President Biden's annoucement Sunday that he's pardoning his son Hunter was nothing close to a spur of the moment decision ... TMZ has learned.

00:19On September 5th, Hunter did a strange move in his tax case.

00:22He submitted an open guilty plea, which means he was going to plead guilty to all the charges

00:27but not know what the sentence would be.

00:29I remember they came out and said, we just don't want to put the family through another

00:33trial.

00:34But they had already been through a trial, so all the stuff that had come out in the

00:38first one, it was already old news.

00:40I remember they said, we have a winnable case here, we're just doing it to put it behind

00:44So the open guilty plea seems pretty risky and pretty stupid, unless you've got an ace

00:48up your sleeve, like say, for instance, your daddy's president.

00:52We know that when he pled guilty, Biden had already committed to pardoning him.

00:59And hey, back in June, maybe he meant what he said.
