Justin Baldoni's lawyer promised to refile four claims against Blake Lively but he missed the deadline to do so ... and now he tells us his client "will be pursuing additional legal options" against Blake.
00:00You'll recall a couple of weeks ago, a big moment in the Blake Lively-Justin Baldoni battle where the judge threw out Justin Baldoni's defamation claim and said that you don't have a case here.
00:11And it seemed like that was a big victory for Blake. It certainly was.
00:15But Justin Baldoni's attorney, Brian Friedman, came on TMZ Live and said the battle was far from over and that there were parts of Justin's case that they were going to resurrect.
00:26In fact, he has not resurrected and the deadline has passed.
00:30Here's what Brian said to us just a couple of weeks ago.
00:33Those claims still exist. The judge just wants us to replete them and gave us a roadmap on how to do that.
00:39Will you do that?
00:39Of course we'll do that. I mean, you know, for sure.
00:43He didn't do it.
00:43For sure?
00:44He didn't do it and the deadline has passed, so there will be no lawsuit that anybody hears with respect to Baldoni versus Lively.
00:52Lively versus Baldoni is still in play and we are at the deposition phase.
00:58I have a theory here. My theory is that this was a decision made after he was on TMZ Live by Justin Baldoni.
01:09Yeah, I believe Brian when he was here said he was going to.
01:12But I think Justin Baldoni is just thinking.
01:15So let's see. The judge seems skeptical of my claim.
01:19We are about to enter the deposition phase where I'm going to have to pay a ton of money for depositions.
01:26And if there's a trial, lawyers' fees are going to be astronomical.
01:30And I may even have to pay her attorney's fees if I lose.
01:33Pay her attorney's fees, right?
01:34And it's not worth it to me. The judge has given me a signal. I'm taking the signal.
01:38Yeah, I think it's probably a pretty smart move.
01:40I think in the immediate aftermath of the dismissal of the defamation charges, there was a lot of emotion that he still wanted to get back into the case
01:48and prove to the court and the world why he believed that Blake had done him wrong.
01:54But after some thought and an understanding of the costs involved, they said sort of cooler heads prevailed.
02:00And I think they did the right thing.
02:01So I have a theory here that everybody thinks, well, this is a huge loss for Justin Baldoni.
02:07Not so fast, because now it's Blake Lively who has to prove her case.
02:14If both of them were still suing, a jury could have ended up saying, we don't believe either of you, 0-0, and nobody wins.
02:21Now it's either she's going to win or she's going to be Amber Heard.
02:25And that's the deal.
02:28So in a way, Justin's kind of off the hot seat and can focus on her claim.
02:33And if he wins her claim, then he presumably could get attorney's fees from her.
02:39And he's viewed as the sole victor.
02:42That is one of the great glass half full explanations I've ever heard.
02:45I mean, that is a really rosy sort of take on him losing the defamation case and being forced to dismiss the other elements of his claim.

03:18But he says, she says, all their reputation is going to be ruined at this point.
03:23There's no coming up from it.
03:25So we just need to call spade a spade and move on.
