Leaked draft judgment in Rosmah's solar hybrid case suggests bias, appeals court told

The Court of Appeal was told on Thursday (May 15) that the High Court Judge had erred in refusing to recuse himself from presiding over Datin Seri Rosmah Mansor's corruption trial involving the RM1.25 billion solar hybrid project in Sarawak.  Rosmah's counsel Datuk Jagjit Singh submitted that Justice Datuk Mohamed Zaini Mazlan (now Court of Appeal judge) ought to have disqualified himself from hearing the case after he allegedly instructed the court's Research Unit to prepare a draft judgment prior to the delivery of his decision. 00:06must have been instructed to prepare an alleged draft judgment

00:10in the Solar Hybrid Project Graft case of Datin Seri Rosma Mansour.

00:15Lawyer Datuk Jagjit Singh, representing Rosma, said the research unit

00:19would not have prepared the draft opinions if instructions were not specifically given.

00:24He was submitting in an appeal filed by Rosma to recuse Justice Mohamed Zaini Mazlan,

00:31now a Court of Appeal judge, from hearing or making a decision on her corruption case

00:36involving a 1.25 billion ringgit solar hybrid project.

00:41Jagjit further submitted that the draft was clearly meant for the benefit of Justice Zaini.

00:46He said Justice Zaini's conduct, when taken as a whole, created a real danger of bias.

00:52He added that the act of requesting an officer in the research unit

00:56to prepare a draft judgment is highly improper, therefore unacceptable.

01:02The hearing continues before a three-judge panel on June 25.
