00:00 Today, two major decisions regarding the former Prime Minister have been made.
00:03 Five years and four months after Mian Nawaz Sharif,
00:05 he was dismissed from the Evenfield Reference.
00:07 And the Chairman of the Justice Party was dismissed from office.
00:10 In just one day, two major news outlets have shaken the political landscape of the future.
00:15 On 6 July 2018, the court of justice of Islamabad,
00:19 sentenced Mian Nawaz Sharif to 10 years of imprisonment for corruption in Evenfield Reference.
00:25 During the hearing of the appeals of Nawaz Sharif against this punishment,
00:28 today, the Islamabad High Court has declared Mian Nawaz Sharif's sentence as illegal and dismissed him.
00:34 Mian Nawaz Sharif was presented before two Rukni Division Benches,
00:38 consisting of Chief Justice Amir Farooq and Justice Mia Gul Hasan Aurangzeb.
00:41 Nawaz Sharif's adviser, Azam Nazeer Tarar and Amjad Parvez,
00:44 gave evidence and said that the court of justice had dismissed Nawaz Sharif from Section 9A in Evenfield Reference.
00:50 In this case, only Section 9A5 is left, which is related to Amjad Farvez.
00:56 Amjad Parvez, while reading Section 9A5 of the Nayab Ordinance,
01:00 said that this case has to be proven by some facts.
01:05 This section requires that the accused be proved to be a public office holder,
01:08 the accused be proved to be a nameless person,
01:10 and that the accused's assets are not in accordance with his income.
01:15 Nawaz Sharif's lawyer said that the word 'nameless' has been used in the Nayab Ordinance.
01:20 Justice Mia Gul Hasan Aurangzeb insisted that the punishment was based on this.
01:26 Amjad Parvez raised the point that the investigative agency has to investigate the assets of the accused.
01:33 The accused's assets have to be compared with the assets of the accused.
01:38 Nawaz Sharif's lawyer, while gathering all the details of the assets,
01:41 the dates of the bombings, and the court, said that this case is such that
01:45 its dimensions have not been proven.
01:48 The Chief Justice raised the question that these assets came at the same time or at different times.
01:53 Amjad Parvez said that these properties came between 1993 and 1996.
01:59 And in the entire reference, Nawaz Sharif's relationship with these properties was not mentioned.
02:03 Whether it is JIT, NAB's report, reference, statement,
02:06 the assets of these properties were not mentioned anywhere.
02:09 There is not a single page that proves that Nawaz Sharif has any relationship with these properties.
02:14 Amjad Parvez raised the point that JIT's Chief Justice Zia also admitted during the hearing
02:19 that he has no evidence to prove that Nawaz Sharif has any relationship with these properties.
02:23 The Chief Justice again questioned that in all these documents,
02:27 the date of acquisition of these properties and their financial status are not mentioned.
02:30 Amjad Parvez replied that in some documents, the date and financial status are mentioned.
02:35 But there is nothing to prove that these properties have any relationship with Nawaz Sharif.
02:40 The most important question is the ownership of these properties.
02:44 There is no proof in any document that these properties have ever been the property of Nawaz Sharif.
02:49 There is no proof of the under-protection of Nawaz Sharif's children.
02:53 Amjad Parvez raised the point that all these things have to be proved by the prosecution.
02:57 The case is never transferred to the defense of evidence.
02:59 On the arguments of the lawyer of Nawaz Sharif,
03:01 Chief Justice Amir Farooq asked the question that is this all the work of the prosecution?
03:05 The lawyer said that yes, absolutely. All this has to be proved by the prosecution.
03:09 On this occasion, Justice Gul Hasan Aurangzeb looked at the lawyer of NAB and said,
03:12 are you noting all this? These are very important things.
03:15 The lawyer of NAB said that yes sir, I am noting this.
03:18 But Justice Gul Hasan Aurangzeb immediately replied that you do not have a pen in your hand.
03:23 Justice Gul Hasan Aurangzeb said to the lawyer of Nawaz Sharif that
03:26 we have recently given a decision that it is necessary to prove four mandir jat for the under-protection.
03:32 If none of these four is not proved, then it will not come under the umbrella of under-protection.
03:36 The lawyer of Nawaz Sharif called the court and said that why are you taking my test?
03:41 The lawyer of Nawaz Sharif also read the decision of Marim Nawaz in the court and said that
03:45 the court had written that there is not a single document to prove the opinion of the prosecution.
03:51 During the questions raised on the NAB prosecution,
03:54 the NAB prosecutor adopted the opinion that the references were issued due to the decision of the Supreme Court.
04:00 On this, Justice Gul Hasan Aurangzeb questioned,
04:03 what are you trying to say that it was your compulsion to issue the reference and the reference was issued and the punishment was also given.
04:09 During the hearing, the question of issuing an appeal was raised on the issue of Marim Nawaz's license.
04:13 The NAB prosecutor told the court that the NAB did not appeal against the decision of Marim Nawaz's license and now that decision is final.
04:20 So we cannot give arguments on this.
04:22 And in today's hearing, the NAB also withdrew the appeal against the license of Nawaz Sharif in the flagship reference.
04:28 And the court was dismissed on the basis of withdrawing the appeal.
04:31 Viewers, in this most important case of Evanfield, today, Mr. Nawaz Sharif was acquitted.
04:35 The appeal was unsuccessful in proving the crime.
04:38 From 2016 to now, to find these properties, from JIT to NAB prosecution, the resources of this country have been spent.
04:46 The court spent a lot of time and only 107 cases were submitted in this case.
04:51 Despite the 10 volumes of JIT, the boxes full of evidence and all the claims of NAB, this case was only 3 cases were submitted.
04:59 But the nation is still unable to know who is the real owner of these 4 flats of Evanfield.
