00:11:09Nearly a year ago, the Japanese whalers filed a lawsuit in the United States against Sea Shepherd.
00:11:24Paul's lawyers have just called with an update.
00:11:27The news is not good.
00:11:29I mean, this is a U.S. court telling international crews that they can't do anything in international waters.
00:11:37It's rather strange.
00:11:41Captain Paul Watson calls a meeting to share the dire news with his crew.
00:11:45Japan has fired their first shot.
00:11:50They got the 9th District Court in the United States to issue an injunction against us.
00:11:57Defendants, Sea Shepherd Conservation Society and Paul Watson and any party acting in concert with them are enjoined from physically attacking any vessel engaged by plaintiffs, the Institute of Cetacean Research, Kyoto.
00:12:08The injunction prohibits the Sea Shepherds from doing three things.
00:12:13Physically attacking any whaling vessel, navigating in a way that puts any whaling vessel in danger, and getting closer than 500 yards to a whaling vessel.
00:12:22This is just one step down from the United States Supreme Court, so they have an incredible amount of power.
00:12:29Past Antarctic campaigns have included actions not prohibited by the injunction.
00:12:33Prop foulers, throwing butyric acid at close range, and ship maneuvers that have often led to collisions.
00:12:44So this ruling not only affects their engagement at sea, but as word spreads, they learn it also may affect them at home.
00:12:52So, if Sea Shepherd was to violate this, potentially there could be a lawsuit that could go after all the assets of Sea Shepherd.
00:12:59And as individuals, you as well could have your individual assets gone after.
00:13:04So, it creates a little element of danger legally for every person on the crew, especially for American citizens.
00:13:10If you are willing to put yourself on the front line, then you need to do so being fully aware that there could be consequences to that.
00:13:19If any of you are not really sure about it, and you want to leave, you have time now to decide.

00:13:30Crew members of each vessel will have to consider if they're willing to face severe legal and financial ramifications.
00:13:37It's one thing to, like, say, you know, I'm willing to die for wills, and then it's another thing to, like, actually come face to face with a long-term repercussion of what we're doing.
00:13:48For the Americans, the stakes are the highest.
00:13:51If the injunction were violated, Crew could be held in contempt of court and arrested.
00:13:55The court could impose penalties ranging from large fines to potentially the seizing of personal assets.
00:14:03Everybody, when they sign on with Sea Shepherd, knows that there's risk involved, but if we end up in court or jail, that could affect the rest of your life.
00:14:12Personally, I'm extremely close to my family.
00:14:15I've got a life outside of being on the ships.
00:14:19And, you know, this can jeopardize all that.
00:14:34As morning light breaks, the Sea Shepherd's discovered that the injunction has claimed its first casualty.

00:20:01While some people have chosen to leave due to the injunction, the rest of the crew that are here are standing even stronger in their beliefs that they're here for the right reasons.

00:20:35The Sea Shepherd fleet prepares to split up and begin the monumental task of searching the seven million square mile Southern Ocean.
00:20:43for the whalers.

00:20:49So, starboard engine clutched in.
00:20:56In the absence of the helicopter, with just four ships to cover this enormous amount of sea area, it makes it extremely difficult to find the whaling fleet.
00:21:06The Japanese fleet is made of four types of ships.
00:21:09A security ship, which guards the fleet.
00:21:12Three harpoon ships, which kill the whales.
00:21:15A hired tanker, which supplies the fleet with fuel.
00:21:19And the factory ship, the Nishinmaru.
00:21:22Our main target is the Japanese factory ship.
00:21:26Without the factory whaling ship, the Japanese whaling fleet cannot process the whale meat, therefore they cannot kill any whales.
00:21:32By shutting down just that one vessel, we shut down all five ships.
00:21:37Three Sea Shepherd vessels will spread out in the search grid to find the factory ship.
00:21:42While the last vessel, Captain Louisa's Sam Simon, will search for the fleet's refueling ship, the Sun Laurel.
00:21:49If we can get on the Sun Laurel, we basically shut down the supply lines.
00:21:55They can only function so long, and then they have to get back to refuel.
00:21:59And if we can control that refueling ship, that can be just as effective as showing that Nishinmaru.
00:22:04If it's good to get the Sun Laurel, that would really be a nice little price.

00:22:09Finding the Sun Laurel, it's a really difficult task, but we know that Sun Laurel usually comes down to just about 60 degrees south,

00:22:34With the helicopter no longer part of the Sea Shepherd's arsenal, the speedy Brigitte Bardot will be an essential asset in locating the factory vessel.
