00:00I heard a loud crash, so I ran outside and saw that my car had been decimated.
00:07And you all had been drinking?
00:09Yes.
00:10She was not allowed to touch that car.
00:12She took it without my permission.
00:13I don't care.
00:14You're her mother.
00:16This innocent victim has to have a donkey to pin the tail on.
00:20And you're it.
00:21This is Judy Justice.
00:30This is Judy Justice.
00:40Uzzurri Shubin is suing Maribel Herrera for car damages after her 17-year-old daughter's
00:46friend crashed into Uzzurri's vehicle.
00:49Court coming to order.
00:50All rise.
00:52Have a seat, everyone.
00:54Hello, Judge.
00:55Hello.
00:55Case number 1140, Shubin v. Herrera.
00:59You're welcome.
01:00Ms. Shubin, I'm going to start with you very briefly.
01:02Okay.
01:03Because my reading of the case, as far as I'm concerned, you know very little about what
01:08happened in this case, except that you parked your car on the street and went into your house.
01:14Mm-hmm.
01:14Don't tell you how?
01:15Yes.
01:15Yes.
01:16Because she can't take down.
01:17You don't know what happened with your car, except that it was destroyed while parked.
01:23Exactly.
01:25Right.
01:26And tell me when this happened.
01:28So it happened tentatively at 1145 p.m. on August 29th.
01:35Of this year?
01:36Yes.
01:37Were you sleeping?
01:38I was sleeping.
01:39I heard a loud crash, and it was over in the direction in which I had parked my car.
01:44So I ran outside, pantsless, no shoes, went over without my phone, too, and saw that my
01:53car had been decimated.
01:55I actually have photos if you'd like to see them.
01:57I would.
01:58Okay.
02:00Okay.
02:00So when I went over there, oh, okay.
02:08I also have a video of the car crash as well.
02:10You do?
02:11Yes.
02:11I'd like to see it.
02:13Yeah.
02:13You can just press play.
02:14What year, model, make of this car was it?
02:21So my car is a Jeep Liberty 06 Limited.
02:24I also have a photo of what it looked like prior to this incident.
02:30When did you purchase the car, Ms. Shubin?
02:32I purchased it around December of 2018.
02:37Do you recall the purchase price of the car?
02:40So I purchased it for $5,360, and I have a photo of what it looked like prior to it
02:47being run into.
02:48Okay.
02:49Can we have a seat, please?
02:52Also have a video.
02:54I'm only the third owner.
02:58God, it looks lovely.
02:59Yeah.
03:00Can I see the video?
03:02It was immaculate.
03:07Let me see your head.
03:09So my neighbor recorded.
03:12Oh, no.
03:13You bleeding bad, boo.
03:14You bleeding bad.
03:16Oh.
03:18Wow.
03:19We hide bottles.
03:22She's bleeding a lot.
03:24Sit down, mama.
03:26Sit down.
03:27Sit down.
03:27Sit down.
03:28Let me see your face.
03:30Yeah.
03:31You too.
03:32Man, you guys.
03:33I don't care.
03:34I don't care.
03:34Okay.
03:35So I'm going to cut this off.
03:36I'm going to cut this off, you guys.
03:38Look, I'm going to call the ambulance, okay?
03:40Okay.
03:41And the car was totaled?
03:42Yes.
03:43Yes.
03:44That was the determination of the auto body shop.
03:47Now, Ms. Herrera, you weren't there.
03:50I was not.
03:50On the evening of August 29th.
03:53But you own the car.
03:55That you are the titled owner of the car that hit her car.
04:01That would be a yes.
04:03I actually am not.
04:04Who is?
04:05The car was given to my daughter as a gift for her to move around, because she just had
04:10a baby.
04:11Ms. Herrera.
04:12Yes.
04:13Where's the title to the car?
04:14I have it here.
04:15I'd like to see it.
04:25Your Honor, I do have...
04:26Shh, don't speak.
04:28Who is this person who owns the car?
04:30My daughter's in-laws purchased the vehicle from that person.
04:35Just a second.
04:37These people are the...
04:39Somebody bought your daughter a present.
04:41Let me understand this.
04:43Somebody bought your daughter who's how old?
04:45She is 17 now.
04:47Somebody bought your daughter a present who's 17.
04:50What month and year did they buy her the present?
04:53I believe it was August...
04:55What date?
04:58I can't recall right now, but I believe it was August, the beginning of August of 2021.
05:03Why didn't they transfer title?
05:05I did do that online.
05:07Oh, well, then let me see.
05:08Let me see the paperwork.
05:09You're doing it online.
05:11Just a second.
05:11Let me see the paperwork of you doing it online.
05:14I have paperwork that says that she is the insured on the vehicle.
05:18Yes.
05:18I'd like to see it.
05:20That is the...
05:21I'd like to see the paperwork she did online, and I'd like to see that.
05:24So what...
05:25The insurance...
05:25You're telling me these people, you did, in fact, change the title.
05:29Yes.
05:30And you changed the title and insured the car in whose name?
05:33My name.
05:34That's what I asked you.
05:35But I was trying to explain, Your Honor, that when I did the paperwork online, when I switched
05:41over the title to my name, everything went through.
05:45I have the emails there of everything that I did online, the receipts and everything.
05:49But at the end of the day, they did not put it under my name because I still owed a fee,
05:55which I couldn't do at the time.
05:57I don't care.
05:59So the car was yours, and you had insurance on it, and you filled out the paperwork,
06:03and you swore in the paperwork that the car was yours, and it was being gifted to you
06:08because it couldn't be gifted to a minor.
06:10Right.
06:11Right.
06:12Okay.
06:12Now I don't have to see anything.
06:13Return that to everybody.
06:15Also, I have the paper that...
06:16No, no.
06:17Didn't ask you anything.
06:18So far, we understand each other.
06:20Your...
06:21Her daughter?
06:22Yes.
06:22Your father's family gave you this car?
06:26No, my fiancé's, um, parent... grandparents.
06:29Now I'm leaving you, Ms. Shubin, for a moment.
06:32Okay.
06:33And I'm gonna try...
06:34The two of you stand up.
06:37Because it's true that your mother wasn't there on the night of August 29th,
06:45when you had the car.
06:47Correct.
06:48Right.
06:48And you're 17.
06:49Yes.
06:50And you have a child?
06:51Yes, Your Honor.
06:52How old is that child?
06:53He is now five months.
06:55Um, he will be six months this month.
06:56He's five months old.
06:57And you live with your mother?
06:59No, Your Honor.
07:00Who do you live with?
07:01I live on my own, Your Honor.
07:02Where does the father of this child live?
07:05He's incarcerated at the moment, Your Honor.
07:07So?
07:07He lives in a state facility?
07:09Yes.
07:10For what?
07:11Um, honestly, I don't really have so much information on it.
07:14When did he go to a state facility?
07:17From what I've known, um, he was arrested on September 29th.
07:21Prior to September 29th, when he went to jail, who was he living with?
07:25He was living on his own, Your Honor.
07:27Did he have a new girlfriend?
07:29No.
07:29So this is what I gather from what your mother wrote in the answer to why she's not responsible
07:36for the damage to Ms. Shubin's car.
07:39And she had to have gotten this story from somebody.
07:42And I assume she got it from you and your friend whose name is?
07:47Jasmine.
07:47Jasmine.
07:48Sometime on August 29th, your son was visiting with his father.
07:54This is what the story your mother tells me is.
07:57Is that true?
07:58No.
07:59That's either a yes or a no.
08:00No.
08:01Okay.
08:01Who told your mother that story?
08:03I think she misunderstood.
08:05No.
08:05Who told your mother that story?
08:08Because she swore to it here.
08:09She says, and it all sounded odd to me, that her son was with his father for the night.
08:16She had to get that from you.
08:17So that was a lie.
08:19Yes or no?
08:20Yes.
08:20She got a call that there was a domestic dispute at her father's house.
08:25So that was a lie.
08:26Yes.
08:27So Violet, that would be you, needed to get there quickly.
08:32So all that you now understand, Miss Herrera, is a lie.
08:35That would not.
08:36Just a second.
08:37That's what your daughter says she told you.
08:40And that's what you wrote in the answer, in your sworn answer.
08:44I'm going to read what you wrote in your sworn answer.
08:47Okay.
08:47You say, on August 29th, Violet was hanging out with her friends.
08:51Her son was with his father for the night.
08:53She got a call that there was a domestic dispute at her father's house.
08:57So Violet needed to get there quickly.
09:00She drove over to her son's father's house and brought her friend Jasmine with her.
09:05That's what you wrote.
09:05I mean, I'm not psychotic.
09:07I didn't make up the story.
09:08I didn't pull it out of the air.
09:09I didn't pull it out of my shoe.
09:12You already have an irresponsible daughter.
09:15She's 17 years old.
09:16She has a six-month-old child.
09:18The boyfriend that she decided to make this baby with at age 15 and a half is now in prison.
09:35Uzuri Shubin is suing Maribel Herrera for car damages after her 17-year-old daughter's friend crashed into Uzuri's vehicle.
09:45Now, that's what you wrote.
09:47So if you wrote that, either you made it up, Ms. Herrera, or your daughter told you that story.
09:53So only two answers.
09:54Don't give me any other answer.
09:56That's your daughter told you what happened or you made up that story.
10:00Which one is it?
10:01Someone wrote it wrong because I did not say that.
10:04Well, your daughter just said to me that that's what she told you.
10:07No, that I'm sorry.
10:07Just a second.
10:08Just a second.
10:09No.
10:10Would you read that back for me, please?
10:11Maybe I'm mistaken.
10:12I said to her, did you tell your mother?
10:14You asked her who told your mother that story.
10:16She said, I think she misunderstood.
10:19You said, who told your mother that story because she swore to it.
10:23So was that a lie?
10:25Yes or no?
10:25Answer, yes.
10:27Okay.
10:27So now I'm going to come to you.
10:29Your mother wasn't there.
10:30No.
10:31Don't play with papers.
10:32I'm trying to...
10:33Your mother wasn't there on the 29th of August.
10:36So just a little bit of background on you.
10:39What do you do?
10:40Do you work?
10:40Do you go to school?
10:41No, Your Honor, I do go to school.
10:43What school do you go to?
10:44I go to Charter High School.
10:46Who takes care of your son?
10:49My father does or my fiance's aunts take care of my son while I'm at school.
10:55Your fiance's in jail?
10:56Yes.
10:57Who takes care of your son?
10:59I do.
10:59Who does he live with?
11:00He lives with me, Your Honor.
11:02When did you move out of your mother's house?
11:04I believe it was sometime in May, but I don't have an exact date for you, Your Honor.
11:10What's the reason you moved out of your mother's house?
11:12My family's household, there was just a lot of people.
11:15And now that, you know, we had a baby, it was just, we kind of wanted our own space.
11:22Who's the we?
11:23Me and my fiance.
11:24How old is he?
11:25He's 20, Your Honor.
11:27Is this the first time he's been incarcerated?
11:29Yes.
11:29Tell me what happened on the 29th.
11:31What had happened was I went out.
11:34I went out.
11:35At the moment, me and my fiance were separated.
11:40Okay, and he was living someplace else?
11:42Yes.
11:42And I went out because I was just having an emotional rollercoaster, and I went out with
11:50my friends.
11:51That's Jasmine.
11:53Yes.
11:53Where did you go?
11:55We went to the area that we were in where the crash happened.
11:59Now, you went to the area where the crash happened, and?
12:02And right there, that's when we started drinking a little bit.
12:06Then it was around 11, I want to say 11.40, where I got a call from a relative that was
12:15taking care of my son and saying...
12:18What relative that was taking care of your son and I?
12:20It was my fiance's cousin, and I had a call.
12:24She called me saying that I needed to come pick up my son, and there was other acquaintances
12:30with me, and...
12:31Who was with you?
12:32Um, there was just two other acquaintances.
12:35Oh.
12:35Um, I honestly don't really know them.
12:37They were...
12:38It was just kind of...
12:40We...
12:40Were they in the car with you?
12:41Yes, they were.
12:42In addition to Jasmine?
12:44Yes.
12:44Were these two people that you had picked up at a bar?
12:47No.
12:47Where were you doing your drinking?
12:48It was by a...
12:49Um, across the street from a graveyard.
12:52Um...
12:53So, in the car?
12:54Yes.
12:55So, the alcohol was in the car?
12:56Yes.
12:57Yes, it was.
12:57Who brought the alcohol?
12:59Um, it was one of the acquaintances, Your Honor.
13:02That was a male acquaintance?
13:04I believe so, yes.
13:05What do you mean you believe so, yes?
13:06Yes, Your Honor.
13:07Is that one of the male acquaintances that I saw in this video who was all bloody?
13:12Um, yes.
13:13I'm listening.
13:14And, um, after I got that call, I went to go pick up my son, and, um, the other acquaintances
13:20were not getting in my car, because at this...
13:22At this time that I got the call, we were already outside.
13:25And I told them, like, let's go.
13:27I need to go pick up my son.
13:29I'm gonna take you guys home, and I need to go get my son.
13:31Nobody really listened, so I just got Jasmine, and I told her, um, that I am going to trust
13:38you.
13:39I'm gonna go...
13:40I'm gonna go get my son.
13:41I'm gonna stay there, because...
13:43Just a second.
13:44So, you were going to, at midnight, go to your boyfriend's cousin's house, who were
13:50babysitting for your son.
13:52Yes.
13:53And you were going to stay at the house.
13:55Yes.
13:56Instead of going home.
13:58Yes.
13:58So, you let Jasmine...
14:01You gave her the keys to your car.
14:03Yes.
14:03And you all had been drinking.
14:06Yes.
14:06And one of the boys stayed in the car with Jasmine.
14:10Or did she go back...
14:11Did you go back, Jasmine, to pick him up?
14:13I went back to go pick him up.
14:14So, she went to the cousin's house.
14:17She got dropped off.
14:18Either you drove or she drove.
14:20You picked up one of the boys from where the graveyard, where they were drinking in a
14:25graveyard.
14:25And then you were driving?
14:28Yes.
14:28And you crashed into her car?
14:31Full speed.
14:32Probably, like, six miles per hour.
14:33And you crashed into her car?
14:36Yes.
14:36After you crashed into the car, did you stay at the scene?
14:40I had left.
14:40That's either a yes or a no?
14:42No.
14:43You took off with the boy in the car?
14:46Yes.
14:46And you left and took off with the boy in the car because there were a whole bunch of
14:51liquor bottles in the car?
14:52Yeah.
14:53Yes.
14:53That's what she says.
14:54She had to get that from someplace.
14:56Did your daughter tell you that story?
14:58That's either a yes or a no.
15:01Yes.
15:02What happened to your car?
15:04It was towed from the place.
15:07I did call the police that night.
15:09Just a sec.
15:09What happened to your car?
15:11Was it fixed?
15:12No.
15:13It wasn't fixed?
15:14It was not.
15:14It was totaled.
15:15Did the insurance pay you for the car?
15:17No, Your Honor.
15:18Did you put in a claim?
15:20I did.
15:21And what happened with that claim?
15:22They denied it.
15:23What did you tell the insurance company?
15:25Because the insurance company didn't pay her.
15:27At all.
15:28Just a second.
15:28The insurance that you had on the car didn't pay her.
15:33Do you know why?
15:34Yes.
15:35Why?
15:35Because I did not know at the time until two days later that the policy of my insurance had expired or was terminated on the 29th because my full payment didn't go through.
15:50So it was denied.
15:51You paid $5,360 for this car three years ago?
15:56Yes.
15:57Did you get another car?
15:58Not yet.
15:58I'm still looking, but yeah.
16:02Great.
16:02Judging for the plaintiff in the amount of $5,360.
16:06Let me tell you this.
16:07Your Honor.
16:08I understand you want emotional distress.
16:10Everybody will.
16:11Just the car rental.
16:12That would be nice too because I really do want to rebuild my vehicle and the auto body shop estimated that it would be about 7,000 views.
16:21Right.
16:21$5,360.
16:22Your Honor.
16:23Sorry.
16:23Down.
16:24What I'm telling you is this.
16:26You already have an irresponsible daughter.
16:28She's 17 years old.
16:30She has a six month old child.
16:31The boyfriend that she decided to make this baby with at age 15 and a half is now in prison.
16:39You gave her the wherewithal to drive this car.
16:42You filled out the paperwork and you evidently got insurance under your name.
16:47But she was not allowed to touch that car.
16:49She took it without my permission.
17:01Luzuri Shubin has accused Maribel Herrera's 17-year-old daughter and her friend of crashing into her parked car while drinking and driving.
17:12Okay.
17:13You let her drive a car.
17:15She, you, you're her mother.
17:17You let her drive a car.
17:18You did the paperwork putting your name on the title.
17:21If her fiancé's grandparents decided to give her a car, let them put it in their name.
17:28Say, I don't want to have any part of this.
17:30My daughter is irresponsible.
17:32She's demonstrated she's irresponsible.
17:34She's demonstrated by her history.
17:36And certainly going out with underage people and drinking in a graveyard and then turning the car keys over to somebody who is under the influence of alcohol.
17:48I would say that I have an irresponsible child.
17:51Just a second.
17:52And if you didn't want to be held responsible for it, you shouldn't have done the paperwork in your name.
17:57You say, you think that my daughter is mature enough to have the responsibility of a car?
18:03You put the car in your name and you get the insurance.
18:05And you say that to the people who gave her the car.
18:07You don't put it in your name.
18:09She has to have somebody.
18:11She has to have somebody to say, make me whole.
18:16She's not going to do it.
18:17Jasmine, who drove drunk, because she's a minor.
18:21Your daughter's not going to do it.
18:23She can't take care of herself.
18:25She makes bad judgments.
18:26And she has no money.
18:28You're the grown-up.
18:29You gave her the wherewithal to drive this car.
18:32Yes, you did.
18:33You filled out the paperwork.
18:35And you evidently got insurance under your name.
18:38Under your name.
18:40Correct.
18:41Correct.
18:42But she was not allowed to touch that car.
18:44She took it without my permission.
18:45Madam, you gave her the ability to drive that car.
18:52You put it in your name and you insured it.
18:55And this innocent victim has to have somebody, has to have a donkey to pin the tail on.
19:03She can't say, well, it's not this one's fault she's a minor.
19:07It's not that one's fault because of this.
19:08She has to have somebody.
19:10And you're it.
19:11It didn't have to be you.
19:13It could have been the people that gave her the car.
19:15Said, I'll put it in my name and I'll insure it.
19:17Grandma and grandpa of this incarcerated father.
19:21They could have said, I'll put it in my name.
19:22I want her to have a car to get back and forth.
19:24And Anne would have been fine.
19:26Then you wouldn't be standing there.
19:28You helped her.
19:29You're the grown-up in the room.
19:3053-60.
19:31Judgment for the plaintiff.
19:32We're finished.
19:33Court is adjourned.
19:36I do admit that my daughter was irresponsible for what she did.
19:40I really do love my car and I took such good care of it.
19:43So for it to end up in the condition that it's in now, it just sucks so bad.
19:49A green Camry run me off the road and I try to make a right and that's when I crashed.
19:53It was catastrophic.
19:55It sounded like an explosion.
19:57That's why it woke me up.
19:58Right now, I'm just not responsible enough to have a car of my own.
20:02I'm thankful that my car was there because the velocity in which they hit my car,
20:08if they would have hit the building behind it, they possibly wouldn't be here anymore.
20:12I'm glad that I wasn't in the car, knowing my son was in the car.
20:14I appreciate her just understanding that I am the victim in this situation
20:18and it's just been hectic and crazy and I'm just thankful to have some resolution.
20:24You know, when I saw that title from that case, it made me think,
20:27I should really find my title.
20:29I know I put it in a safe place.
20:31But I just can't quite remember where that safe place is.
20:34But it is a very important document.
20:36Yeah, welcome to a senior moment.
20:39Yeah.
20:39Yeah, you look for it when you go home.
20:40People don't realize that being the owner of a car gives you a certain responsibility
20:46and you're supposed to exercise judgment about who uses that car.
20:51And if you have a child who acts irresponsibly about other things,
20:56and I'm sure this is not the first time,
20:59this wasn't the first rodeo for getting alcohol and going to sit at the cemetery and drink,
21:04then you have to be careful not to have your name attached to that.
21:08Because ultimately, your 17-year-old or your 16-year-old isn't responsible because they have nothing.
21:13Somebody has to be responsible for an innocent victim.
21:16And it will usually fall at the feet of the person who has the money to pay for it.
21:24So you have to be very cautious about lending your name to somebody else's potential irresponsibility.
21:32That, to me, is the takeaway.
21:33Yeah, I agree.
21:34And find your title.
21:35Yeah.
