Illegally Detained Bangladesh Youth Finally Being Sent Home from India

A Bangladeshi man is going home after being held illegally in an Indian prison for nearly a decade. Only being identified as Farookh, he faced charges of being involved in a murder when he was a juvenile... a sentence that shouldn't have lasted more than three years.
The Delhi High Court on Tuesday ordered the release of a Bangladeshi youth kept in illegal detention for nearly ten years.
Only being identified with his first name, Farookh, he was a juvenile when he was arrested in a murder case that went on for several years.
A juvenile up to 17 years old in India can be imprisoned for up to three years for any crime, including murder.
[Ajay Verma, Lawyer, Delhi High Court]:
"During video conferencing one day, he informed me that he was a juvenile on the date of incident and then I advised him to move a petition from jail, as a service available inside the prison. So, he moved a petition and we presented it before the court."
The trial court sent him to prison for life in 2009.
[Ajay Verma, Lawyer, Delhi High Court]:
"One day we found out in the newspaper that this person is still in the custody of the FRRO (Foreigner Regional Registration Office). So, on the basis of that newspaper (report), we moved a writ petition of habeas corpus on 6th May. The honorable Court directed the production of this Farookh and issued notice to the respondent's state."
The court has ordered Farookh's deportation within a week.

"They have filed the travel documents before the Court and they have informed that within a week, he would be deported with safe security. So the Court has also directed the state to also file the compliance report within a week thereafter."
