00:00Two drunks, nobody knows who was driving the car when it got total.
00:04He called me and said, yo man, I just crashed your car.
00:07He says that you don't remember because you were so blotto that you were driving.
00:13Everybody sober today?
00:15This is Judy Justice.
00:30Daniel Gray is suing his former friend, Tony Woods, for car damages after a night of drinking and driving.
00:43Court come to order.
00:44Have a seat, please.
00:47Hello, Judge. Case number 2018, Gray v. Woods.
00:51Thanks, Kevin.
00:52You're welcome.
00:54Everybody sober today?
00:57Yes?
00:58Yes, ma'am.
00:59Yes?
01:00You?
01:01Yes, sober.
01:02Yes?
01:03Oh, yeah.
01:04Most definitely.
01:05Everybody.
01:06Okay, good.
01:08You two gentlemen know each other.
01:10You went out for an evening.
01:12I assume there was some drinking and your car got totaled.
01:17Yes, ma'am.
01:17It is your claim that the defendant was driving your car when it got totaled.
01:22Yes.
01:23The defendant says, well, he was drinking a little bit, but he says that you don't remember because you were so blotto.
01:29No, that you were driving.
01:30Right?
01:31Yes.
01:32Yes.
01:33So that's what the case is about.
01:35Simple.
01:35Two drunks.
01:36Nobody knows who was driving the car when it got totaled.
01:40Let's see if we can decipher it.
01:41If we can't, I may not care.
01:43Because you're not supposed to be in a car when you're drunk.
01:46Otherwise, you can kill a lot of people, as we all know.
01:49Right?
01:50Yes, ma'am.
01:50Want to drive drunk and kill yourself.
01:52That's one thing.
01:53You take a lot of other people down, and sometimes you make it out.
01:57So you have to be understanding to the fact that the judicial system really doesn't give a rat's behind.
02:04If the two of you were drunk and in a car, and neither one of you was together enough to know who was driving the car, when did this incident happen?
02:14It was November 27th, 2021.
02:18How long have you known Mr. Woods, Mr. Gray?
02:20I've known Mr. Woods about 20 years, I would say.
02:23So you've known him since you were kids?
02:25Yeah, since high school.
02:25And you have gone out frequently?
02:28Yes.
02:28Does he come to your house?
02:30Yes.
02:30You go to his house?
02:32Occasionally, yes.
02:33Occasionally.
02:33And where were you going on the 27th of November?
02:36We were going downtown in Ann Arbor to attend some festivities from the Michigan versus Ohio State football game.
02:43To a football event?
02:44Yeah.
02:45How did Mr. Woods get downtown?
02:47Well, Your Honor, I got dropped off.
02:49By whom?
02:49My friend.
02:51Friend's name?
02:52Um, Lauren.
02:53And where did she drop you off?
02:55Um, she dropped me off in front of the Starbucks downtown where they were waiting.
02:59Because they were drunk.
03:00I didn't drink.
03:01First a second.
03:02Lauren dropped you off at Starbucks.
03:04Where were you supposed to go from Starbucks?
03:06We were supposed to go, um, to a club and hang out after the game.
03:10So you first went to the game?
03:12No, they went downtown right after the game.
03:14And I came to meet up to hang out.
03:16So it was all after the game?
03:17Yes, yes, yes.
03:18What time did Lauren drop Mr. Woods off at Starbucks?
03:22I would say it was around, like, 3, 4 o'clock.
03:26In the afternoon?
03:27I believe so.
03:28What time did Lauren drop you off?
03:29It had to be about 5.30, 6 o'clock.
03:32And when you say it had to be 5.30 or 6 o'clock, how do you know that?
03:35Because the game was over.
03:36I don't know.
03:37I don't watch football, so I don't know when it starts and when it's finished.
03:41Do you remember what time the game finished?
03:43No, I don't remember exactly the time.
03:44Okay, so let's say Lauren dropped you off at 5.30.
03:47How did you set the time for Mr. Woods to meet you so that he could join your party?
03:54The game is over different times.
03:56Did you text him?
03:57Did he call you?
03:58So on the way, we had left from my barbershop, me and my witness here, Mo Chon.
04:03So you weren't at the game.
04:04You were in a barbershop.
04:05Yeah, we were at the barbershop at first.
04:06We watched the game.
04:07Oh, you watched?
04:08So you didn't go to the game?
04:09We didn't attend the actual game, no.
04:11Okay.
04:12We watched the game at the barbershop.
04:13How many people, you, Mohammed, and who else watched the game at the barbershop?
04:16I mean, the barbershop was full of, we were still working at the time.
04:19We had left work after the game was over to go downtown to...
04:23Were you watching the game or were you working?
04:25I was doing both.
04:28I would have hated to be your last haircut.
04:31No, actually, it wasn't a lot of people there because that was the biggest game of Michigan's.
04:36Season, the last game of Ohio State.
04:38It's a big rivalry, so nobody was at our barbershop.
04:41So it was just party.
04:44It was...
04:45It was just party.
04:49You know, I'm old.
04:50Yeah.
04:50So, you know, it was just party.
04:53You said, Mohammed.
04:55It was a party, yeah.
04:55It was just party.
04:56Okay.
04:57So you left the barbershop, but how did you find out to meet them at the Starbucks?
05:02We had been communicating through text.
05:04So you knew what time they were leaving the barbershop and then you got dropped off.
05:07Now, what were you doing with Lauren?
05:08I was waiting to get to them.
05:11Where were you before?
05:11I was at home.
05:12I watched the game at home.
05:14With Lauren?
05:15No, with myself.
05:16Well, how'd you get Lauren to take you to Starbucks?
05:18Oh, I just asked her and gave her some gas money.
05:21Okay, so now you're at Starbucks.
05:22You meet up and who's driving?
05:24I was driving.
05:25Okay.
05:26And that would have been a mistake.
05:27Excuse me?
05:28That would have been a mistake.
05:30I wouldn't get behind the wheel of a car, sir, if I was at a party all afternoon watching
05:34a big football game.
05:35No, ma'am, I wasn't at a party.
05:37I was at my barbershop.
05:38I know you were at your barbershop.
05:39Yeah.
05:40Look at Mohammed.
05:41I know you were at your barbershop, sir.
05:43There hadn't been any drinking going on at that time.
05:45There was no drinking in the barbershop, Mohammed?
05:49There was people participating.
05:51Some people weren't.
05:52Some people were.
05:53I wasn't.
05:54I wasn't.
05:55I wasn't participating.
05:56All righty.
05:58Okay.
05:59So now you go from this party in the barbershop all afternoon from this very big game and
06:04you pick him up and where were you going?
06:06At that point, we decided to go to a bar.
06:08Where was the bar?
06:09I'm not familiar with downtown Ann Arbor area, but, like, it was a bar that was suggested
06:14by...
06:15Stand up next to him.
06:16He's not familiar with a whole lot of things.
06:17You suggested a particular bar, Mohammed?
06:20Yeah.
06:21How far is that from the Starbucks where he was dropped off?
06:24About a couple blocks over.
06:25And you were in the car?
06:26I was in the car.
06:27Were you sitting in the front or the back when you picked up Mr. Woods?
06:30I was sitting in the passenger seat at this point.
06:32So Mr. Woods got in the back?
06:33Yes, he did.
06:34And you were going a couple of blocks to the bar?
06:36Yeah.
06:36Step by step, what happened next?
06:38So traffic is jam-packed down there, so we're really just inching to the bar.
06:43We get to the bar.
06:44We go inside.
06:45We have a couple drinks.
06:47Okay.
06:47So now it may be 6 o'clock, 6.30?
06:50Yeah.
06:51Dark outside.
06:51And you have a couple of drinks at the bar?
06:53A couple drinks, yeah.
06:54What were you drinking?
06:55I was drinking water.
06:56That's not a drink that they like to serve at a bar.
06:58I was a designated driver, so...
07:00Okay.
07:01Well, after we left the bar.
07:02Okay, so you were the designated driver.
07:04Yeah.
07:04And Mr. Gray was drinking.
07:06Yes.
07:07What was he drinking?
07:09I don't remember what his drink is.
07:11You remember what you were drinking?
07:13Yes, ma'am.
07:13What?
07:14I had one beer.
07:17Okay.
07:20Even he can't keep a straight face.
07:21You know, it's hard.
07:23Just don't speak.
07:25Now, you were the designated driver.
07:27When were you designated the designated driver?
07:30Well...
07:30Think very carefully.
07:32Before you answer my questions, you know.
07:33Okay.
07:34I'm already two steps ahead of this game.
07:36I've watched...
07:36When were you...
07:37Yeah.
07:37I've watched you on TV, yes.
07:38I know.
07:39When were you designated the designated driver?
07:42When we left the bar, I was the designated driver.
07:45No, no.
07:45So it was when you left the bar?
07:47Yes.
07:48And who designated you the designated driver?
07:50Well, I kind of designated myself.
07:52I'm pretty familiar with the Ann Arbor area.
07:54It's actually my idea to go downtown, so...
07:56So you asked Mr. Gray if you could drive.
07:59Yeah, I thought it would be the best idea.
08:01And Mr. Gray said okay.
08:03Yes, he did.
08:03So you drove.
08:04And where were you going from the bar?
08:05To another bar.
08:06Better pickings at the other bar?
08:09Just bar hopping, you know.
08:10College downtown football.
08:12Okay.
08:12And what's the name of that bar?
08:14Where do we go from there?
08:16No, no, no!
08:17No!
08:20Speak.
08:21Yes, I look at you.
08:22The name of the other bar.
08:24Okay.
08:25Now, he helped you with that, right?
08:26Yeah, he jogged my memory a little bit.
08:27He jogged your memory.
08:28So if he knew the bar, why did you have to be the designated driver?
08:32I don't think I understand your question.
08:33It's very easy.
08:34You said you were the designated driver because you know that area.
08:37Right.
08:37I'm saying I didn't remember what bar we went to.
08:40I'm very familiar with the area.
08:41I just didn't remember what bar we were going to that night.
08:43Okay.
08:44What happened when you got to the second bar?
08:46We had some more drinks and...
08:47We had some more drinks?
08:49Yes.
08:49What was Mr. Gray drinking?
08:51You know, I don't...
08:52I was talking to some other friends that I met up with there.
08:55He was off doing his own thing.
08:56I don't remember what he was drinking.
08:57What were you drinking?
08:58Water still at this point.
09:00Water.
09:00Yeah.
09:03I like to stay hydrated.
09:09When I come out of the restroom, my car is gone.
09:11So I call him and he's not answering the phone.
09:15So I'm sitting at the shop waiting.
09:16And he called me and say, yo, man, you're going to kill me, man.
09:19I just crashed your car.
09:21I'm sorry.
09:22I'm sorry, bro.
09:23Daniel Gray claims his former friend, Tony Woods, drove drunk and crashed his car.
09:41Tony says Daniel was the one driving drunk and wrecked his own car.
09:46Okay, so now you had a couple of drinks.
09:48You had another glass of water.
09:50Mr. Gray and Mr. Woods both were drinking alcohol.
09:52And what happened next?
09:53We left there.
09:54We went to get something to eat.
09:56At this...
09:57Where did you go to eat?
09:58We went to...
09:58What's the name of that place?
10:00I don't know the name of the place.
10:01And he's not going to tell you.
10:02It's a hot dog place.
10:04It's right around the corner from where we was drinking.
10:05And then what happened there?
10:06We got something to eat.
10:08Okay.
10:08Do you remember what time that was?
10:09You know, I really don't.
10:11Well, you've been already to two bars and a place to eat.
10:15And if you started out at 6 o'clock, it had to be closer to 9 or 10 o'clock.
10:19Right.
10:19Yeah.
10:20Okay.
10:20Then what happened?
10:21Came out of the restaurant.
10:22And?
10:23And...
10:23Do you remember what you had at the restaurant?
10:25I had some waffle fries.
10:28And do you remember what Mr. Gray ate?
10:30He had a hot dog.
10:31And do you remember what Mr. Woods ate?
10:33He also had a hot dog.
10:34Good.
10:35So you came out of the restaurant.
10:37Do you remember who paid the bill?
10:38I think we all paid separately.
10:40Okay.
10:40So now you come out of the restaurant.
10:42Yeah, we come out of the restaurant.
10:43We had an already.
10:44This one, Mr. Woods over here, started horse playing a little bit.
10:47Charged at me from across the street.
10:49You know, I try to get him...
10:50But just a second.
10:51Okay.
10:51How did he get across the street?
10:53Well, the restaurant was across the street.
10:55We parked across the street from the restaurant.
10:56Okay.
10:57I got it.
10:57So I had already got back to the car.
10:59Okay.
10:59Mr. Woods over here started horse playing.
11:02And he ran across the street and tried tackling me.
11:05And he got me around my waist.
11:06I tried to put him in a headlock, but you see the size of his head.
11:11And did that just continue throughout the night, this horse playing?
11:14No, no, no.
11:15So he's horse playing with you.
11:18Right.
11:18But you get into the car.
11:20You said if he continued all during the night.
11:22What I want to know is, from the place where they got hot dogs and you got waffle fries,
11:26did you get back into the car?
11:28We did get back into the car.
11:30We went one more place.
11:31Okay.
11:32Now, when you got back into the car after the two dogs and the fries, who was driving?
11:37At that point, I think I was still driving.
11:40Not think.
11:41I don't want to think.
11:42I believe I was driving.
11:44I dropped myself off to my next destination because I separated from them two.
11:48You went to one other place?
11:49Yeah.
11:50With them?
11:52With the three of them, yes.
11:53And when you got to the other place, you went in or you did not go in?
11:57I went inside, yeah.
11:59Okay.
11:59Did you stay there?
12:01I did stay there.
12:02And what about the two of them?
12:03They went wherever they went.
12:05I don't know.
12:05Back to the barbershop, I believe.
12:07And you were the designated driver?
12:09Up into the barbershop.
12:10So you were drinking the water?
12:11Yes.
12:12And they were both drinking alcohol?
12:15Yes.
12:15Yes.
12:16Yes.
12:17What do you mean?
12:19You go to at least two bars, maybe three.
12:24You have a whole afternoon of drinking at a barbershop.
12:28Not you.
12:29You were drinking water.
12:29Water, yeah.
12:30I don't know what they were going to cook.
12:31Then you get dropped off.
12:34You was the designated driver.
12:35Now, they're nowhere near home.
12:37So you knew one of them was going to be driving.
12:39Right.
12:39And as far as your testimony is concerned,
12:43you were left in the last place that you visited.
12:47They went out to go someplace else or go back to the barbershop.
12:51Right.
12:51Did you see them again that evening?
12:53Uh-huh.
12:54It's not an answer.
12:55I mean, we're coming to court today.
12:57You know, it's not a photo shoot.
12:58You came here for testimony.
12:59I don't believe I seen them that night again.
13:03No, I'm just talking about that night.
13:04That's what we're talking about, that night.
13:06This is the night of the accident.
13:07The 27th of November, 2021.
13:10I didn't see them again.
13:10You're in a club.
13:11You don't know what happened.
13:12Now, when they dropped you off, did you go outside with them or did you just stay in the club?
13:18I stayed inside.
13:19So you don't know anything else.
13:20What happened after that?
13:21Now you can sit.
13:25Okay.
13:26Now, your witness, the designated water drinking driver, has dropped himself off.
13:32And the two of you go outside.
13:34What happened?
13:35After he got dropped off, we are parked at a bar and...
13:39Just a second.
13:40He stays there.
13:41You get into the car because you're going to another bar.
13:45No, not at this point.
13:46Where were you going?
13:47I was getting ready to go to my barbershop.
13:49He's not with you.
13:50Who was driving?
13:51I was driving at that point.
13:52Okay.
13:52And you were driving to take yourself back, according to you, to the barbershop.
13:56Yes.
13:57And then what happened?
13:58Okay.
13:58So we get to the barbershop and I leave the car running.
14:01He's in the car with me.
14:02Just a second.
14:03Got to the barbershop and you left the car running for what reason?
14:06Because it was cold outside.
14:08It was snow.
14:08It was, I guess, November.
14:10Well, what were you going to the barbershop for?
14:11I went to the barbershop because I needed to use the restroom.
14:14And the barbershop is close by to this last bar you were at?
14:17Yes.
14:18How close?
14:19Maybe like two miles.
14:20Okay.
14:20So you went to the barbershop.
14:23You left the car running and?
14:24So I go in to use the restroom and I leave the car running and Mr. Woods was sitting in the car still.
14:30So as I'm in the restroom, he comes in and started knocking on the door and says that he had lost his phone when he had got out the car where we were parked at.
14:39Where?
14:40The last bar that we were at.
14:41I didn't actually go into the last bar.
14:43We was parked there.
14:44We were about to go in to meet up with him.
14:47What do you mean to meet up with him?
14:49He was with you.
14:50As he said, he got, he met up with another friend.
14:53He didn't tell me that.
14:54He said you just dropped him off at the other bar and you weren't going in.
14:57Just he was going in.
14:58You dropped him off.
14:59That's what he said.
15:00No, he went in.
15:01I understand he went in.
15:02I never went in the last bar.
15:04Okay, you didn't go and neither did he.
15:06Yeah.
15:06Well, I'm asking you.
15:07He said I lost my phone someplace.
15:09No, where we were parked at, he got out the car for a second.
15:12I never got out the car.
15:13He got out the car for a second.
15:14What was he doing when he got out of the car for a second?
15:17He thought we were about to go in.
15:18But I said, I told him that I needed to use the restroom.
15:22So he got back in the car.
15:24But at some point when he got out the car, he dropped his phone.
15:27So I told him I needed to use the restroom.
15:29So I go to my shop to use the restroom.
15:31I park the car.
15:32Got it.
15:32I get out.
15:33I leave the car running.
15:34I go in, use the restroom.
15:35He comes in, knocks on the door, telling me that, hey, yo, I lost my phone.
15:40Can I drive the car?
15:41Let me go pick it up real quick.
15:42And I tell him no.
15:44Like, just wait.
15:44I'll be out in a second.
15:45So he leaves.
15:46I hear the door open and close.
15:48I'm thinking that he's just going to sit back in the car.
15:51So when I come out of the restroom, my car is gone.
15:54I call him and he's not answering the phone.
15:57So I keep calling.
15:58I keep calling.
15:59And then the next, like, 10 minutes later, he answers the phone.
16:02So I knew he went to go get his phone.
16:04He found his phone.
16:05Yes.
16:06And I'm furious at this point because he just left me in my shop.
16:09At the barbershop.
16:09Yeah.
16:10In my car.
16:11So I tell him, you know, bring my car back right now.
16:13You know, he said, I'm on my way.
16:15I'll be there in a minute.
16:16About 15 minutes later, he called me and say, yo, man, you're going to kill me, man.
16:20I just crashed your car.
16:22I'm sorry.
16:23I'm sorry, bro.
16:24And I had to walk all the way to the accident scene to the car where he crashed my car at.
16:29Now, you have an accident report?
16:31No, I don't have an accident report.
16:32Why?
16:33Because we never called the police.
16:35That's probably a good idea.
16:36Because he wasn't involved with another car.
16:37He just hit a pole.
16:38I understand that.
16:40That's still an accident report.
16:41The only reason you don't call the police is because both of you were drinking.
16:44Well, I wasn't driving the car at that time.
16:47When you were driving the car to the barbershop, right?
16:50Yes.
16:50From the last bar where you dropped Mohammed off, you were driving.
16:54Yes.
16:54I was not drunk, though, kind of.
16:55If you're not drinking, you know, it's sort of an interesting thing.
16:59Everybody's definition of drunk is different.
17:01Your friend Mohammed said that he was the designated driver, so he was just drinking water.
17:06That's what he said.
17:07That's what Mohammed said.
17:08Which suggests to me that we had a full day of drinking, starting at the barbershop, watching
17:13the game, from the game to two or three bars, then for a bite to eat.
17:18No, I wasn't drinking at the barbershop.
17:20I didn't start drinking until we got to the first bar.
17:23Okay, so now you started to drink at six o'clock.
17:26Now it's ten o'clock.
17:27And you've been drinking from one place to another.
17:30I'm just saying you got behind the wheel of the car and you had been drinking.
17:35Now, did you hit a pole?
17:37No, Your Honor.
17:37Okay, now you tell me your version of the events.
17:44How long was he in the restroom before you realized that you had dropped your phone?
17:49About five minutes.
17:50So now he's gone in to use the restroom.
17:53You go and look for your phone.
17:55You see how easy this is, like fishing in a fish tank.
18:07Daniel Gray has accused his former friend, Tony Woods, of driving drunk and wrecking his car.
18:17Okay, now you tell me your version of the events.
18:20Okay, first off, I ain't eat no hot dog.
18:22You didn't what?
18:23I never had a hot dog.
18:24Okay, strike the hot dog.
18:27No hot dog.
18:27Whitney, it's true.
18:28He denies the hot dog.
18:30I don't reckon I didn't eat a hot dog either.
18:31Yeah, okay.
18:32Okay.
18:32Denies the hot dog.
18:33Okay, so for what happened after they got in the car?
18:37First, they were very drunk.
18:39Just a second.
18:40You don't have to tell me.
18:41All three of you were drunk.
18:43I wasn't drunk yet.
18:44Okay.
18:46By the time the car got trashed, you were drunk.
18:49Let me tell you what I believe.
18:50Okay.
18:51So then you can pick it up from there.
18:52Okay.
18:53I believe that Mohammed was dropped off at the last bar.
18:57So there came a time at the end of the evening when it was just the two of you.
19:01I don't know who was driving.
19:03I don't know who was the passenger.
19:04But I believe that they dropped him off because otherwise Mohammed, who appears here as a witness today, would have had a better story.
19:10Because he says, I don't know what happened afterwards, you know, because I wasn't there.
19:15So there was a time at the end of the evening that just the two of you were in the car.
19:18Okay.
19:19That's what I believe.
19:20Okay.
19:20Can I tell you before that part, though?
19:22Because he was driving down the wrong way of the street.
19:25There's no question in my mind.
19:26He shouldn't have been behind the wheel of the car.
19:28And that's when I lost my phone and my wallet, and we were wrestling in the street.
19:32He actually attacked me.
19:33Let's move forward.
19:34Okay.
19:35There came a time when just the two of you were in the car.
19:38Okay.
19:39When was that?
19:40Well, we were sitting in front of a bar that we were about to go to.
19:43I got out the car, and I dropped my phone.
19:46At that time, I asked him to take me back to get back.
19:49No, no, no.
19:50You dropped your phone.
19:51And you didn't know you dropped your phone because if you knew you dropped your phone, you would have picked it up.
19:55Right.
19:55Correct.
19:56Right. So then you got back into the car, driver's seat or passenger seat?
20:00I was in the passenger seat.
20:01And Mr. Gray was driving?
20:02Yes.
20:03And Mr. Mohammed was at the bar?
20:05Yes, he was with a friend.
20:06He had gone to the bar, so it was the two of you.
20:08You're in the passenger seat, he's driving, and he's drunk?
20:12Yes.
20:13And you went back to the barbershop for him to use the restroom?
20:16Just follow, because there was a time when you wanted to go back to look for your dropped phone.
20:21Do you understand?
20:22Correct.
20:22Now, he goes back to the barbershop.
20:24How long was he in the restroom before you realized that you had dropped your phone?
20:29About five minutes.
20:30And you realized that you had dropped your phone because you tried to make a call while you were waiting for him?
20:37Correct.
20:37And it was snow on the ground, correct?
20:39And it was snowing, and he didn't have a frankfurter.
20:42Yes, yes, yes.
20:43So now, he's gone in to use the restroom.
20:46You go and look for your phone.
20:48You see how easy this is?
20:49Like, fishing in a fish tank.
20:57You went inside, and what did you do when you went inside when you realized that you had lost your phone?
21:02I told him, let's go get my phone, and he drove us, and we done got the phone.
21:05Okay.
21:06So, he came out of the restroom.
21:08You got back into the passenger seat of the car.
21:11Correct.
21:11And he got into the driver's seat of the car.
21:14Correct.
21:14And what happened?
21:15Then, we called Mohammed to try to meet back up with him after we got my phone.
21:20No, no, no, no, no, no, no.
21:22Step.
21:23Slowly, he turned.
21:26Step by step.
21:28Inch by inch.
21:30Now, you're in the car, on your way back to the bar where Mohammed is to look for your phone.
21:36I got drunk.
21:36I think I blacked out after that point.
21:42Not according to your answer.
21:44So, according to your answer, you knew exactly what happened, sir.
21:47What do you mean you blacked out?
21:48You signed a sworn statement.
21:49I know we got the phone.
21:50I got the phone back.
21:51Well, I know you got the phone.
21:53So, you had to have driven back there successfully to get the phone.
21:57Yes.
21:58And is it at that point that you get back into the car and you blacked out?
22:01No, it was just I got really drunk after getting my phone.
22:04Like, after that, I just...
22:05You don't remember what happened?
22:07I remember getting my phone and being drunk.
22:10Like, yeah, I got my phone.
22:11Okie dokie.
22:12There we go.
22:12Okay, you were all drunk.
22:14As a matter of fact, I have zero sympathy for any of you getting behind the wheel of the car.
22:18Okay, the car was damaged.
22:20Yes, I have.
22:21And so, what you want me to believe that you blame him, and I could understand that because I don't know how drunk you actually were, whether or not you blame him for your wrecked car because you were driving the car back to find his phone, and it wouldn't have been in that problem had he not dropped his phone out of the car, or whether he was actually driving the car drunk.
22:43It's actually irrelevant to me, you were both driving drunk.
22:45You have a bill to fix the car?
22:47Yes, I do.
22:48I'd like to see it.
22:49And I have pictures of the accident.
22:50And I have pictures of the accident.
22:52Okay, so, yeah.
22:53So the bill was $5,500, and you had insurance?
22:57Yes.
22:58And the insurance paid for how much?
22:59I had no fault insurance.
23:00So you didn't have-
23:01I didn't have collision.
23:02Okay.
23:03You didn't have collision, so you had to pay $5,500, which you paid.
23:07Yeah.
23:08Divide that by two.
23:10$2,750.
23:11That's what I thought.
23:12So, Mr. Gray, there are some lessons that you learned, and I don't know whether other courts would agree.
23:17I have to make a determination as to credibility, and quite frankly, I can't determine between two drugs and two drugs.
23:29Who's telling me the truth?
23:31Because on the 27th of November, both of you were in no condition to drive a car.
23:35And I can't tell who actually drove the car at the time that it was wrecked.
23:39But I do know that you drove the car from a club to your barbershop, and that neither one of you stayed at the scene, called the police because both of you were inebriated,
23:49and knew that either one or both of you were going to get busted for a DUI because you both drove the car that evening.
23:56What?
23:57I was not drunk at the time that this happened.
24:01I did go to the bars, but I wasn't in the bars drinking.
24:04I had one beer.
24:05$2,750.
24:06We're done.
24:07This court is adjourned.
24:08I feel like he kind of got the story wrong because I wasn't drunk, but I think that was very fair.
24:17I feel like, you know, the judge was very reasonable.
24:19I had one beer that day, but I mean, there's a limit to like being drunk in the state of Michigan.
24:24It was just one of those drunk things, you know, but we got it taken care of.
24:29I wanted to make him look like my vehicle.
24:31It was very snowy outside, and you know, something happened, and I don't remember.
24:35I didn't do anything.
24:36I just called a tow truck and tried to get the situation solved.
24:41And I'm very happy to get this case behind me.
24:43Satisfied I got something out of the deal.
24:45I don't know.
24:46I don't know.
24:47I don't know.
24:48Hopefully we can get back to being friends.
24:49You know, he's a good guy.
24:50I'm surprised you gave them anything.
24:53You know, unclean hands don't deserve money from this court, as we've seen time and again.
24:58So I'm surprised, really, that you gave him even half of what he was asking
25:02because you couldn't tell which one of them was credible if either of them were credible.
25:07And so what are you supposed to do?
25:09I mean, I guess splitting it down the middle was, I understand why you made your judgment,
25:13but I would have taught him a lesson, given him nothing.
25:16Interesting.
25:17Jump driving is nothing to play around with.
25:20Yeah.
25:21Very curious.
25:22Okay.
25:23I'm glad in the DNA it's getting tougher rather than softer.
25:28Oh, yeah.
25:29Okay.
25:30Good.
25:31You may be right.
25:32You may be right.
25:33I just felt that they were both at fault, and either you leave the parties where they
25:38are, or you say both of you have to hurt a little.
25:41Yep.
25:42I understand.
25:43But I actually understand your position.
25:45Respect it.
25:47Absolutely.
25:51Great.
25:53Fantastic.
25:55You're welcome.
25:56You're welcome.
25:58pedir.
25:59I'll see you next time.
26:00And, how are you looking at?
26:01You're welcome.
26:02I'm a little wiser of money.
26:03I'm a little wiser.
26:04Yes.
26:05You're welcome.
26:06I'm lucky.
26:07I'm a little wiser.
