00:00I said in your hearing, when you had your confirmation hearing, that my biggest concern
00:04with you at the helm was the potential use of the military in ways that contradict the
00:10Constitution or that taint what I hope we all want, which is an apolitical military.
00:16And when I asked you about whether you would accept an order that was actually given to
00:23your predecessor, Secretary Esper, Trump SecDef, to deploy active duty troops against unarmed
00:30protesters and to, in Secretary Esper's words, shoot at them, shoot at their legs, you said
00:37this was all theoretical.
00:38Here we are a few months later, you've deployed 4,700 troops to Los Angeles against the wishes
00:45of the governor.
00:46And my colleague across the aisle was right.
00:48It is the first time since 1965 that we have deployed guard troops without the permission
00:54of the governor.
00:54In all the instances he laid out, the president had sent in the military to protect protesters,
01:02not against the protesters.
01:03So you may dismiss it, but I feel like this is a fundamental issue of American democracy.
01:09If you love your country and you want an apolitical military, then it should be the last resort,
01:14not the first resort in our country to use them.
01:18So to get to the non-theoretical, have you authorized the uniformed military to detain
01:24or arrest protesters in Los Angeles?
01:29Senator, I would just start by saying you're not a protester if you're throwing concrete
01:33at law enforcement officers.

01:34Arrest those people.
01:35Throw them in the jail.

01:37But what you're doing is something different.
01:39Everyone knows this is a political decision, right?
01:42So we don't trust that you're using the best interests of the military, certainly, and of
01:46democracy on top of that.

01:52For the U.S. military, military, not law enforcement, they can arrest all day long.

01:57Do they have the ability, the uniformed military, to arrest and detain protesters currently today?

02:43ICE officers, who are trying to do their job deporting illegals who were allowed in by

02:49So they cannot arrest and detain citizens of the United States, the uniformed military.
02:53As we've stated, if necessary, in their own self-defense, they could temporarily detain
02:59and hand over to ICE.
03:00But there's no arresting going on.
03:02And you know this better than if you're trying to play political games, there's no arresting
03:07of U.S. personnel.
03:08Of the U.S. military against members of the protest.
03:12Have you authorized U.S. military cyber tools to investigate people participating in
03:18these protests?

03:20Certainly in no way that I'd be aware of.

03:25Have you given the order to be able to shoot at unarmed protesters in any way?

03:38What evidence would you have that an order like that has ever been given?
03:42It is based on Donald Trump giving that order to your predecessor, to a Republican
03:46secretary of defense who I give a lot of credit to because he didn't accept the order.
03:50He had more guts and balls than you because he said, I'm not going to send in the uniformed
03:54military to do something that I know in my gut isn't right.
03:57He was asked to shoot at their legs.
04:00He wrote that in his book.
04:01That's not hearsay.
04:02So your poo-pooing of this, it just shows you don't understand who we are as a country,
04:08who we are.
04:09And all of my colleagues across the aisle, especially the ones that served, should want
04:12an apolitical military and not want citizens to be scared of their own military.

04:21So I'm worried about you tainting it.

05:01It's the day after with Iraq and Afghanistan that so many of us have learned to be so deeply
