta is not entitled to discovery and he fails to present a compelling
01:28 reason for the court to order it.
01:31 Pannu, facing charges in India for advocating separatism and orchestrating overseas referendums
01:37 to establish an independent Sikh state, Khalistan, has been under scrutiny.
01:42 The National Investigation Agency filed a case against him in November of the preceding
01:45 year, citing violations of the Unlawful Activities Prevention Act, 1967 and relevant sections
01:51 of the Indian Penal Code.
01:52 The case was initiated after Pannu, listed as an individual terrorist when New Delhi
01:56 in 2020, issued threats to air India passengers in a video, prompting concerns for their safety.
02:02 An arrest warrant has been issued against him as he continues to challenge India's security
02:06 through alleged financing of violence and appeals to Punjab-based individuals to fight
02:10 for Khalistan.
