Bombshell in the Diddy prosecution ... CNN destroyed the only known copy of the 2016 video in which Diddy is seen beating Cassie in the hallway of an L.A. hotel ... this according to new court documents.

00:26Even though he's not being charged for this the prosecution wanted to play this video to the jury in the federal case

00:33I do not think that's going to happen because

00:37CNN according to the defense

00:40Altered this video before it aired it and has now destroyed the original. I like I said

00:47Unbelievable if true that that that original copy of that video has been destroyed. I

00:53Can't even get into why it would have been destroyed

00:56We're but the bottom line of the case as you say is if that is the if that's true

01:01It's gonna be a huge hurdle in its prosecution getting this admitted. It's not gonna get admitted

01:07But let's get into what happened now

01:09There is a joint letter that was filed today in federal court by both the prosecution and the defense

01:16Regarding evidence now this portion of the letter

01:20Involving the Cassie video it was the narrative is from the defense, right?

01:25So let's get into what the defense is saying. So here's what they say about the tape

01:29They say CNN purchased the only copy only known copy of the hotel surveillance footage

01:35Uploaded that footage into a free editing software

01:38Altered the video and then destroyed the original footage

01:42Even though it knew about and repeatedly reported about the federal investigation

01:48Okay, that is breathtaking for a couple of reasons number one, I mean obviously they paid for it and then destroyed it

01:56Between paying for it and destroying it according to the defense at least it was altered

02:01They did not air the full version. They said they sped it up. They took things out of sequence, right and

02:09And that's if true it is shocking

02:14Speeding up in the editing of it is not shot out as long as the out-of-sequence and that

02:19Can be shocking depending on what they are alleging. They're trying to tell there but again, I

02:25Cannot fathom a reason that they would destroy the original I get that you

02:31Upload it you're gonna edit and I agree with you that it seems to me the better thing to do would just air the raw

02:36Higher thing air the raw. Yeah, but even if you do edit it why destroy the original?

02:46According to this letter referring to the editing and this is where they define says it it the video also includes

02:53speeding up the video to make it falsely appear that the actions in the video are taking place faster than they are as

03:01Result the CNN videos do not fairly and accurately depict the events in question

03:07So I gotta say on that part. I

03:11Understand if you take it out of sequence

03:13That can definitely change some of the narrative and we don't know all the details as far as what was happening in that hotel room

03:22Walked out. I think the intimation Charles is this I think that there was a freak-off

03:29Allegedly going on in that in his in their hotel was trying to leave

03:32Well, that's what you think from the video

03:36It may be that the dispute they were having that caused Diddy to get violent the way he did

03:46That there might be more because would explain others as it pertains to the federal indictment

03:52That's what really matters exactly horrible and horrific as this beating is it's not what he's on trial for that is a state matter

04:07I'd like to go back to the video and the allegations about the deletion

04:10I really want to know we're gonna have to hear from CNN and they will be called to testify

04:17So eventually be called to testify and in that they're gonna talk have to talk about what was on that video

04:21Originally, it could be that the original had remember this is hallway surveillance a static camera in the hallway

04:27So it could very well be that there was 10 minutes or 15 minutes of just static hallway footage beforehand

04:34There's no reason why they deleted the original that is inexcusable

04:37What my information is is that the Intercontinental Hotel it was in Century City

04:43They closed that down and it's a new hotel now

04:46So there are there's nothing that they could that anybody can go to not going back to any server. Yeah, it's gone

04:53It's I guess I guess the point I'm making is so so they have let's call it five minutes of video

04:57CNN that that they aired and

04:59There's an allegation that they've taken it out of

05:03Order and they've sped up what we saw on television when CNN played it

05:07I just wonder if CNN still has the original of what they played before they edited it

05:12They they clearly have destroyed the original

05:15I just wonder what they still have if to your point Harvey they have taken that and they have forever

05:21Altered it so that it can't be

05:23Recreated puzzle together that is a death knell to what we should take into the pretense of the prosecution

05:27We should explain I want to get to legal Jason, but every lawyer learns this in first year law school

05:32It's called the best evidence rule that you are looking for the best evidence

05:37Which is the unedited version if there's an edited version?

05:42It's inconceivable to me that a judge would allow that in before a jury

05:47Because it doesn't necessarily represent the actual events even though you could argue

05:52Well, it basically does not good enough under the best evidence rule. You have to have the full

05:59unfiltered unedited

06:00Version of it and so if the judge knows that there is and by that point by the time the trial starts

06:06CNN certainly will have to answer to the judge if to no one else

06:11If not to the audience why they would have destroyed this but if the judge knows that there actually is

06:17More video that we're not gonna see you're right. I don't know how

06:21The judge would allow that it's just really bad video
