Court decision shows vernacular schools protected under Constitution, says MCA, Dong Zong, Jiao Zong

The Court of Appeal’s decision that vernacular schools are constitutional means that these schools are subject to protection under Article 152 of the Federal Constitution, says Chan Quin Er.   The MCA publicity bureau chairman also hopes that there will not be further challenges on the matter following the Court of Appeal’s decision on Thursday (Nov 23). 00:06 It's a very landmark decision by the Court of Appeal today.

00:09 Not only did the Court of Appeal rule that vernacular schools

00:13 and the use of Tamil and Mandarin in these schools are not unconstitutional,

00:18 it also upholds that the vernacular schools are protected,

00:23 are subject to protection under Article 152 of the Federal Constitution.

00:27 This is a very resounding and clear judgment.

00:30 We hope that this puts a stop to any future challenges to the existence of vernacular schools.

00:35 Vernacular schools existed even before Merdeka.

00:38 And when our drafters of the Federal Constitution drafted the Federal Constitution,

00:42 it had the vernacular schools in mind.

00:44 It was meant to protect the status and the right to exist,

00:49 the vernacular schools' existence in Malaysia.

00:51 And we believe that the Court's decision today not only affirms the KL High Court's decision

00:56 that was in favour of vernacular schools,

00:58 it underscores a very important feature of our Federal Constitution.

01:02 That is, the schools, in today's decision, it's very clear that they said

01:08 the schools, all schools, not just vernacular schools, any school,

01:11 is not considered a public authority or statutory authority,

01:15 meaning that the medium, the teaching language,

01:18 shouldn't be made compulsory in the national language,

01:22 which means that the schools have the freedom to utilise Mandarin, English,

01:27 any other languages to teach, because knowledge should not be discriminatory.

01:32 And it should be, and the people, and the rakyat should have access and freedom

01:36 to send their kids to vernacular schools, to receive the mother tongue education.

01:40 So that is something that we welcome, and we hope that the appellants

01:44 would respect the decision of the Court of Appeal,

01:46 and we hope that, of course, they do not further appeal.

01:49 We at MCA remain steadfast, we remain steadfast in upholding

01:53 this constitutional right for vernacular schools to continue to exist,

01:56 not just exist, continue to develop, to assist the country

02:00 in producing more quality nation builders.
