The Industrial Court has held that Malaysia Airport's Sandirian Berhad was wrong to dismiss

its employee on grounds of misconduct after having condoned the act for which he was sanctioned.

In allowing the ex-flight security staff member's complaint of unfair dismissal, J.C.

Lin said the company never suspended Aminuddin after finding out about his misconduct.

Instead, they only counseled Aminuddin and secured from him an undertaking not to violate

Lin awarded Aminuddin a net sum of R36,363.60 in back wages and compensation in lieu of

reinstatement, having deducted 30% of the total sum due on account of the claimant's

Aminuddin had negligently released a female passenger without proper documentation at

KLIA's International Departure Hall checkpoint on December 7, 2019, and admitted to breaching

regulations and callousness when issued a show-cause letter.

Despite this, Aminuddin was told that investigations into the incident would continue, and he was

subsequently issued three additional show-cause letters, dated July 8, September 15, and November
