00:45what's the smash smash jd's reaction to the ethan vine

00:51last week video h3 h3 productions is suing three creators and i believe it's denims and let's see

01:07denims frogan and caseytron so i have not seen this video yet many people have shared it with me

01:15so we're gonna do a raw live reaction here hi there my name is ethan klein and my favorite

01:24heart and uh smash jd what are you willing dollars on lawyers today i invite why do you have me and

01:32ethan who extra eyes on your head are my favorite past time with you join me in creating generational

01:41wealth for my attorney that's a great intro let me tell you guys a story about a year and a half ago

01:51it's a big conversation called react gate react gate was a debate going on in the streaming community

01:57about what constituted fair use people like hasan xqc and many of the large twitch streamers would watch

02:03other creators entire video on their stream they would rarely add sufficient commentary or even how did

02:09he not say anything about sniper wolf by the way but anyways pause the video to speak most egregiously

02:15they would yeah exactly what i was uh like thumbnail rap thing so that they could i was reacting to that

02:22from the original where sniper let me know or sss sniper wolf i don't mind people reacting to my videos

02:29but i do mind when they play the entirety of my video a face cam in the corner or the occasional

02:35interruption does nothing to address that issue my video is still being played from beginning to end

02:41in someone else's stream or video it's neither ethical nor necessary to feature the entirety of

02:46someone else's work or you know they could do the bare minimum and ask for permission something that

02:52none of the major reaction channels have ever done when they should i should i reach out to hdh3

02:56before i react to this video no no you don't have to stream to re-upload my videos but to ask your

03:03question no i i don't want people to stream re-upload the entirety of my videos now understandably

03:10this made a lot of people angry because why should these content thieves essentially get more views

03:17than their author of the video which in a lot of cases was happening i mean people don't like

03:21injustice and this just we all see this and no it's not right i wish that would happen to my channel

03:26see one of the prime suspects called into my show to debate me unfortunately it's never going to

03:32happen on my channel so in that regard do you care at all about like so smashjt is just sitting there

03:40watching like the fact that it's illegal does that matter it might be illegal uh does that matter to you

03:46uh no it doesn't matter well if flat out doesn't because that's fair i gotta tell you i'm not the biggest

03:54fan of xqc i don't understand the draw to him he just he strikes me as a a very egregious douche

04:02i don't i don't understand how some people just get super popular i'm like what what the hell is his

04:09draw what is it just being douchey i don't get it watch me full screen can do the warm and watch your

04:16do that then watch your prime content for a week do a week of no reaction content and see how many

04:21views you get oh okay sure

04:28i mean that's content man it's original content at least the ultimate debate bro he hit him with the worm

04:56now ironically after this debate and in the wake of this large conversation the problem seems to have

05:02only gotten worse you have people like hassan piker paving the way of fair use with what's known as

05:08chair reacts when hassan gets up to go to the bathroom or to eat or to talk to his mom or to

05:14do whatever disappears for an extended period of time and leaves the video playing for his chair

05:20mr chair they call it idf had warned people to leave the area around the main airport in sauna

05:26uh did hassan just say i gotta pee and cough and then just get up while his video is playing and walk

05:36away yes

05:45and as you can see smash that uh the chair is very transformative from one month of footage guys

06:06and it was in this setting that i formulated an idea what if i could make a long form irresistible piece

06:14of content that i knew that these streamers couldn't resist they couldn't i thought i was original with

06:20chair jt all these people did it before me apparently but they don't have eyes so we still got that avoid

06:28the temptation of watching it yeah uh what's with the ice

06:34it's not that i is there a meme about ice in the internet right now i knew they would watch the entire

06:41video add little to no commentary react to it instantly giving them no time to form an opinion

06:47the trap was set and it worked even better than i imagined it would we captured pretty much every

06:53large streamer reacting to it in its entirety immediately after it was published now the thing

06:58is there were a few people that went above and beyond to commit copyright infringement for example

07:06denim sits here silently with nearly 50 000 live viewers that's 30 see look look at that

07:12viewership i i batting reaction subreddit moderators to siphon views and their intentions couldn't be

07:19clear that is the reaction from a sticky post her eyes are batting hey everyone we've seen a lot

07:24that is the reaction to watch the nuke without showing support for a besides besides the creators

07:30you know besides the cleavage aging with us directly the other reaction is the eye batting reaction here

07:36they're offering and also the looking like a smug for my work this is the is also a copyright reaction

07:43the snark subreddit has been a frequent and persistent infringer that's how i knew when this

07:48video came out the snarkers were going to encourage promote and push streamers to commit copyright

07:54infringement i should thank the snarkers actually because of their predictability they acted like double

07:59agents for us incriminating their favorite streamers and serving them up on a golden platter

08:04so thank you snark it's one thing for us well i mean i'd almost argue like this is not illegal

08:12and there's no problems with this if people want to watch someone else react to the content that's fine

08:17i go back to the well if they're just sitting there and staring at it so that h3h3 doesn't get

08:23the view and someone else does then yes that's where the issue is but just them serving this up here

08:29there's nothing wrong or illegal with this here specifically subreddit to admit it's engaging in

08:36copyright infringement but how do you get i know max k i know he didn't claim it was illegal i don't

08:40mean to say he is i i guess i'm just clarifying in case people are getting that out of this

08:45streamers themselves to admit that they're stealing content

11:52this is not a healthy environment and with people like hassan reacting to entire tv shows on stream my

11:58fears that sony or disney comes along sues everybody and sets a devastating precedent that could endanger

12:04our entire field now before i tell you who the three people i'm suing are i just want to make it

12:09clear that they all met this very specific high bar of criteria that i set that forth earlier these

12:17people were not targeted based on their gender their identity their political beliefs all three are on

12:22this list in fact they're the only three as far as i could tell that reacted to the full video drum roll

12:29please who's sweating at home guys casey tron the queen of ripping farts and bong loads they do musicals

12:37they're very musical people are you being serious dog what do you look you think i made this frogan what the

12:45hell was that who blessed her soul she's still rising can i use it can i walk away and use the

16:05reaction and just as a silly thought experiment we thought wouldn't it be funny if she spent more time

16:10smoking than she did talking and thinking there was no way that that could be true well we tallied

16:16them up and lo and behold there's 15 minutes 40 seconds of commentary first 18 minutes and 55 seconds

16:23of smoking wow she spent three minutes and 15 seconds longer smoking and uh i would guess just a

16:30guess i don't see the actual legend was just to express maybe she stopped smoking because she ran out

16:36of smoke from smoking 42 times what is happening i'm trying to follow what what is happening wait aren't

16:45you like not allowed to like do drugs on stream i thought that was against terms of service

16:50uh unless marijuana is like not considered a drug i don't know i haven't read the terms

16:57for that kind of stuff weed is okay okay okay so i've lost the plot the complaint continues indeed

17:06casey tron is often too obliterated to comment on the nuke and instead stares blankly at her computer

17:13screen and a span of two hours and seven minutes casey tron smokes marijuana frequently in highly

17:19concentrated forms through vaporizers on 42 separate occasions at one point casey tron is so wasted

17:26that she states quote what is happening i'm trying to follow but i've lost the plot to give you an

17:31idea the majority of her commentary comes down to this i don't understand this he keeps blurring it out

17:39though which makes me wonder if it is illegal um maybe in youtube are you doing because uh smash

17:49different platforms they they have different rules so maybe in youtube it's not allowed or maybe maybe

17:58even time is just playing it safe you know uh there's nothing wrong in playing it safe

18:04what is happening oh on youtube it's illegal okay there you go i was right see i thought i heard that

18:10i think keemstar was the one saying that i'm trying to follow see smash i was like

18:21oh again different platforms smash different moves is she won up and coming twitch streamer two years in a

18:28row which gives her a front page spot on twitch for a year for each of the two awards so there's

18:35definitely something going on in the back back room with frogan and people in twitch because what

18:40they do musicals they're very musical people are you being serious dog what do you think who watches

18:57this content whoa people who enjoys watching people destroy themselves online i keep going back to the

19:08george carl and the the remember guys remember that there are eight billion people on the planet 50

19:16of the world is dumber than that and then you start to be like oh that's who watches this stuff gotcha

19:29you think a hundred million subscribers this is the part that really got her soon is a lot of people

19:35compared to 80 million people on the planet without supporting ethan clime without necessarily supporting

19:43ethan clime so there are people out there with weird on here with weird fetishes that her intention

19:53of doing this is seeing people with weird likes and dislikes through her is why copyright infringement laws

20:01exist you could not and should not do that especially if your commentary consists of you taking bong

20:07loads at least try to well i was gonna say like i i'm not a court i'm not gonna try and pretend to be

20:17a judge or understand the law at all because i've already been dealing with lawsuits enough but um i don't

20:23necessarily have a huge issue with them saying like oh watch me instead of them because if your content

20:30sucks people aren't gonna watch you what i don't understand is why they're why people would want

20:37to watch them and they suck like that that's what i don't get that's what i keep going back to

20:43like it's almost like the free market should decide i keep thinking about that but then i go back to who

20:51is watching these people and why wouldn't they watch someone that at least provides some sort of insight

20:58some commentary like what what the hell even is this they're barely even having a pulse on these

21:07good point inkling the people who riot are the ones that watch this good point that's why i'm

21:12so out of touch with this who engage with the content well what was that oh sorry that was a flying

29:06stuff like that because at least i'm not like directly ripping from one content creator and

29:10not like a whole team and stuff and most of those videos have like five million views so the lawyer

29:15who watched this and reacted to this it's a lot harder to feel like i guess bad implied explicitly

29:21implied a single content creator does that make sense that uh what she's saying you know i'm sure

29:29if you click on a random part in the video i might not be saying anything sure whatever and i might now

29:33let's see how uh smash is going to uh we have to watch uh um it's not about the actual what she's

29:40saying it's the same reason you watch shows with your friends you want to watch it with other people

29:45a lot of people again the lawyer streamers on twitch for their react content almost as a curator so they

29:50don't actually want the entire thing that uh she's saying is stupid for the lawyer never will go

29:56through youtube and click a bunch of videos they like going to twitch because they like to have it as like

30:00this stream there was no justification there was no arguing from the people that talk to the people

30:05who watch twitch content are specifically there to watch it so they don't because scroll through youtube

30:10and find a video they like if what she was doing was if someone watches content and you know someone

30:15on copyright infringement there is a very low likelihood that they're going to go watch it

30:19separately regardless of how she describes it content or how she defends it on twitch

30:26aren't necessarily people that would be watching content on youtube that my friend is um called

30:31theft and you're a thief and now i'm suing you this is just a testimony to how brazen and how safe they've

30:39you know gotten that she thinks she can go on out it's a good point in public on video and say like

30:47i'm stealing this content because i want to i'm coping even though i know it's stealing um when people

30:53watch it with me they're definitely not going to go watch the original like you are way too

30:57comfortable committing crimes out in the open well there you have it three separate lawsuits for three

31:03separate geniuses now i want to make it clear again i hope it's been obvious about why i'm suing

31:10these three people and not others these people not only violated all the principles of fair use

31:16they also did it maliciously and that's the part that really got me i think if you're a reactor

31:23on twitch for the most part if you make a good faith effort to comment and if you make a good

31:28faith effort to promote the author to link to them to try to drive traffic to the original video

31:34according to the pretty much the right thing and that's fine and i would never sue what's important

31:40is the transformative absolute morons to state their intention to steal my property on video

31:46you know and to all the detractors who are saying that i'm targeting women

31:50that i'm a hypocrite for suing for copyright infringement i just have this to say

31:58i don't care what i do hope though is that you'll support their crowdfunding efforts to defend

32:02themselves because let's face it i want to make sure there's money left over for me when i win my
