01:42Good evening, and it's great to have you with us here on a Tuesday night.
01:44We begin tonight with the breaking news in the Sean Diddy Combs trial.
01:47Late this afternoon, the jury telling the judge
01:49they have reached a partial verdict.
01:51They have decided on four of the five counts,
01:54telling the judge they are stuck on one of those counts,
01:56the racketeering conspiracy charge.
01:59The jury deliberating for just a day and a half
02:01and reaching this partial verdict, again, four of five counts.
02:04Their verdict not revealed at this hour
02:06because the judge telling them to keep going on that fifth count.
02:09The Combs trial went on for nearly two months
02:11with graphic testimony and disturbing sexually explicit images.
02:14Earlier today, the jury asking for a transcript
02:16from Cassie Ventura's testimony
02:18about this 2016 hotel attack captured on surveillance.
02:22She testified she was trying to escape when Combs assaulted her.
02:25The jury made up of eight men and four women.
02:28Combs has pleaded not guilty to all charges.
02:30Late today, the judge telling them to keep an open mind
02:32and to keep deliberating.
02:34ABC's chief investigative correspondent, Eric Ketursky,
02:36he's live at the courthouse tonight, and he leads us off.
02:38Aaron?
02:39After a day and a half of deliberations, David,
02:43we have an incredible cliffhanger here,
02:45a verdict but no conclusion,
02:47a defendant who looked shaken,
02:50and a jury told it's not done yet.
02:53Tonight, 13 hours into deliberations,
02:55jurors said they have reached a verdict
02:57on four of the five criminal counts against Sean Combs,
03:00but said they're stuck on the racketeering conspiracy charge,
03:04the judge instructing them to keep going.
03:06The eight-man, four-woman jury sent a note saying
03:09there are unpersuadable opinions on both sides.
03:12The note said the jury is prepared to release a verdict
03:14on the two counts of sex trafficking
03:16and two counts of transportation for prostitution.
03:19When the note came in,
03:20Combs, who was denied all charges,
03:22looked stricken.
03:23He sat in a chair with his chin resting on his palm,
03:26defense attorney standing in a huddle around him.
03:28At one point, Combs wiped his eyes.
03:30His mother, sons, and twin daughters
03:32sat stone-faced in the second row.
03:34Racketeering conspiracy requires jurors
03:36to find Combs led a criminal enterprise
03:38and agreed to commit at least two of eight underlying crimes,
03:41like arson, where prosecutors allege
03:43he jealously ordered the firebombing
03:45of rapper Kid Cudi's car,
03:47or bribery, where they say he tried to pay off
03:49a hotel security guard
03:50after surveillance cameras captured him
03:52attacking Cassie Ventura.
03:54The judge told jurors,
03:55I ask at this time that you keep deliberating.
03:58He reminded them of their duty
03:59to consult with one another
04:00and to deliberate with a view
04:01to reaching an agreement,
04:02adding they should not hesitate
04:04to change an opinion when convinced
04:06that it is erroneous.
04:07So let's get right back to Aaron Katursky,
04:09live at the courthouse tonight.
04:10Aaron, again, as you've reported,
04:12the jury at this hour says
04:13it's reached an agreement on four counts,
04:15the charges of sex trafficking
04:17and transportation for purposes of prostitution.
04:19But again, as you have reported here,
04:22they are stuck on the racketeering conspiracy charge.
04:25So what happens now?
04:26And what are legal observers saying tonight?
04:28A day and a half in,
04:29a partial verdict on four of five counts
04:32against Sean Combs.
04:33What could this mean for Combs?
04:36Based on his demeanor alone, David,
04:38he didn't seem to think
04:39this is going very well for him.
04:41But there really is no way to know for sure.
04:44And it could cut either way, honestly,
04:47at this point.
04:48We do know there is consensus
04:50on four of the five counts.
04:52So the jury is working together.
04:54Maybe they're stuck on what it means
04:56to be part of a criminal conspiracy.
04:59The jury's going to come back,
05:01start fresh tomorrow, David,
05:02after more than 13 hours
05:04of deliberations so far.
