Hi, I'm Indiana personal injury attorney David Holub.
I’m prompted to make this video because of calls we’ve been getting from people who have had their CPAP or BI-PAP machine recalled. As a result of a Philips Company recall on their machines. In particular the machines that are being recalled have been reported to have been used in such a way that they may cause exposure to diethylene glycol (otherwise known as DEG). Now this is a solvent that is used in things like brake fluid polyurethane type products. It can lead to kidney damage, neurological damage, liver damage and can prove to be fatal.
Well, the recall is telling people to no longer use the product after they consult with their doctors. But many of the calls we’ve been getting are from people who have consulted with their doctor and their doctors say “well just stop using the machine.”
But if they stop using the machine, they are becoming very ill because they cannot find replacement machines. If everybody stops using a particular brand of machine and wants a new replacement machine. Well, there is just not enough supply.
So, we suggest that people consult their attorneys in addition to their doctors. It is possible doctors really do not understand the nature of the situation and are simply trying to protect themselves from liability.
The only type of cases that are viable are if you have a serious injury which could be a serious neurological injury, could be cancer that’s caused, or something of that nature.
But, one of the key things is that it maybe medical monitoring is required. Now what does that mean? Medical monitoring means going in for tests every year to see if there is some particular type of ailment that takes time to develop that’s actually developing. All of these things have to be considered. And, we are certainly advising people consult with their doctors before discontinuing their machines. Maybe in consulting with their doctors they should decide to have their machine tested to see if it is causing any problems. So they can continue to use it if a new replacement isn’t available.
