It's giving a huge amount of power to one person, and that power is controlled by the court.

But the conservator is the person who exercises that power on a day-to-day basis, and that's

built in.

It's fundamentally a disability issue, and I think our society's stigma and ableism is

a big part of why they're so overused.

There's something called the school-to-guardianship pipeline, or school-to-conservatorship pipeline,

where people with intellectual and developmental disabilities end up in conservatorship as
01:35
soon as they turn 18, often because schools tell families that that's what they should

do or that's what they must do.

There are people who could use many, many alternatives that are less restrictive, that
01:50
actually protect people's safety better, that families don't know about.

Some people also end up in conservatorship during or after a psychiatric crisis of some

sort.

And then people end up in conservatorships later in life, as they age into disabilities

like dementia or Alzheimer's.

I want to be able to get married and have a baby.

I was told right now in the conservatorship I'm not able to get married or have a baby.

I have an ID inside of myself right now, so I don't get pregnant.

I wanted to take the ID out so I could start trying to have another baby, but this so-called

team won't let me go to the doctor to take it out because they don't want me to have

children, any more children.

In our view, the problems of conservatorship are not just outright abuse and neglect.

That's of course a harm and it's real and it happens a lot, though we don't know how

often because there isn't data about these issues.

But the other piece of it is that even where everyone is acting in complete good faith,

it's a harm to take away someone's autonomy.

It's particularly sad and painful in the context of young people with intellectual

and developmental disabilities who are told right when they're 18 that, you know, well

you don't know how to balance a checkbook yet, you never will be able to, so we're going

to take away all your rights.

Some of you may know that as a result of Brittany, California has passed legislation to try to

ensure that conservatorships like this that were corrupted by her father do not happen

again.

In recent months, one conservatorship has captivated the world, revealing the deeply

restrictive nature of these arrangements and just how easily they can be abused and

how difficult it can be to escape.

Of course, I'm talking about Brittany Spears.

Part of what needs to be done is really changing laws to be really explicit that conservatorship

and guardianship is the last resort and we also need more, much easier access to getting

out of conservatorships, to access the court to get out of a conservatorship, to have a

lawyer who could help you, you know, in the termination process.

There's a really wide range of how people can get support and make their own decisions

and this is the same as people without disabilities do as well.

If I decided what I was going to eat for breakfast today on my own, didn't talk to

anyone about it, did that.

If I'm going to buy a car, I don't know anything about cars, I'm not going to do that without

support.

I'm going to talk to people who I trust.

We need to expand recognition of that for people with disabilities that there are many

voluntary ways that people can direct their own lives and supported decision making is

an option there of helping people, allowing people with disabilities to choose people

they trust to help them make their own choices.

There are other things like powers of attorney that people can use or advanced medical directives

or simple documents to share medical information or share educational information.

Hopefully my story will make an impact and make some changes.
