00:00Despite the ongoing and wide-ranging issue and questioning of the legality of the arrest of former President Duterte,

00:07Father Angelio Aquino, dean of San Pedro Graduate School of Law, clarified the legal basis of the case.

00:14In the program Mike Abilife, Aquino gave two legal basis for the arrest of former President Duterte.

00:22First, the membership of the country in the Rome Statute in 2011,

00:27where it is stated in Article 127 that even if the Philippines withdraws from membership,

00:33it will still have an obligation to do and will be held accountable for the processes

00:38included in the cases where there is a jurisdiction or power of the court.

00:44Second, it is stated in Republic Act No. 9851, Article 17,

00:50where it is stated that the government can issue an investigation and prosecution in favor of the International Tribunal.
