00:16 Justice Azizah, who chaired the Court of Appeal three-man bench, said she was minded to recuse

00:21 herself for the simple reason that her husband was directly under Thomas at that time and

00:26 on the basis that the case is of public interest.

00:30 She then asked parties whether they are objecting to her presiding over Najib's appeal.

00:35 Najib's counsel, Datuk Firuz Hussain Ahmad Jamaluddin, told the court that the instruction

00:39 from his client is to object since Thomas is the subject matter of the proceeding.

00:45 Lawyer Alan Adrian Gomez, representing Thomas, said they are not objecting as he has not

00:50 heard of any grounds, suggesting there was a real danger of bias if Justice Azizah hears

00:56 the appeal.

00:58 Justice Azizah then ordered the date to be fixed for case management to set the hearing

01:02 date for the appeal.

01:05 The bench, which also comprised Justice Datuk C Mi Chun and Datuk Lim Chong Fong, was supposed

01:10 to hear Najib's appeal on Wednesday to reinstate his suit against Thomas.

01:15 The suit was struck out by the High Court on November 25 last year.
