A three-member bench chaired by Justice Supang Lian says Anwar Ibrahim has shown special circumstances to justify a temporary stay pending a full hearing.
00:00The Court of Appeal has granted Prime Minister Anwar Ibrahim an ad-interim stay of a civil suit brought by his former research assistant Yusuf Rother over an alleged assault.
00:13The temporary stay is pending a full hearing of the Prime Minister's application, which will take place on July 21.
00:20A three-member bench chaired by Justice Supang Lian said Anwar had shown special circumstances to justify the grant of the application.
00:29The bench found that Section 44 of the Courts of Judicature Act 1964 empowered them to make an ad-interim order to preserve the integrity of Anwar's stay.
00:39Accordingly, the trial in the High Court will be put on hold until the stay application is resolved, the bench ruled.
00:46The trial of the suit was scheduled to take place before Justice Rosemar Rosane in the Kuala Lumpur High Court over seven days between June 16 and June 25.
00:55Anwar is appealing to the Court of Appeal against Rosemar's refusal to refer eight legal questions arising from the suit to the federal court for determination
01:05and is seeking a stay of all proceedings pending the outcome of that appeal.
