00:26In a landmark judgment, the Supreme Court has directed the West Bengal government to pay 25%
00:33of the pending Dearness Allowance, DA, arrears to its state government employees.
00:39The interim order was issued by a bench comprising Justices Sanjay Karol and Sandeep Mehta,
00:45with a deadline of three months for compliance. The matter is scheduled for its next hearing in
00:50August. This decision marks a significant development in a long-standing dispute between
00:55the West Bengal government and its employees, who have been demanding parity in DA with central
01:00government employees. The issue began when some employees approached the Calcutta High Court
01:06seeking arrears and DA at central rates. In May 2022, the High Court ruled in their favor,
01:13directing the state to pay DA accordingly. However, the state government challenged this
01:18decision in the Supreme Court in November 2022. Currently, while central government employees
01:24receive 55% DA, their West Bengal counterparts get only 18%, even after a recent 4% hike added to the
01:32previous 14%. This disparity has led to prolonged protests by government staff, with some employee
01:39unions demonstrating for over 900 days. Bhaskar Ghosh, leader of the Sandrami Juto Munch, an umbrella group of
01:47employee unions, stated, that nearly 12 lakh employees and pensioners would benefit from the court's
01:53directive. Despite the incremental increases over time, a significant 37% gap remains. The West Bengal
02:01government has argued that matching the central DA rate would strain the state's finances. However,
02:07critics, including CPI, M, leader and senior advocate Bikash Ranjan Bhattacharya,
02:13dismissed this reasoning, accusing the government of spending lavishly on non-essential projects while
02:19failing to meet legitimate employee demands. The Supreme Court initially considered ordering
02:2450% payment of arrears but scaled it down to 25% after the state claimed financial stress.
02:31The partial payment, estimated to cost the state around 10,000 crore rupees, is seen as a compromise.
02:37Employees and union leaders welcomed the ruling, hailing it as a victory for workers' rights.
02:44Politically, the ruling has sparked sharp reactions. BJP leaders, including Amit Malviya and leader of
02:51opposition Suvendu Adhikari, called the court's order a major blow to the Mamata Banerjee government.
