Malaysia is exploring the possibility of introducing legislation to regulate artificial intelligence (AI) as part of efforts to address emerging legal challenges in the digital era, says Minister in the Prime Minister's Department (Law and Institutional Reform) Datuk Seri Azalina Othman Said.

At a press conference on Monday (June 16), Azalina said she has written to Digital Minister Gobind Singh Deo to propose a meeting between the Legal Affairs Division and the Digital Ministry to begin discussions on drafting AI-related laws.

00:32the Online Harms Act is more about the implementation of in that platform,
00:39and the duty which is expected. But of course, for me, when you talk about children,
00:45you must also read with the Child Act. The Child Act talks about the duty, the responsibility,
00:52that is taken care of under the Kementerian Wanita. As far as we are concerned,
00:58we are looking into the SOAC Act, which is implemented by PDRM, certain offenses.
01:04But the SOAC Act, if you look at it carefully, is very, very wide. It looks at a lot of situation.
01:10So, the Online Harms is more about the digital platform. Especially now, the biggest challenge is the issue on AI,
01:17when they are using certain format. So, that's why I have written to the Digital Minister, YB Gobin,
01:27in reference to looking to more AI laws for our country. There should be a joint committee between
01:32and digital on more laws on AI. A joint committee.

02:19Okay, let's talk today. One of the issues is that you talk about banking documents that you sign.
02:25Now, you still can go to court and say that, well, you know, you did sign a document and you sign digital signature.
02:31If you have a situation where someone comes up with a defense, you say,
02:34can you prove I sign or I don't sign?
02:36So, of course, you're proving mechanism is all very technical.
02:39So, the law has to fit into that situation.
02:42Because the situation now with AI is all a different situation.
02:46It's not like a normal situation.
02:48So, now, on our part, we have already got the contract law committee.
02:52We've got the criminal law committee.
02:54We're looking to all this also.
02:55So, these committees are checked by seasoned judges, retired judges.
03:00They're all looking to certain situation that we have today.
03:03So, we will pull in and start combining to see from their perspective on the existing law that we have.
03:08So, for us, when we went to certain countries, they already got certain laws.
03:20But their laws are not just like EU law.
03:23Their laws are just a little bit.
03:25So, for example, the law minister from Uzbek will tell us their experience when they are digitalizing.
03:32See, one of the issues that I have today for me on Bahagian Undang-Undang is that we want to digitalize the court.
03:38Okay, now we have voice to text.
03:40And then we have a lot of online system.
03:44But what we want is that we want the court to be more efficient.
03:49So, the court is taking in documents, more digital documents.
03:53But we want it to be more.
03:54We want it to apply not only in Putrajaya, but it must apply elsewhere, especially at district court, outstation.
04:01So, those are areas that we have to look at.
04:03So, these are things that we have to keep moving.
