00:00A convicted murderer set to be executed tomorrow is hoping the state's Supreme Court will step in.
00:06Thomas Gudinas was sentenced to death for the murder of an Orlando woman in 1994.
00:11News 6's Stephanie Rodriguez joins us live in studio with more.
00:15And Stephanie, if it does happen, he'd be the seventh inmate put to death by lethal injection this year in Florida.
00:21Yeah, he would be, but his attorneys are trying to stop that from happening.
00:24They're asking for a stay of execution, saying the state needs to have a criteria for who is put to death.
00:30Gudinas was convicted of raping and murdering 27-year-old Michelle McGrath in 1994 after she left an Orlando nightclub.
00:37In a petition to the state, his lawyer said Florida's governor has no criteria, procedure, or guidelines in place for selecting who lives and who dies.
00:47The attorney says the state should turn over records that would explain Governor DeSantis' choice to sign the death warrant.
00:53Now, we spoke to Michelle McGrath's sister last month about the execution, which she believes would bring her some closure.
01:00I would say over the last 30 years, occasionally I do look at the status of if he's still where I thought he was.
01:11And I'm not going to have to do that anymore.
01:13And that is actually kind of a relief.
01:15Now, the state attorney general's office did respond to Gudina's attorney, urging the Florida Supreme Court to reject the request to stay the execution.
01:24So now we just have to wait to learn if the Florida Supreme Court will stop it or will allow it to happen.
01:30It is scheduled to happen on Tuesday.
