00:00The Court of Appeal was informed on Monday that the defence in Siti Bainoon Ad-Razali's
00:06case intends to call Ismaneera Abdul-Manaf, the mother of the late Zayn Rayyan Abdul-Martin,
00:13to testify regarding a police report she lodged implicating a prosecution witness.
00:18Siti Bainoon's counsel, Haijan Omar, told the three-member bench, Justices Datuk Azman
00:25Abdullah, Datuk Azmi Arifin, and Datuk Dr Chuka Singh, that a notice of motion was filed
00:32on May 7 to introduce new evidence in his client's final appeal.
00:37The defence is also seeking leave to recall the prosecution's fifth witness, Yasmin Nahar
00:42Mahmood, for further questioning related to the police report dated July 25, 2024.
00:50Haijan submitted that the evidence could have a bearing on the appeal against the 12-year
00:55sentence handed to 33-year-old Siti Bainoon for the abuse and neglect of a teenage girl
01:01with Down syndrome known as Bella.
01:04Ismaneera and her husband, Zaim Ikhwan Zahari, are currently on trial at the Pataling Jaya Sessions
01:10Court for allegedly neglecting their autistic son.
01:14A verdict in their case is scheduled for July 21.
01:17Deputy Public Prosecutor Datin Azma Musa confirmed receipt of the defence's notice of motion.
01:25The court fixed June 3 for case management to schedule the hearing of both the motion and
01:30Siti Bainoon's appeal.
01:32In her supporting affidavit, Siti Bainoon stated that the proposed new evidence was not available
01:38during trial and is relevant to the grounds of her appeal.
01:42On May 3, 2023, the Sessions Court sentenced Siti Bainoon to 12 years in prison after finding
01:49her guilty on two counts of neglect and abuse involving 13-year-old Bella.
01:55Her request for a stay of execution was denied, and she was immediately committed to Khajang
01:59prison.
02:00She was also ordered to serve a five-year good behaviour bond with one surety and a
02:055,000 ringgit deposit, in addition to completing 200 hours of community service within six months
02:11of her release.
02:13The High Court upheld both her conviction and sentence on May 2, 2024.
02:20Siti Bainoon was convicted under Section 31, Subsection 1, Subsection A of the Child Act
02:262001 for offences committed at a condominium in Wangsamaju between February and June 2021.
02:36The section carries a maximum penalty of 20 years' imprisonment, a 50,000 ringgit fine,
02:42or both.
