00:00The Industrial Court in Kuala Lumpur ruled that it can admit secret recordings of meetings into evidence in dismissal cases.
00:12Chairman D. Paramalingam said the court could consider such evidence, even if it was illegally obtained.
00:19He also said proceedings under the Industrial Relations Act 1967 are not bound by the rules governing evidence in civil and criminal courts.
00:29In an award last week, Paramalingam ruled that AgarCorp's Sundiran Berhad had validly dismissed its sales and marketing manager effective January 31, 2019.
00:40M. Dagan had contended that the recording of a meeting he had on January 28, 2019 with AgarCorp's general manager, finance manager and company lawyer was not admissible in evidence.
00:53He claimed that the recording in which he made several admissions was recorded by the company's service manager, Carlos Matheus, illegally and without his knowledge.
01:03He said the recording did not satisfy the test for the admissibility of audio recordings as laid down in the criminal case of Muhammad Ali Jafar v. PP 1998.
