Man convicted of rape not allowed to have sex unless he gets married

TWIN FALLS, IDAHO — An Idaho judge sentenced a 19-year-old man to a year-long rider program with an unusual condition. He must not have sex with anyone before he marries.

Cody Duane Scott Herrera pleaded guilty to the statutory rape of a 14-year-old girl in March and was sentenced to 5 to 15 years in prison. His sentence was suspended in favor of a one-year-rider program, in which he would receive intensive programming and education.

Herrera will be released to probation if he successfully completes the program with one special condition: he won’t be allowed to have sex unless he gets married, and then, only with his spouse.
