Diddy's trial is on the verge of another jury shakeup due to one of them getting a strange text message that's left the judge with concerns this juror is talking about the case outside of court.

00:00Well, they are dropping like flies, it seems, in the Diddy trial.
00:03One juror excused, another on the hot seat.
00:07Yes, big time on the hot seat with the judge.
00:10But it started, the day is going to end with a decision about the second juror.
00:15The first juror, known as juror number six, that was their badge.
00:21But juror number six is no longer on the case.
00:24Because early this morning, before the jury came in,
00:28the judge addressed the issues that started last week with this juror number six,
00:33which was a question about where he lives and whether or not he should actually even be on this case.
00:39And the judge said that juror number six had shown a, quote,
00:43lack of candor about his residence.
00:47During jury selection, he had said that he lives in the Bronx with his fiance.
00:52But I guess through conversations he's had with people around the court,
00:58it came to the court's attention that, or prosecutor's attention,
01:02that he was saying something about New Jersey.
01:05And if he lives in New Jersey, you shouldn't be on a case.
01:09He wouldn't be part of that.
01:10He wouldn't be part of the jury pool.
01:12But here's the thing.

01:14The judge heard this from the prosecution on Friday.
01:20The judge then said, I'm booting this juror.
01:23By the way, we should say, actually, this started even earlier than Friday.
01:26Friday, he finally addressed it with both sides.
01:30But they'd been talking about it for a couple of days before Friday.
01:33So he boots the juror on Friday.
01:36Then the defense comes in and says, wait a minute.
01:41They think that this juror is, the reason prosecutors want to get rid of the juror
01:47is because the juror wasn't buying the prosecution's case.
01:51Now, how do they know that?
01:53Maybe gestures, reactions, whatever.
01:56But the defense, and he's an African-American guy who's a big fan of 90s hip-hop.
02:01So clearly, the defense would prefer to have this person on the jury.
02:06They feel there's a better chance than not that he's going to side with Diddy.
02:10Now, let me give you the reason.
02:12The thing that gives me just a little bit of pause here is that if it's so clear that
02:18this juror should not have been in that jury box, if it's so clear he's not living in an
02:25area from which the jury is pulled, then the judge would have said to the defense, sorry,
02:30I've already booted him.
02:32But instead, the judge says, hmm, I'll think about it.
02:35Let me think about it over the weekend.
02:36But hold on.
02:37No, no, no.
02:37Right.
02:38And the judge came in this morning and said, OK, I heard you out.
02:42I thought about it.
02:42But if it was so clear, why did he even?
02:44And actually, he's saying it's not clear.
02:46He's saying there are too many questions.
02:48But he said, look, we have alternate jurors.
02:51Let's use the alternate juror.
02:52Because I can't tell what this guy, he said this and he said that.
02:56That's not the way it works.
02:57That is exactly how it went down this morning.
02:59But that's not the way it works.
03:00On Friday, what actually happened is the judge did not remove him from the case.
03:05The judge said, this is what I'm inclined to do.
03:08And before, this is all after court on Friday.
03:10Right.
03:11And then the defense made their case for why he should stay on.
03:15The judge said, I will think about it.
03:17And because it's not clear.
03:18But he had not actually removed the juror yet.
03:20But because it's not clear, I'm just telling you, the defense has a really interesting argument
03:26here that the prosecution is trying to get rid of unsympathetic jurors.
03:31There is another juror.
03:33We got hung up on that one.

03:38The other juror, the issue with that juror, involves a text message.
03:43On Friday, this juror, not juror number six, informed the judge that he had gotten a text
03:49message he said from a phone number he didn't recognize.
03:52And the text said, are you juror number six?
03:56So he wanted to be open with the court about that.
03:59We're told that the judge drilled down, asked some more questions.
04:02Oops.
04:03And whatever the answers were, we don't know exactly what this juror said, but the judge
04:09was left feeling like, this juror might be talking to people outside of, talking to people
04:15about the case, which...

04:17This was an unknown phone number that, at least unknown...
04:21That's what the juror said.
04:22Unknown to the juror.
04:23And maybe the juror did think, who is that person?
04:26Because somebody obviously heard the news that juror six was booted.
04:30So why did that person text this guy and ask that question?
04:35Why would he know to text that guy?
04:37It seems that the juror actually knew the guy, but just didn't know that was a phone number
04:44of this guy.
04:45Could be.
04:45And if they knew each other, then how did that person know that he was even on the jury?
04:51What did he talk about?

04:54So at the bottom end of the day, you may have...
04:57We already have one new juror on the case, and there could be another alternate on by
05:01the end of the day on Monday.
