Blake Lively might end up withdrawing the part of her lawsuit alleging emotional distress at the hands of Justin Baldoni, but there’s a catch holding things up … this according to his lawyers.

00:00Another day, another round of the Blake Lively, Justin Baldoni legal war, which is going to go on.
00:09It has been going now for six months and will go on until early next year, unless they reach a settlement.
00:16And now it seems less likely than ever.
00:19But Justin Baldoni's side is claiming somewhat of a victory because his attorney, Brian Friedman, wrote a letter to the judge in this case.
00:30Saying that that Blake Lively intends to drop the emotional distress claim from her lawsuit against against Justin.
00:40Interesting. But like implying as if she didn't have any emotional distress.
00:44Well, it's a little more complicated than that.
00:46But what it comes down to, they say, Justin's legal team says they requested Blake's medical records because they wanted proof that she had gone through.
00:58She had suffered emotional distress, therapies, you know, therapist receipts or treatment.
01:04So this is very common, right?
01:05You have on the one hand a party that is claiming damages for emotional distress.
01:08And the other side is saying, well, if you want to prove those damages, you've got to provide to us your medical records showing that you, in fact, suffer these damages.
01:16Typically therapist notes and that kind of a thing.
01:18And you're waiving the privilege, the typical privilege that you'd have over those because you want to prove your case.
01:22So here, Brian Friedman, on behalf of Justin Baldoni, is insisting on those records.
01:27Blake Lively says, look, I don't really want to turn them over.
01:30So instead of turning them over, because I just don't want my private information out there and information is leaked like crazy.
01:37So I'm just going to drop those claims for emotional distress.
01:40It's hard for you to imagine ever suing for emotional distress and not having to turn that over.
01:45I mean, didn't they know?
01:46Didn't Blake Side know that it was all roads were going to lead to this point?
01:49That's just how her attorneys should know that.
01:51Everything we've noted about this case is that everybody anticipated an early resolution, right?
01:56But now the case is dragging on and trial is, you know, coming up.

02:09And we can never tell what is actually fact and what's not in this situation.
02:14He loves to take anything she says, anything she does, twist it for their narrative.
02:18And it just makes it look so much bad.
02:20But I guess we can put it all to their crisis management team, to be really, like, honest.
