Former Murang’a governor Mwangi wa Iria has acquired interim conservatory orders stopping ODPP and EACC from preferring charges against him and his family members.

01:15 And therefore, the court order became effective from the

01:40 time it was issued.

01:41 And we communicated to the media houses.

01:44 We communicated to the EACC and the ODPP.

01:47 And we informed them that we have a court order.

01:49 Staying the implementation of the decision dated the 13th

01:53 of April, 2024, which is a decision that arose from the

01:57 DPP's office, suggesting that my clients should be charged

02:01 before a court of law.

02:03 As of today morning, as at 8 o'clock in the morning, they

02:06 were aware of the existence of a court order.

02:09 And therefore, anything that they are currently undertaking

02:12 is a breach and a violation and a disobedience of the

02:14 court order.

02:15 They are very much aware.

02:17 We have also told you through these mechanisms that Mr.

02:21 DPP, in charge of the ODPP, the person in charge of the

02:27 prosecution at Milimani Courts, the magistrates

02:30 handling this matter at the Milimani Courts, the DPP and

02:35 the EACC, notice and knowledge of the existence of an order

02:40 insufficient service.

02:41 I therefore notify you that you are duly notified that with

02:45 me, I am in possession of a court order that states,

02:50 pending the hearing and determination of this

02:52 application, an interim conservatory order be and is

02:55 hereby granted, staying and restraining the respondents,

02:59 that is the DPP, the inspector general, the director of

03:02 criminal investigation and the ethics and corruption

03:04 commission, by themselves, their employees, servants,

03:07 agents, and successors, as I need to remind you, the

03:10 person acting or claiming through them, or under them,

03:12 from implementing, taking any action that may amount to

03:15 implementing the first respondent, that is the DPP's

03:19 decision contained in his letter dated 13th of April,

03:23 2024.

03:24 What else are we supposed to do if this is not a

03:27 sufficient notice?
