00:04tungkol sa hinihingi ng certification para sa impeachment trial

00:07ni Vice President Sara Duterte.

00:13Hindi raw dapat ituring na patibong ang certification

00:17na hinihingi ng Senate Impeachment Court sa Kamara,

00:20kaugnay sa impeachment ni Vice President Sara Duterte.

00:22Depensa ng tagapagsalita ng Senate Impeachment Court,

00:26kung tutuusin ang proseso raw na ito ay tumutulong

00:28para makaiwas sa problemang legal.

00:30So, the disrespect for or attempts to undermine the impeachment court processes

00:36threaten the independence and credibility of the court

00:40and jeopardizes public trust on the process itself.

00:44Nauna nang sinabi ni Congress Manchel Diokno

00:46na posibleng patibong ang pag-require ng Senate Impeachment Court

00:50ng certification mula sa 20th Congress

00:52na nag-asabi na handa silang ituloy ang impeachment complaint laban sa Vice.

00:57At dahil bagong Kongreso ang 20th Congress

00:59at hindi pa nakakapanumpa ang ilang bagong Senador para maging Senator Judge,

01:04nauna namang nanawagan si Sen. Rizzo Ontiveros na panumpain na ang mga ito.

01:08Pero sabi ng tagapagsalita ng Impeachment Court,

01:10Yung call po for swearing in of the Sen. Judges

01:14will need to depend on the existence of a presiding officer or a Senate President

01:20kasi po ang Sen. Judges will have to take their oath before the presiding officer.

01:26And as you know po, if one Congress adjourns and another begins,

01:31the Senate President is going to be elected or re-elected again.

01:36Ayon kay Tonggol, ayon ang presiding officer na si Sen. President J. Scudero

01:41na magkaroon ng kwesyon sa proseso ng pananumpa

01:44na maaaring magkaroon ng problemang legal.

01:46Kaya naman,

01:47So gusto ng presiding officer as a matter of prudence and diligence

01:51na gawin na lamang po yun kapag nag-elect na po ng Sen. President

01:56na tumatay yung presiding officer ng Impeachment Court ang 20th Congress.

02:01Nino naman ni Tonggol na hindi nawawala ng kapangyarihan si Escudero

02:05bilang presiding officer dahil may holdover capacity.

02:08Maaaring ma-question siya na bakit ka nag-ano?

02:12Bakit ka nag-swear in?

02:16Diba? Nakalagay sa rules natin, mag-elect muna tayo ng Sen. President.

02:19Okay.

02:20So, ayaw niyang mangyari yun na ma-question siya.

02:23And since wala pa rin naman yung compliance,

02:25kahit mag-swear in yung mga judges ngayon,

02:28wala rin naman mangyayari kasi wala naman convening pa ng Impeachment Court.

02:32Kasi nga, we have to wait for the certification or the compliance to the second order of the Impeachment Court

02:38bago po mag-convene.

02:40Sa harap din ng mga ugong na posibleng ipadismiss ulit ang impeachment,

02:44ang posisyon naman ni Sen. Sherwin Gatchelian.

02:47Yun ang aking posisyon.

02:48Even during the, even during the, uh, uh, uh, votation,

02:53the trial needs to begin.

02:55Whatever the defense will raise, whatever the defense, uh, the prosecution will raise,

03:01then doon natin pag-uusapan yan.

03:03At least out in the public at maririnig ng publiko.
