01:21Si Puno ang chairperson ng Philippine Constitution Association of Filconsa, ang pinakamatandang constitution watchdog ng bansa.
01:29At siya mismo may nakitang problema sa ilang hakbang na ginawa ng Senate impeachment court tulad ng pagbabalik sa Kamara ng Articles of Impeachment laban sa vice-presidente.
01:39Halimbawa, nag-promulate na sila nung sarili nilang rules and procedure.
01:46E wala naman doon sa kanilang rules na dapat magkaroon ng certification yung house to the effect na nasunod yung one-year aban.
02:03Wala naman yung rules and regulations nila eh. Eh bakit nila ngayon iniimpose yung reglamento na yan?
02:12Naniniwala si Puno. Wala dapat question na pwedeng tumawid ang impeachment trial mula sa 19th Congress patungo sa 20th Congress.
02:20Kinagawa nga raw ito kahit ng Senate Electoral Tribunal na dumidinig sa mga election complaint.
02:26Sa pagsusuri ng maraming galubhasa sa ating saligang batas, eh klarong-klaro naman doon na yung impeachment court is a continuing body.

03:14Nung nipit si President Clinton, eh nagkaroon rin ng mga bagong senador doon dahil sa eleksyon nila.
03:25Pero hindi nawala yung jurisdiction ng Senado.
03:29Paniwala rin ni Puno, dapat manatiling walang kinikilingan ang mga Sen. Judge at kailangan mag-inhibit ang mga hindi makakasunod dito.
03:38Yung pong requirement na kailangan ng isang wish ay maging impartial, maging fair.
03:48Yan po ay parte ng due process.
03:52At yan ay nandoon sa ating konstitusyon.
04:00Pag binayulate yung provision na yun, eh baka yung desisyon nila ay maging questionable.
04:06Kaya nauungkat ngayon ang usapin kung dapat bang ang Senado ang magsilbing impeachment court
04:12gaya ng napag-usapan noon sa diskusyon ng Constitutional Commission para sa 1987 Constitution.
04:19Sabi ng isa sa mga bumalangkas nito na si dating Supreme Court Associate Justice Adolf Ascuna,
04:25may mungkahin noon na ang Korte Suprema ang tumupad ng tungkuling ito kung di ito magagampanan ang Senado.

04:49Her solution is if the Senate is, for some reason or another,
04:54unable or unwilling genuinely to try and decide an impeachment case,
05:00the Supreme Court should fill the void in the exercise of some residual power
05:07and be the one to try and decide an impeachment case.
05:11Because the Supreme Court is impartial and it is a constitutional body.
05:17So it is well placed to fill the gap in case the Senators somehow refuse or are unable to act.

05:30Meron na nga tayong mga naging panukala dyan eh kung papalitan natin yung 87 Constitution natin.
05:37Na dapat ang maging court dyan ay hindi yung political principle government natin.
05:48Dapat mag-husga kagaya sa ibang countries yung tinatawag nilang constitutional court.
