00:00The Senate Committee on Foreign Relations is now in the Senate Legal Department
00:06to discuss the arrest of former President Rodrigo Duterte.
00:10Earlier, the members of the Cabinet and other officials did not attend the hearing.
00:16Let's witness it with Ma'am Gonzales.
00:18There is no question from the Executive, Police, and Military that the Senators heard earlier
00:27about the arrest of former President Rodrigo Duterte by the International Criminal Court or ICC.
00:33The Foreign Relations Committee wants to clarify who the doctor was
00:37who made it clear that the former President traveled even though he had high blood sugar,
00:41why the Philippines sent him to The Hague,
00:44and why the police escorts sent him did not have a passport or visa.
00:49It was clear from the headlines that the President gave that order.
00:54He said that he was just following orders.
00:57We want to know from Secretary Chudoro who gave the order
01:02because as you said, there is no one higher than the Cabinet member, but the President himself.
01:09According to the Senator, that airplane was regularly used by his brother, President Bongbong Marcos.
01:15Who authorized the charter or lease since it was a private aircraft?
01:20And if it was paid for by the Office of the President, where are the bid documents?
01:25We know that the mode of procurement is very long.
01:30The Air Force also has a presidential plane.
01:34Why is it being used differently?
01:36And why was it used again after President Duterte brought it?
01:43It was used again to go to us, to The Hague.
01:46Like what was clarified in the letter sent to the Senate,
01:49Executive Secretary Lucas Bersamin said
01:52that the first hearing of the Senate Committee on Foreign Relations was enough.
01:56That's why no executive was sent earlier.
01:59There are many probable or likely topics covered by those matters
02:06that would come under the Executive Privilege.
02:12But the Committee Chair, Senator Aimee Marcos asked,
02:15how is the statement of the palace of April 1 that the members of the Cabinet will not stop?
02:20Did they really do April Fools? We are really confused.
02:25I respect the doctrine of Executive Privilege,
02:28but let us remember that it cannot be used as a blanket shield,
02:34as a half-hidden weapon to question and avoid the Senate's invitation.
02:40There is a continuous mistrust that there is a cover-up to what is happening.
02:44I think we are now on the verge of a constitutional crisis
02:49if they continue to snub our invitation.
02:54I would like to move that we issue a subpoena to these government officials
03:01to require their presence in the next hearing.
03:04According to Senator Marcos,
03:06there is a subpoena, but it still needs to be signed by Senate President Cheese Escudero.
03:11Bring them here, here to the Senate, now.
03:15Escudero is now sending this to the Senate Legal Department.
03:19The court said that if the invocation of Executive Privilege is valid,
03:23the Senate's compulsory process cannot be used as a subpoena.
