Diddy's defense team is coming out swinging against the prosecution ... accusing the federal government of unfairly spying on him amid his ongoing detention.

00:00Diddy says there's something nefarious going on while he's being detained at MDC Brooklyn.

00:06He says he's being spied on, that the feds have been working with the Bureau of Prisons

00:12to systematically take notes and sometimes take photographs and information that is being

00:20shared with the prosecutors.

00:21Wow.

00:22He says it means he absolutely cannot get a fair trial.

00:27Part of this has to do with the fact that he was denied bail again last week, and he

00:34thinks that part of the reason he's being denied is that the prosecutors are getting

00:39a head start essentially.

00:40They know what the strategy is that he and his attorneys are going to use because they've

00:46seen his notes, handwritten notes.

00:48With the raid, Charles, and we obviously know how they felt about that, that there was privileged

00:52information.

00:53Judge agreed, by the way, that the prosecution should not be able to see.

00:57They get access possibly to defense strategy here.

01:02Let's put it right out there.

01:03There's nothing wrong with prison officials, quote unquote, spying.

01:06That's a loaded term versus keeping a video or audio record of what's happening in there.

01:12Now, when you reach a limit, which is what he sort of seems to be alleging, that they're

01:17taking advantage of it to see his confidential attorney client, privileged communications,

01:22that goes over the line.

01:23But we've been hearing a lot from Diddy, right?

01:25I mean, this is-

01:26But isn't that the difference there, Jason?

01:28I mean, there are ... The thing that stood out to me when he said that there are handwritten

01:32notes that they are either taking or taking photographs of, handwritten notes between

01:39himself and his attorneys.

01:41That's different than a phone call.

01:43Obviously your phone calls are going to be monitored when you're in jail, but if they're

01:47taking photos of-

01:48This happens all the time, and Diddy just has really successful lawyers that are making

01:53a big deal of it, really good lawyers that are making a big deal of it.

01:56When they raided his cell, they were not going through fine tooth and comb to seeing what

02:00they could take and what they couldn't.

02:01They were taking everything.

02:02This happens all the time, and then you get back and then you determine, okay, these might

02:06be privileged, so we can't look at these and we can't consider them for prosecution.

02:10That is part of the process.

02:12He is being held over for trial because there was enough evidence to establish that he had

02:17committed some incredibly heinous crimes, that he was a flight risk, and that he was

02:22intimidating witnesses.

02:24He doesn't get all the privacy that he wants in there.

02:28That's not the way the system works, nor should it, nor could it.

02:32He's suffering for the price of whether you believe he's ultimately going to be found

02:35guilty or not.

02:36He's paying the price for being, at this point, found to be held over for trial.

02:43Is part of this a strategy for setting up, if he loses the case, setting up possible

02:49appeals, is to put all this out there?

02:52Yes.

02:53Obviously, all of it will be brought up in appeal if he loses.

02:55I think right now, they're really waging a war in the courtroom of public opinion.

03:00At this point, that seems to be what this is about, to get people on his side so they

03:05don't all abandon ship.

03:07He has his people supporters.
