00:04but for the 4.7 crore alimony he was ordered to pay his wife after divorce.
00:10Last year, Hardik Pandya claimed all his assets were in his mother's name,
00:14allegedly to avoid paying alimony to wife Natasha Stankovic.
00:18These cases triggered a social media storm,
00:21turning alimony into a men versus women debate.
00:24But what is alimony and why does the law provide for it?
00:30Alimony or maintenance exists as a social justice measure
00:37to support the spouse, usually the wife, and dependent children
00:41after separation or divorce.
00:43Why? Because in traditional marriages, women often stepped back from work
00:47or never worked outside at all to take care of the family.
00:51Alimony ensures that they can remain financially stable
00:55even after the marriage ends.
00:57But here's what many don't know.
00:59Alimony is not just for women.
01:01Under the Hindu and Parsi marriage laws,
01:04a husband can also claim alimony if the wife earns more.
01:07But under Muslim, Christian and special marriage laws,
01:11only the wife can claim it.
01:13So what's the difference really between maintenance and alimony?
01:16Maintenance is usually monthly.
01:18It is paid during the separation and while divorce proceedings are on.
01:22Alimony on the other hand kicks in after the divorce is final,
01:25either as a lump sum like Chahal has paid or monthly payments as long as the wife remains unmarried.
01:31How much is it?
01:33There is no fixed formula.
01:35Courts look at several factors to decide.
01:37The social and financial status of both spouses,
01:40the wife's reasonable needs and those of the children,
01:43qualifications, jobs and incomes of both spouses,
01:46sacrifices that are made for the family by giving up a career,
01:50standard of living during marriage,
01:52the husband's ability to pay after accounting for his liabilities,
01:56and even litigation costs if the wife wasn't earning.
01:59Remember, alimony can also include assets like transfer of shares,
02:03property or savings to the wife or kids.
02:06And yes, if the husband proves that he is financially dependent
02:09or the wife is earning enough,
02:11courts can either reduce the amount or even award alimony to the husband.
02:15At its core, alimony is not about punishing one spouse or rewarding the other.
02:20It's about ensuring that no one, especially a dependent, remains penniless.
