Constitutional Amendment | Maulana Fazal ur Rehman ki Taraf Say Asal Deadlock Hai Kiya? Inside News
Transcript
00:00We are seeing today that there is still a consensus.
00:04There was a meeting, then a second meeting, then a third meeting,
00:09but the government has not been able to table it yet.
00:11And there is still no complete consensus on this.
00:15You were also sitting in that meeting, we saw yesterday,
00:17when you were meeting Mullah Nafzul Rahman.
00:20Where is the matter stuck?
00:21What is the particular point where the negotiation has stopped?
00:28Bismillahir Rahmanir Rahim.
00:30One thing is that the Pakistan parliament has the constitutional legislative competency
00:36that it can amend the constitution.
00:40And its article 249 is very clear in this matter,
00:43that what process can be adopted.
00:46And if that process is initiated,
00:49then you need two-thirds majority in the National Assembly,
00:53and you need it in the Senate.
00:55After that, you will send the president, if you pass it,
00:58and after that, it becomes an act of parliament.
01:00Now, all the amendments that have been made in our Supreme Court on this,
01:05the Supreme Court of Pakistan has not called any constitutional amendment
01:08an ultra-virus of the constitution.
01:11Even if you had a case of the 21st constitutional amendment,
01:15which came recently, there was also a judgment on it,
01:18and they upholded that constitutional amendment.
01:22Because generally, the legislation that has the standard of checking the courts,
01:27altogether there are different constitutional amendments.
01:30Because two-thirds majority is behind that process.
01:34And it is a matter of deep thought.
01:36Now, the way you pointed out earlier,
01:39the consensus is that if you are going to reform the judicial system of Pakistan,
01:44and this is the wish and opinion of every person in Pakistan,
01:48whether he is sitting anywhere, whether he is in the media,
01:52whether he is in the parliament, whether he is a common man,
01:55whether he is from the justice sector, whether he is a lawyer,
01:57that the judicial system of Pakistan has the opportunity to improve it.
02:01And it is to be improved in both places.
02:03So, Mr. Hafiz, you are absolutely right.
02:05My question, I will make it a little more particular.
02:08At the meeting that took place yesterday,
02:10I saw you were there with Mr. Tehreek-e-Insaf and Mr. Moulana Fazl-ur-Rehman.
02:14Are there any suggestions from Tehreek-e-Insaf regarding this amendment?
02:18What is the discussion between Mr. Moulana Fazl-ur-Rehman and Tehreek-e-Insaf?
02:21What is the deadlock in this matter from Mr. Moulana Fazl-ur-Rehman?
02:27See, the thing is that when the meeting took place last night,
02:30the draft of the constitutional amendment that was to come,
02:34was not shared in that.
02:36So, when those things will come,
02:38definitely when you sit in the opposition,
02:41then you want everyone to come together and make a decision.
02:45And when you are in the government,
02:47then you want the opposition to be brought together.
02:51And if a consensus is being built,
02:54then I think this is a good initiative,
02:56both from the opposition and from the government.
02:59So, since you had a discussion with Mr. Moulana,
03:02do you see his views in favour of this amendment,
03:06or do you see his views in favour of Tehreek-e-Insaf,
03:08or do you see his views in favour of your current party position?
03:11See, the idea in this matter,
03:15I think all the political parties, including Mr. Moulana,
03:18want to improve the system of justice in Pakistan.
03:22And if you have heard the basic speech in their assembly,
03:27then there were a few major points in it,
03:29which were to improve the dispensation of justice system,
03:33to get rid of the colonial justice system,
03:36to get rid of the concept of a constitutional court.
03:39And that is also in your COD,
03:41in which all the political parties of Pakistan have endorsed it,
03:44including PTI.
03:46These are the other parties.
03:48So, it is in a broad thing,
03:50but the basic thing is that if it is done with consensus,
03:53then it is better for the benefit of this country.
03:55Right. Thank you very much, Mr. Afiz Izzan.
