00:00Human Trafficking in the UAE, What You Need to Know
00:03The UAE is committed to combating human trafficking
00:07and has further implemented a comprehensive legal framework
00:11to prevent, investigate, and prosecute trafficking offenses.
00:15This video aims to discuss the human trafficking laws
00:18and the measures taken to combat this crime in the UAE.
00:22The UAE has enacted Federal Law No. 51-2006
00:26on combating human trafficking crimes
00:28to combat human trafficking in the region.
00:31The law criminalizes all forms of human trafficking
00:34and aims to prevent and combat all forms of human trafficking in the UAE.
00:38The law defines human trafficking under Article I, Biz 1, as follows.
00:431. It shall be deemed to commit a human trafficking crime
00:46by any person who
00:47A. Sells, offers, or promises to sell or buy persons.
00:52B. Attracts, employs, recruits, transports, transfers,
00:58harbors, hosts, delivers, to receives persons,
01:03whether from inside the country or through its national borders,
01:07using threats of or use of force or other forms of coercion,
01:11of abduction, of fraud, of deception,
01:15of the abuse of power,
01:17or of a position of vulnerability for exploitation, C.
01:20B. Gives or receives payments or benefits
01:24to achieve the consent of a person having control over another person
01:28to exploit the latter.
01:302. The following acts shall be considered as human trafficking,
01:35even if this does not involve the use of any of the means
01:38indicated earlier in this video.
01:40A. Recruitment, transportation, transfer,
01:44harboring, or receipt of a child for the purpose of exploitation.
01:48B. Selling or offering to sell or buy a child.
01:513. Exploitation shall include,
01:54under the provision of this article,
01:56all forms of sexual exploitation,
01:58or the exploitation of the prostitution of others,
02:02forced labor or services,
02:04the removal of organs, slavery, begging,
02:06or practices like slavery or servitude.
02:09Punishments.
02:10The punishments for human trafficking are entailed under Article 2.
02:15Any person who commits a crime involving human trafficking
02:18shall be subject to temporary imprisonment for no less than five years
02:22and to a fine of at least 100,000 dirhams.
02:25Life Imprisonment.
02:27In the UAE, a person who has committed the crime of human trafficking
02:31shall be sentenced to life imprisonment in the following cases.
02:351. If the victim is a child or a disabled person.
02:392. If the act is committed by use of threat of imminent death or serious injury,
02:43or by physical or mental torture,
02:46or if the criminal is armed.
02:473. If the perpetrator has established or administered an organized criminal group,
02:52or is a member of such group,
02:54or if he has participated in the act's knowing of its purposes.
02:584. If the perpetrator is the victim's spouse
03:01or any ascendant or descendant of the same,
03:03or having authority thereover.
03:055. If the perpetrator is a public officer or public servant
03:08who has abused his position or authority for the commission of the crime.
03:126. If the crime is transnational in nature.
03:157. If the victim is suffering because of the crime,
03:19from an incurable disease or a permanent disability.
03:218. It must be noted under Article 6, BIS,
03:25that any person who publishes, by any means of publication,
03:29the names or photos of victims or witnesses involved in human trafficking crimes
03:33shall be sentenced to imprisonment and a fine of at least 10,000 dirhams,
03:37or either one of these two penalties.
03:398. Cabinet Resolution No. 75 of 2020,
03:43the National Committee to Combat Human Trafficking, NCHCHT,
03:48was established by way of this resolution.
03:51The Committee is responsible for developing policies and programs
03:55to prevent and combat human trafficking in the UAE.
03:58Article 3 of the resolution lays out the following responsibilities
04:01and functions of the Committee.
04:021. To study and update the legislation governing the issues related to human trafficking
04:08in a way that achieves the required protection as per the international requirements.
04:132. To prepare reports on the measures taken by the state
04:17to combat human trafficking in coordination with the concerned entities at the state.
04:223. To study the reports related to human trafficking
04:24and take necessary action in their regard.
04:274. To coordinate with the various concerned entities at the state,
04:31such as ministries, departments, institutions, and authorities
04:35concerning combating human trafficking
04:38and follow the actions taken in this regard.
04:405. To raise awareness about human trafficking
04:44by organizing conferences, seminars, publications, training, and others
04:49in a way that achieves the objectives of the Committee.
04:526. To participate with the concerned entities at the state
04:57in the international conferences and forums on combating human trafficking
05:00and transfer the point of view of the state in these international forums.
05:057. To carry out any work assigned to it in this regard.
05:08The NCHCHT developed the 5Ps approach, which stands for
05:12Prevention of Human Trafficking, Prosecution and Punishment of Traffickers,
05:17Protection of Survivors, and Promotion of International Cooperation.
05:21This approach has been the guiding force in combating human trafficking in the UAE.
05:25The UAE has established shelters and rehabilitation centers
05:29to provide assistance and protection to the victims of human trafficking.
05:34These shelters offer a safe haven for victims,
05:36where they can receive medical care and counseling.
05:39The victims are also provided with legal aid to pursue justice and compensation.
05:44At present, the UAE maintains a network of shelters, namely EWAA Shelters,
05:50which is established in Abu Dhabi, the Dubai Foundation for Women and Children,
05:55DFWAC, and Amun Shelter for Women and Children located in Ras Al-Khaima.
06:01These shelters are equipped with modern facilities, including medical facilities,
06:05educational and training facilities, and recreational facilities.
06:09The shelters provide a supportive and wholesome environment
06:12where the victims can heal and rebuild their lives
06:15after being rescued from human trafficking.
06:18In addition, the UAE government runs a 24-hour hotline
06:22that promotes reporting of human trafficking by the public.
06:25In conclusion, human trafficking is a serious crime
06:29that threatens the safety and dignity of individuals,
06:32and the UAE has made significant efforts to combat this crime
06:36by raising awareness and implementing a comprehensive legal framework
06:39that prevents, investigates, and prosecutes human trafficking offenses
06:44and provides protection to the victims.
