- Let's start off with obviously a story

that hits very home to you,

which is the fact that horse racing machines

could end up being extinct pretty soon.

I mean, if you can't have these things in Churchill Downs,

you probably can't have them anywhere, can you?

Yeah, so these historical horse racing machines

were recently ruled unconstitutional in Louisiana.

A couple of states where these are legal.

This was a little bit of an interesting story

last week out of Louisiana,

where the judge, like I said,

ruled that these machines are unconstitutional.

And the reason was, well, I guess first,

what are these HHR machines?
00:46
They're essentially slot machines
00:49
that use past horse races to kind of wager with.

To the unsuspecting eye, basically a slot machine,

but they fall in a lot of states under paramutual law,

which means that they're taxed

and regulated a bit differently

than your typical slot machine.

So in Louisiana, a group of voters were arguing

that they should be illegal,

saying that they're not covered

under the state's constitution,

considering these HHR machines as a new form of gambling,

which would have required all of the parishes or counties,

if you will, in Louisiana to hold a local vote

whether or not to authorize these machines,

much like they did with sports betting a couple of years ago.

With sports betting, each parish had to vote to legalize it.

And as we know, sports betting is legal in Louisiana,

in the vast majority of parishes,

but there are a few where you can't legally wager on sports.

So a group of voters got together

and kind of petitioned a judge who agreed

that these machines are unconstitutional.

Now, where might this go from here?

Still remains to be seen.

I called around to a couple of the off-track betting parlors

where these HHR machines are active in Louisiana.

Several of those are owned

by Churchill Downs Incorporated, CDI.

And the staff there told me that they were still in use,

even though the ruling said

that they needed to be turned off immediately.

I imagine some appeals will be coming sooner

rather than later.

So still remains to be seen what the next steps here are.

But just to kind of put a bow on this,

just specific to Louisiana,

like you said, in Kentucky,

the HHR machines are a huge business.

They help fund the overall horse racing ecosystem there

and quite popular with the public,

quite popular with lawmakers.

So if I had to venture a guess,

I doubt we see any movement elsewhere

outside of Louisiana on this topic,

but we'll see how this goes in Louisiana
