Diddy is NOT going to take the stand and testify in his criminal trial ... because his defense team plans to rest their case Tuesday without calling any witnesses.
00:00The Diddy trial is going to go to the jury this week. Thursday, it looks like they're going to do closing.
00:06And this jury could get this on Friday. No idea how long it's going to take.
00:10But we do know that Diddy is not going to be testifying.
00:14Diddy's not going to be testifying. But apparently, at least as of now, there is somebody on the stand from Homeland Security.
00:22And they're the ones that initiated all of this. We're going to get into that in a minute.
00:26But as of now, and as we are doing the show right now, the person is still on direct.
00:33So assuming nothing significant changes, we are told they are not going to call a single witness.
00:39That they could simply stand up and rest their case.
00:43We are told the following. That the defense believes, A, the prosecution did not prove racketeering.
00:52B, they believe that the prosecution is not proven beyond a reasonable doubt that Cassie and or Jane did not did did not consent to having these freak offs and consent would be a requirement.
01:08As for the Mann Act, which is simply transporting a sex worker for commercial purposes of prostitution, their argument is, well, listen to what the sex workers said.
01:22They said they were not paid for sex. They were paid for time and discretion.
01:29So time to have sex.
01:31No, time to be with them.
01:34And during that time, they had sex.
01:37I'm not saying that the jury is going to buy it, but that's what the sex workers said.
01:42You think that's the weakest.
01:43I'm sorry, but this is a very, very desperate type of argument.
01:46This is what you hear all prostitutes and escorts say because they don't themselves want to be committing a crime.
01:50So you say, no, you just pay for my time when you pick me up.
01:54And then I fall in love and we happen to have sex, but that's all consensual.
01:57And the money's for my time.
01:59This is ridiculous.
02:00I think the jury will see through that on the Mann Act.
02:02On the other two serious charges, maybe they're right that the prosecution hasn't made a strong enough case,
02:07but this is a risky sort of tactic to not put on any defense and try to rehabilitate Diddy in any way
02:12and just rely entirely on the burden of proof being too high.

02:15Even on the Mann Act, it's not minors.
02:19So you have a bunch of consenting adults, right?
02:22So Diddy's got a lot of money.
02:24He's got some strange sexual proclivities in the view of some people.

02:32I mean, he transports sex workers across state lines, allegedly.
02:38And, you know, they have these freak-offs.
02:42You know, I mean, this is how he likes to spend his time.
02:44It's not a bunch of minors.
02:46Yeah, it just seems like bedroom police at this point,
02:48where they're poking around what he's doing in hotel rooms, in his bedroom.
02:53They're making big deal about lube, Astro Glides, baby oil, six-inch heels.
02:59I think Kid Cudi and his burned-out car would say the case is about a bit more than just his sexual proclivities.
03:04They built a RICO case, and they said he threatened the parents.
03:07He's a criminal.
03:08He's a criminal for sure, because we've heard numerous crimes, including the Cassie video.
03:12The issue is, is it organized crime or is he a disorganized criminal, which is what the defense is going to say.
03:20But what's really interesting, and Austin just hit on this, about whether this is really a bedroom police case.
03:27We are told that one of the things that the defense is mulling over is actually invoking the war with Iran.
03:36I guess I could call it a war now.
03:38That they are saying, what they're thinking of saying is Homeland Security, which launched this incredible offensive against Diddy,
03:51you know, at his Miami house, at his Los Angeles house, at the airport, all of these things,
03:57that their eyes should be on the Iranian ball, and that this is just underscoring how their priorities are really screwed up.
04:08Right, Harvey, and you mentioned those raids in L.A., Miami at the airport.
04:11They testified, one of the Homeland Security agents, that about 70 agents were involved on the raid at Diddy's house in Star Island.
04:19He's a famous guy.
04:20People know who he is.
04:21That just seemed like overkill at that point.
04:24Like, he's not, where is he going to go?
04:26He's not going to run away.
04:27Yeah, but, I mean, doesn't the military take care of stuff like Iran?

04:34Well, Homeland Security, no.
04:35That's kind of a lame argument.
04:38The argument is Homeland Security protects our homeland.
04:42Now they're busy rounding up people at Home Depot.
04:45Behind those two, you know?
04:46I mean, you've got a lot of federal agencies.
04:49And taco trucks.
04:49They're doing raids now at those sorts of places.
04:53There could be Iranian sleeper cells in America in Florida or something,
04:57and they're worried about what Diddy's got in his closet.
05:00It's both foreign and domestic, and they think Diddy's a domestic threat to a lot of people in this country.
05:05Homeland Security typically investigates sex trafficking.
05:09That's why they were on Diddy.
05:12He's a threat to anyone who wants to buy baby oil, because apparently he's just cleaning out the aisles.

05:29You know, you have to really think about this.
05:30He's looking at life in prison.
05:33So imagine if he would cry on the stand.

05:52And just to be clear, with the discussion we just had, because some people might think that that's like excusing Diddy's behavior towards people.
05:58Nobody's saying that he's a great guy.
06:00Just the question is, those three charges, have they met their burden?
06:04He's a criminal.
06:05He beat Cassie.
06:07He's a criminal for that.
06:08And there were other crimes that they clearly brought out.
06:10They didn't charge him for that.
06:11Well, they can't because it's a federal case and the beating, the statute of limitations is right.
